The Aam Aadmi Party targeted the BJP saying its only job is to defame Arvind
Kejriwal and alleged that it is behind the Enforcement Directorate's charge sheet
which is likely to be filed soon in a city court. The ED is expected to soon file a fresh
charge sheet in the Delhi excise policy-linked money laundering case and it may
name Chief Minister Arvind Kejriwal, BRS leader K Kavitha and some others as
accused, the official sources said. The Aam Aadmi Party sources alleged that the ED
charge sheet is in fact the BJP's charge sheet. The BJP's only work remains to
defame Kejriwal, they said. Kejriwal, who is also the national convener of the AAP,
was arrested on March 21 by the ED and is currently lodged in Tihar jail under
judicial custody in the money laundering case. Delhi BJP president Virendra
Sachdeva said the case is sub judice and any comments can be made only after the
agency files the charges sheet.

On Tuesday, the bench hinted at granting interim bail to Kejriwal to enable him to
campaign for the upcoming Lok Sabha elections. However, it had also said that if
interim bail were granted, Kejriwal would not be allowed to discharge any official
duties as Chief Minister.

With filing of the combined chargesheet, detailing charges against Kejriwal, AAP and
Kavitha, ED is likely to conclude its investigation in the case and seek the court's
permission to initiate trial which has been pending for more than a year.
In its earlier submissions before courts, ED had claimed that Rs 45 crore of the
kickbacks received by AAP was used by the party for its campaign in the 2022 Goa
elections.

The party added that Kejriwal's legal team has also filed a formal complaint with
SC's registry denouncing ED's affidavit as a "blatant disregard of legal procedures"
and submitted without approval of the apex court when the matter was already
slated for a final decision on Friday.
Questioning ED's objection to the interim bail, AAP said even after two years of
investigation in the liquor policy case, not a single rupee or incriminating evidence
had been recovered. It also questioned Kejriwal's grounds of arrest and alleged that
it was based on statements made by other implicated persons. "ED has relied solely
on the statements of these accused-turned-witnesses with direct links to and
benefitting from BJP," the party said in a statement.

A day before Supreme Court's verdict on whether interim bail is to be given to Delhi
chief minister Arvind Kejriwal, Enforcement Directorate told the apex court that if he
is granted relief for campaigning, all politicians arrested under any charge across the
country would seek parity.
In its affidavit, ED said SC, while rejecting bail to another excise case accused,
former Delhi deputy CM Manish Sisodia, had said, "Rule of law means that laws
apply equally to all citizens, including the state. Rule of law also mandates objective
and fair treatment to all."

in jail
On Wednesday, the Delhi high court dismissed a public interest litigation filed by a
lawyer demanding proper provisions for CM Arvind Kejriwal to manage the
government from jail, with Rs 1 lakh costs. The petitioner also sought to prevent
Delhi BJP president Virendra Sachdeva from exerting "undue pressure" on Kejriwal
to quit. A bench led by chief justice Manmohan remarked that because the AAP
leader had already appealed the Supreme Court against his detention, "no orders
were called for" in terms of providing him with any accommodations while in judicial
custody. The bench, which also included Justice Manmeet PS Arora, added that the
court cannot restrict the media or prevent political rivals from making statements.

Justice Swarana Kanta Sharma, who listed the matter for further hearing on May 14,
was informed by the counsel for the probe agencies that they needed some more
time to respond. The counsel for Sisodia opposed the request, pointing out that ED
and CBI had assured the Supreme Court that the trial would be completed in six
months.
The court recorded that “ED is in the process of filing another prosecution complaint
in relation to a co-accused in the case…irrespective of that, the accused is in
custody, and four more days are granted to the respondents to file their replies. The
reply will be placed on court record by Monday and an advance copy is also supplied
to the other side by Monday.”
In the high court, Sisodia has challenged a trial court’s April 30 order by which his
bail petitions were dismissed on the ground that the stage was not right for granting
ba il to him.
