painting professionals all over India. The Safe Painting Service connects you with a
service provider/ painting professional who will help deliver safe and hygienic home
painting/ Sanitization services using genuine and quality Asian Paints products. The
service also allows for free consultation with our representative to assist in the
selection of paint products, shades, textures, etc.

As part of this service, our representative has connected with you to understand
your painting needs. Based on the site evaluation and your painting / Sanitization
requirements, attached herewith is the service provider’s quotation for painting your
premises. The service provider’s contact details are mentioned in the said
quotation. Should you find the quotation to be satisfactory, you may contact the
service provider and confirm the same to him. Alternatively, you may reach out to

The Safe Painting Service /San Assure is subject to certain terms and conditions
which are mentioned herein below. By contacting the Service Provider and
accepting the quotation, you are agreeing to abide by the same.

“Asian Paints Safe Painting Services” (“APSPS”) are subject to the below
mentioned terms & conditions. In proceeding with the services, you, the customer
hereby accepts that you have read and understood these terms and conditions,
including those incorporated herein by reference, and AGREE to the same.

In Ref to your enquiry for Safe Painting Service.

1. Asian Paints’ role is limited to that of a facilitator, helping customers connect with
professionals for a seamless home painting and sanitization experience with
genuine Asian Paints products. Asian Paints’ role is restricted to that of supply of
paints only and introduction of the service provider. The final call of appointing
the service provider will rest with you, the customer.
2. Asian Paints does not investigate, assess, validate, or certify any Service
Providers / contractors / painters (Service Provider) and nor do we make any
certification, representations or warranties as to their professional competency,
training, experience. It is recommended that all the relevant checks,
assessments and due diligence be done by the customer prior to choosing and
engaging the service provider.
3. Asian Paints does not receive any commission through any transaction between
the service provider and the customer. It is further clarified that any work
undertaken and performed by service provider will be in their capacity as an
independent contractor(s) and there exists no agency between Asian Paints and
the service providers. The service providers are not bound to Asian Paints in any
manner by virtue and are free to advise the customer in all respects as per their
professional opinion.
4. Asian Paints disclaims all liability in respect of any service or work undertaken
and executed by the service provider. It is expressly understood by the customer
that any service performed by the service provider, will be an independent
contractual arrangement to which Asian Paints shall bear no role or liability
towards the services.
5. Mode of Payment: Asian Paints recommends that all payments to be made under
this service to the service provider be done by way of RTGS / NEFT / Cheque /
Demand Drafts/ E Payment only.
6. Warranty for products is subject to the terms and conditions mentioned in the

7. LIABILITY: Asian Paints’ liability shall be limited to the warranty provided and
shall be subject to the terms and conditions of warranty for the products supplied.
Under no event shall APL be liable for any indirect, incidental, special,
exemplary, punitive, or consequential damages and quality issues, whatsoever.
8. Governing Law and Jurisdiction: The services under APSPS shall be governed
and construed in accordance with the laws of India. Any dispute arising
hereunder shall be subject to the exclusive jurisdiction of the courts in Mumbai,
India.

speak to the Service Provider for any queries, concerns or clarifications.
10. This service is subject to force majeure conditions and in the event or occurrence
of any force majeure event including but not limited to fire, explosions, natural
calamities, state emergency, riots, epidemics, pandemics, public health
emergencies, etc., Asian Paints shall not be responsible for any delays caused in
executing the services, nor shall Asian Paints be liable to bear any penalty as per
the said offer/services.

“Asian Paints Safe Painting Services” (“APSPS”) are subject to the below
mentioned terms & conditions. In proceeding with the services, you, the customer
hereby accepts that you have read and understood these terms and conditions,
including those incorporated herein by reference, and AGREE to the same.

1. All payments are to be made as per stated milestones mentioned in the Payment
Terms. It is recommended that all payments be made by way of E-payment or
cheque.
2. Commencement of painting work is subject to realization of payments as stated
in the quotation and the site being made available free from all hindrances, for
carrying out the said painting work, until completion. Timelines for completion of
the painting work indicative and subject to the customer handing over the site fit
to start work, free of any encumbrance. We reserve the right to stop the work if
amount is not paid as per above payment terms and / or to exit the site till such
time as dues are cleared by the customer.
3. We shall not be held responsible or liable for any delays due to:
1. Delay by customer in handing over the site or disruption of work caused by
the customer.
2. Delay attributable to intervention of some other agency engaged by the cus
tomer to work on the site.
3. Delay attributable to any force majeure event, or circumstances which are
beyond our control.
4. We reserve the right to terminate this contract and exit the site in case of
unreasonable delays, changes, arbitrary demands, or misbehavior on the part of
the customer. In such case, customer shall not be entitled to any refund for
products and painting work completed on site
5. Permissions: The customer is solely responsible for arranging for all permissions
required for the purposes of executing the painting work at site, including but not
limited to any permissions, authorizations to be taken from the housing society,
or other authorities.
6. Cost for Scaffolding, Water, Electricity, storage for paints and any additional cost
/charges not specifically mentioned in the quotation shall be borne by the
customer and charges for the same are not inclusive and do not form part of this
quotation.
7. Once the material is tinted, paint / shades cannot be changed, cancelled or taken
back. In case a new shade is selected, the price of new shade product shall be
charged additionally to the customer and invoice for the same shall be issued.
Refund shall be at our sole discretion.
8. In case any additional work is to be done at the site, other than the work
mentioned in the quotation, customer hereby agrees to pay for the same, over
and above the quotation.
9. Governing Law and Jurisdiction: Services provided hereunder shall be governed
and construed in accordance with the laws of India. Any dispute arising
hereunder shall be subject to the exclusive jurisdiction of the courts in Mumbai,
India.
10. This service is subject to force majeure conditions and in the event or occurrence
of any force majeure event including but not limited to fire, explosions, natural
calamities, state emergency, riots, epidemics, pandemics, public health
emergencies, etc., Asian Paints shall not be responsible for any delays caused in
executing the services, nor shall Asian Paints be liable to bear any penalty as per
the said offer/services.
11. Authorized Dealer will not be able to take up the work in the below cases -
Structural repairs and others as identified in the site evaluation report are not
carried outproperly before paint application. These may include –
1. Concrete repairs
2. Cracks in the Column / beam/concrete slab
3. Loose plaster
4. Leakages through water storage tanks on terraces (any leakages through
storagetanks must be identified & rectified as per standard civil practices)
5. Water penetration due to capillary rise from the ground level, including
waterleakage, seeping and continuous dampness of the surface
6. Intermittent dripping of water due to overhanging branches, terrace
gardening plantpots or concealed plumbing lines
7. Leaks or damages resulting from any additional installations on the surface
coated with the system or usage on surfaces that already has pre-installed
elements that is not consistent with the recommended application
8. Leaks or damages resulting from Acts of God including but not limited to
lightning,flood, wind, earthquake, hurricane, tornado, hail or other violent
storm or casualty or impact of stated or unstated objects

It is recommended that in case of the surface is found to be affected in the above

areas,then it should be referred to a structural expert for technical solution.
