ON-THE-JOB TRAINING AGREEMENT

The COOPERATING INDUSTRY

with Company Address ,
represented by the Company Representative agrees
to accommodate the STUDENT-TRAINEE,
, of (course) student of BiPSU- for the purpose of providing
training in various departments of the COOPERATING INDUSTRY. This period shall begin on
and will end on .

The following terms and conditions shall govern this agreement:

1. The COOPERATING INDUSTRY shall provide the STUDENT-TRAINEE orientation and
training on the areas pertinent to his/her line of specialization.
2. The COOPERATING INDUSTRY shall assign On-Site Supervisor who is responsible in
providing the STUDENT-TRAINEE with opportunities to work with specific department or area
where they can best apply theories, principles and ideas learned in the academe.
3. The training agreement shall not, in anyway, constitute an employer-employee relationship and
the STUDENT-TRAINEE shall leave the COOPERATING INDUSTRY free and harmless from
any demand, claim or complaint, whatsoever arising from this agreement, except in cases of gross
negligence, malicious acts and criminal acts by the COOPERATING INDUSTRY or any of its
officers and employees.
4. The status of the STUDENT-TRAINEE while on training shall be that of STUDENT-TRAINEE.
As such, shall not be entitled to any compensation and to any of the benefits accorded to an
employee.
5. The COOPERATING INDUSTRY may grant the STUDENT-TRAINEE a training allowance at
the former’s sound discretion.
6. The STUDENT-TRAINEE shall conform to all the rules and regulations of the COOPERATING
INDUSTRY while on training.
7. The STUDENT-TRAINEE shall not divulge any information that may have access to, and any
information will only be used for academic purposes.
8. Both the COOPERATING INDUSTRY and the STUDENT-TRAINEE have the right to pre-
terminate the on-the-job training if:
a. the STUDENT-TRAINEE does not show the required interest, maturity or discipline during
the training period, if there is serious misconduct
b. the COOPERATING INDUSTRY does not provide the kind of responsible training agreed
upon.
The terminating party will inform the On-the-Job-Training Placement Coordinator of the
grievance before any decision to terminate is made and finalized. The latter will intervene in
order to rectify the situation in the interest of all parties concerned.

9. That, both parties shall solve any problems existing, other than the above-mentioned provisions,
and shall resolve amicably in good faith.
10. The COOPERATING INDUSTRY shall issue a Certificate of Completion to the STUDENT-
TRAINEE with the grade embodied thereon upon completion of the on-the-job-training program.
11. The STUDENT-TRAINEE will submit a post-training report to the COOPERATING
INDUSTRY and On-the-Job Training Placement Coordinator and such will be the basis for the
release of the Certificate of Completion. The report may be used as basis of the COOPERATING
INDUSTRY as well as the Biliran Province State University (BiPSU) in the improving its on-the-
job training program.
12. The STUDENT-TRAINEE shall hold responsible on their actions against and found violated the
University Student Manual, code of ethics or rules and regulations of the COOPERATING
INDUSTRY in the duration of the program period.
13. No claim for damages by BOTH PARTY shall arise out of any breach of this
UNDERSTANDING if such breach is caused directly by individual or of any statute or
regulation, war, riot, civil disorder, revolution, acts public enemies, strike or other labor
disturbance, fire, act of God, or any other cause beyond the control of the parties.

14. The latter’s waiver “Annex A” and the parent’s consent “Annex B” are attached hereto as integral
parts of this agreement.
NOW, THEREFORE, for an in consideration of the foregoing premises, the parties shall undertake to
comply with the above undertakings in good faith and shall be enforce in the manner provided by the law
and by this agreement.
