PERMISSION TO FILE ADDITIONAL DOCUMENTS UNDER THE
CONSUMER PROTECTION ACT, 1986.

Delhi the Humble Petition of the Complainant Above Named

IT IS MOST RESPECTFULLY SHOWETH: -

1. The present complaint case has been preferred by the complainants herein

to take legal recourse under the ambit of Consumer Protection Act 1986

against the Respondent/Opposite Party to initiate the proceedings under the

scope of said act. The Complainants have preferred to file this petition due

to deficiency of services agreed upon and indulging in unfair trade practice

by the Opposite Party.

2. The Complainants are joint landowners of 13 Guntas of property bearing Sy

No. 52/1 A at Horramavu Village, K R Puram, Hobli, Bangalore East

Taluk, which was converted from agricultural purpose to residential

 purpose in the name of Complainants on 20-04-2012 by Dy Commissioner,

Bangalore here after referred as schedule property.

3. That the petitioners are well acquainted with the facts of the case as per

information derived from the record.

4. That the Complainant herein seeks this Hon’ble Commissions’ permission

to bring on record additional documents for the better adjudication, i.e.,

letter from Complainant No. 3 to the President of Aditya Mother Palace

Owner Welfare Association to formally inform the association for

construction execution work on 4th floor under his ownership which was

left unconstructed by the Respondent.

5. That the said case is pending adjudication since 2019 before this Hon’ble

Commission, whereby the whole 4th floor consisting of 8 dwelling houses

have remained unconstructed till date which was to be duly completed by

Respondent. That the complainant being the resident in the schedule

property has intimated the residents of society with regard construction

which the complainant himself carrying out with his own expenses. A true

copy of intimation of construction execution of dwelling houses duly issued

by the Complainant No.3 to the residential associations. ANNEXURE A-1

6. Wector Design Studio, the company who has undertaken to complete the

interiors of the above-mentioned 4th floor has given an estimate cost of

construction in the dwelling houses and A true copy of estimate given by

Wector Design Studio is herein annexed as ANNEXURE A-2

7. The complainant has preferred the present petition bona fide and in the

interest of justice.

PRAYER

On the foregoing submissions, it is therefore, most respectfully prayed that this

Commission may be pleased to: -

(a) Permit the Complainant to place Annexure - A1 to Annexure –A2 as additional

documents on record of the present case;
(b) Pass such other or further order(s) as this Commission may deem fit and proper in
the facts and circumstances of the case in the interest of justice.

And for this act of kindness, the answering petitioner shall, as in duty bound, ever pray.
