EXPLANATORY NOTES (NGANO? – current scenario)

WHEREAS, (in example) there is a huge number of stray animals present within the public spaces
of the barangay that is and might be considered as a threat to the community;

WHEREAS,

NOW THEREFORE, on motion of Councilor -----------, Committee Chairman on -----------------,

unanimously seconded by all members present, it was:

BE IT ORDAINED BY THE SANGGUNIANG BARANGAY OF ___________, MALITBOG, BUKIDNON,

IN SESSION ASSEMBLED, THAT:

Section 1. SHORT TITLE. This Ordinance shall be known as the “______________ Ordinance of
Barangay ___________ of Malitbog, Bukidnon”.

Section 2. SCOPE. This Ordinance shall be applicable to all persons within the territorial jurisdiction of
Barangay ____________ of Malitbog, Bukidnon.

Section 3. DEFINITION OF TERMS.

In example: STRAY ANIMALS – refers to stray dogs, cats, cattle, poultry animals found
along public areas within the barangay.

Section 5. EXEMPTION. The following cases shall be considered as exemptions to the foregoing
ordinance:

Kung unsay walay labot or wala naapil sa gibawal. In example, during celebration of Araw ng
Barangay, there will be impounding of stray animals.

Section 6. IMPLEMENTING AUTHORITY. The Barangay Officials and the Barangay Peacekeeping
Action Team (BPAT) are hereby assigned to implement this Ordinance. Kinsa ang magpatuman.

Section 7. PENALTY. The following penalties shall be imposed for violation of this Ordinance.

FIRST OFFENCE - P 100.00 and/or Community Service for hours/days

SECOND OFFENCE - P 500.00 and/or Community Service for hours/days
THIRD OFFENCE - P 1,000.00 and/or Community Service for hours/days

(BARANGAY LEVEL - FINE OF NOT LESS THAN P 100.00 AND NOT MORE THAN P 1,000.00 PER RA 7160)

Section 8. SEPARABILITY CLAUSE. If, for any reasons, any part or provisions of this ordinance shall be
held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall
continue to be in full force and effect.

Section 9. REPEALING CLAUSE. All previous ordinances inconsistent with this ordinance shall be
deemed repealed or modified accordingly.

Section 10. EFFECTIVITY CLAUSE. This ordinance shall take effect upon the approval of the
Sangguniang Bayan of the municipality of Malitbog, Bukidnon.
