MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT made and entered into by and between:

CENTRAL MINDANAO UNIVERSITY (CMU), a duly registered higher educational


institution created by virtue of R.A. No. 4498, with postal address at University Town, Musuan,
Maramag, Bukidnon, represented by its President ROLITO G. EBALLE hereinafter referred to
as "SCHOOL";
and

MONARK EQUIPMENT CORPORATION, officially regarded as HOST TRAINING


ESTABLISHMENT (HTE) with office address at Brgy. Sinaloc, El Salvador City, Misamis
Oriental 9017 represented by its Senior Supervisor – Human Resource, Ma. Katherine C.
Tumabiao, hereinafter referred to as "COMPANY".

Recitals:

WHEREAS, the SCHOOL is offering a course in Bachelor of Science in Business


Administration majors in Financial Management, Marketing Management and Operations
Management, wherein qualified students/trainees are required to undergo 600 hours of
Internship prior to graduation. The objective of the program is to expand the horizon of the
students by applying their theoretical learning on business arena specifically in the areas of
Marketing, Operations, and Finance in the actual world of work and exposure them to different
working environment;

WHEREAS, the SCHOOL is in need of host training establishment that could further enhance
the acquired knowledge, skills, and experience of its trainees;

WHEREAS, the COMPANY has the premises, facilities, resource persons, and expertise that
may be made available to the SCHOOL (CMU) for an INTERNSHIP in the line with the
SCHOOL's training program and as part of the COMPANY's corporate social responsibility and
development programs;

WHEREAS, the PARTIES have agreed to enter into partnership for the successful
implementation of school's INTERNSHIP.

NOW, THEREFORE, the PARTIES agree as follows:

I. RESPONSIBILITIES OF THE PARTIES

A. Joint Responsibilities Both the SCHOOL and the COMPANY shall:

1. Create a joint undertaking that will prepare the action plan to operationalize the
partnership. The group shall, among others:

(a) Develop an INTERNSHIP Schedule of activities that will be followed by the students
during the whole duration of the INTERNSHIP. Such activities must be relevant to their
field of study, varied in nature to expose them to all facets of the work, and of practical use
and application;

(b) Regularly evaluate the effectiveness of the program and update or revise as needed
based on inputs from stakeholders;

2. Pursue a joint effort to monitor the progress of the partnership and to make sure that the
provisions of this Memorandum of Agreement (MOA) are met.

B. Responsibilities of the SCHOOL

The SCHOOL shall:

1. Provide a list of students, assigned in the company, under its INTERNSHIP program who
will undergo the required INTERNSHIP, to be attached as Annex "A" and be made
integral part of MOA;

2. Designate an ADVISER/FACULTY-IN-CHARGE to liaise with COMPANY and


supervise the activities of the students for the duration of the INTERNSHIP;

3. Monitor students' progress to ensure that the tasks assigned to them are meaningful,
applicable to their particular programs, and are able to maximize the quality of the
learning experience;

4. Provide the COMPANY an evaluation tool for the students' performance;

5. Issue final grades/component for the computation of the final grade to the students
upon completion of the requirements within a prescribed period;

6. Ensure that the students, faculty, staff, administrators, while within the company
premises, will adhere to the policies of the COMPANY especially on safety, security, and
environment;

7. Voluntarily withdraw a student-trainee who is found to misbehave and/ or act in defiance


to existing standards, rules, and regulations of the COMPANY and impose necessary
college sanctions to the said student-trainee;

8. Comply with the Non-Disclosure Agreement between the PARTIES. The SCHOOL shall
be responsible for ensuring that confidentiality is maintained by its administrators,
faculty, staff, and students.

C. Responsibilities of the COMPANY

The COMPANY shall:

1. Designate an IMMEDIATE SUPERVISOR to liaise with the SCHOOL, and the different
departments of the COMPANY that are involved in the INTERNSHIP, ensuring that
agreed upon schedules of activities are followed and all resources to be provided by the
COMPANY are ready and available;
2. Provide the student-trainees a general orientation on the COMPANY, its stakeholders, its
business, the functions of the various departments, and the policies that they are bound to
comply with during the duration of the INTERNSHIP;
3. Give duly identified SCHOOL faculty, staff, and students access to the COMPANY
premises and resources allotted for the INTERNSHIP, provided that access and use are
strictly in accordance with the approved schedule of activities.

The COMPANY reserves the right to evict from the premises and bar entry to any member
of the SCHOOL found to commit serious misdemeanors and serious violations of the
company policies, and endanger the safety and security of the COMPANY and its people.
4. While within the COMPANY premises, the COMPANY shall safeguard the well-being
and safety of the trainees as they perform various relevant tasks during the training.
Students shall not be unnecessarily exposed to hazardous materials and placed in risky
situations. Personal Protective Equipment will be provided by the COMPANY as needed;

5. Lend its expertise by making available its resident resource persons to provide 500 hours
of training to the trainee during the INTERNSHIP period;

6. Evaluate students' performance using the evaluation tool provided by the SCHOOL and
co-sign with SCHOOL a Certificate of Completion upon satisfactory compliance with all
requirements of the program. The COMPANY shall inform the SCHOOL as early as
possible any misconduct committed by the student trainees and/ or untoward
circumstances for proper action;

7. Maintain confidential the personal data of the students, faculty, and staff who will
participate in the INTERNSHIP and process the personal data only in line with the
implementation of the program and in accordance with the Company's Data Privacy
Policy;

8. Allow the student interns to participate in approved college and university undertaking
that requires their presence provided that an approved communication of the activity is
presented to the immediate supervisor.

II. CONTRACT PERIOD, RENEWAL, AND TERMINATION

This agreement shall take effect on February , 2024 until May , 2024. It may be renewed
on an annual (school year) basis upon mutual agreement of the parties and subject to the
execution of a Letter of Renewal signed by both parties, which shall be made an integral part of
the original agreement.

Either party may pre-terminate the agreement by providing a thirty (30) day prior written notice.
Within the one-month period, the PARTIES shall comply with their remaining obligations up to
the pre-termination date. All deliverables shall be turned over on or before the final date.

III. LIABILITY

The SCHOOL, its administrators, and teachers exercising authority and supervision over the
students undergoing INTERNSHIP in the COMPANY premises shall be responsible for their
students and may be held accountable for students' acts that violate national and local laws, and
company policies. It is understood that the COMPANY is merely providing the resources for the
INTERNSHIP. It has no authority whatsoever over the students and other.

Members of the SCHOOL, except the right to evict and bar people from the premises in Section
IC.3 above.
