Subject Code: 7.3 Drafting, Pleading and Conveyancing
Time: 3:00 Hrs.
Total Marks: 70
INSTRUCTIONS:
1. Read the questions carefully and answer.
2. Unnecessary queries on the Question Paper shall not be entertained.

Answer any five questions from the following. Question Nos. 3 & 4 are compulsory. All
questions carry equal marks.

1. (a) Mr. Robert purchased a mobile phone priced at Rs. 80,000/- (Rupees Eighty
Thousand) from Mr. John's shop, situated at Maligaon in Guwahati. He paid Rs.
10,000/-(Rupees Ten Thousand) in cash and issued a cheque for the balance amount
of Rs 70,000/- (Rupees Seventy Thousand). Mr. John deposited the said cheque, in
the Global Bank, Ulubari Branch, but it was returned unpaid, on account of
insufficient funds in Mr. Robert's account. Draft a Notice for dishonor of the said
cheque on behalf of your client.

(b) Draft a “Will” on behalf of Mr. Sharma, bequeathing all his movable and immoveable
properties in favour of his wife.

2. Patricia, a film actress reads an article about herself in a popular film magazine which she
considers defamatory. She decides to file a case against the editor of the magazine. As her
lawyer draft a plaint in a suit for recovery of damages on the ground of defamation.

3. Ramesh has left his matrimonial home without any reasonable excuse and refuses to
return, inspite of repeated requests from his wife Arati. She wants her husband to return
home. Both parties are Hindus. As Arati's lawyer advise her and draft the petition based
on the advice you have given her. (14 Marks)

4. Atul hit Rajesh with an iron rod on his head as a result of which, Rajesh was badly
injured. He lodged an FIR against Atul in the Jalukbari Police Station under section 326
of the Indian Penal Code 1860, which is a cognizable and non-bailable offence. Atul's
next door neighbour, informed him that the police had come to his house looking for him
in connection with the said FIR. As Atul's lawyer advise him and draft the Bail
application on his behalf.

5. (i) Mr. Allen wishes to gift his movable and immoveable properties to his daughter on
her 21st birthday. Draft a gift deed on behalf of Mr. Allen in favour of his daughter.
(ii) Write a short note on the component parts of a conveyancing Deed.
(7+7=14 Marks)
6. Draft an Agreement for Sale of an immoveable property situated in your place of
residence, containing the usual terms and conditions of a sale. (14 Marks)
