Justice Department says new Texas immigration law violates


Constitution
"Violation of the US Constitution" is a new law created to authorise local law enforcement in Texas
to arrest immigrants, which was proposed by the US Department of Justice to Governor Greg Abbott, and
he threatened to sue unless Abbott backed down from enforcing the law. The letter signalled tensions
between President Joe Biden and Abbott over the handling of the US-Mexico border.

Earlier this month, Abbott, a Republican, signed legislation known as Senate Bill 4, which
authorises local law enforcement to arrest immigrants and gives judges the power to issue orders to remove
people from the United States. Some in the White House administration have criticised the legislation,
calling it "extreme". It is expected to go into effect in March.Principal deputy assistant attorney general
Brian Boynton said in a letter to Abbott on Thursday that "the United States intends to file suit to enjoin the
enforcement of Senate Bill 4 unless Texas agrees to enforce the law".

Although the federal government is committed to securing the border, Boyton mentioned that the
Texas law "runs counter to this goal". And Abbott denounced the letter from the Department of Justice, and
accused president Joe Biden of wanting to destroy America. "Not only does the Biden administration refuse
to enforce current US immigration laws, they want to stop Texas from enforcing laws against illegal
immigration," Abbott said in a post on the X app. "I have never seen such hostility to the rule of law in
America".

The surge of immigrants at the US-Mexico border has put enormous pressure on local and federal
resources. Thursday's legal threat followed the DOJ's lawsuit against Texas earlier this year over the state's
use of a floating barrier on the Rio Grande. Enforcement of immigration laws is a federal responsibility,
and opponents of Texas' action argue that it is unconstitutional. The law has also raised concerns in the
Latino community in Texas, which makes up 40 per cent of the country's population. Civil rights groups,
including the American Civil Liberties Union, filed a lawsuit to block the measure.
There was a threat of a Justice Department lawsuit following high-level talks between senior US
and Mexican officials this week. And officials from both countries described the talks as productive, with
Mexican officials expected to visit Washington next month to continue discussions.
