1. Prohibited Uses: THIS VEHICLE CAN ONLY BE DRIVEN WITHIN THE STATE
OF FLORIDA. Taking this vehicle outside the State of Florida my result in
serious personal and financial consequences for the Renter. All of our
vehicles operate on regular gasoline. You are prohibited from using diesel or
any other fuel. Smoking in rental vehicle is strictly prohibited - Fine $350. We
make no warranties, express, implied or apparent regarding the Vehicle, no
warranty of merchantability and no warranty that the Vehicle is fit for a
particular purpose.
The vehicle shall NOT be used, driven or operated (a) by anyone other than an
Authorized Driver; (b) by anyone under the influence of medicinal (proscribed or not)
drugs, illegal drugs and/or alcohol; (c) to push anything including another vehicle; (d)
to tow anything unless the vehicle is equipped with proper towing/safety equipment;
(e) off-road or on any road that is not hard surfaced and regularly maintained; (f) to
carry persons or property for hire and shall not be used as an Uber or other car
service; (g) to carry any dangerous, hazardous or illegal materials; (h) for driver
training activities; to race or engage in any speed contest; (I) by any person who
provides fraudulent, false or misleading information to us; (j) for any conduct listed
as an exclusion to our C/CDW (defined in paragraph 5);YOU SHALL NOT: (1) leave
the vehicle unattended with the keys or other entry or starting fobs in it; (2)
intentionally, willfully, wantonly or recklessly damage the vehicle; (3) re-rent or
sublet the vehicle to anyone; TEXT, USING HAND HELD CELL PHONE OR
NAVIGATION SYSTEMS.
2. Authorized Driver(s): The vehicle shall be used, operated or driven only by an
Authorized Driver, i.e. those persons named on page 1 and described as “renter”
and/or Additional Authorized Driver(s) with the exception of licensed car-parking
attendants and with the further exception of any person operating the vehicle in a
bona fide emergency situation. Allowing a person who is not a listed Authorized
Driver to use the vehicle except in a bona fide emergency, is evidence of a willful
and reckless breach of this rental agreement.
3. Vehicle Return and Damage: On the due date or sooner on demand, Renter will
return the Vehicle in the same operating agreement as rented. If Vehicle is returned
with less fuel than when rented, the charge shall be at the fuel price set forth in this
Agreement and measured by Rent Smart’s estimated difference in fuel level shown
on the fuel gauge from the time Vehicle is rented to the time it is returned. Renter
shall not receive a refund or credit if Vehicle is returned with more fuel than when
Renter received it. If Renter purchases Pre Paid Fuel, Renter’s fuel charge shall be
the per gallon charge multiplied by the fuel tank capacity of Vehicle rented. If the
vehicle is not returned by the Due Date, Renter will be charged the highest
published daily rate for each day that the vehicle is overdue. If Vehicle (a) is not
returned on Date Due In or sooner (b) is illegally parked; c) is used in violation of
this rental agreement; (d) is damaged by accident or otherwise while outside the
South Florida area or (e) appears to be abandoned your permission to use the
Vehicle is automatically terminated and Renter shall be charged for all of the costs of
retrieval or repossession of the Vehicle, including towing charges from the out of
area to Rent Smart’s offices in Miami, FL. WARNING: Failure to return the Vehicle
and all equipment rented upon expiration of the rental period and failure to pay all
amounts due (including costs for damage to the vehicle or equipment) are evidence
of abandonment or refusal to redeliver the Vehicle and equipment, punishable in
accordance with section 812.155, Florida Statutes. (initials) . We, or any of our
agents or employees, may peacefully repossess the Vehicle, without demand,
wherever found and terminate and terminate this rental agreement if the vehicle is
illegally parked or used in violation of law or this Agreement.
4. Amounts Due Us (Payment): You shall pay on demand each of the following:
(a) all time and mileage charges as computed on the front page of this rental
agreement. (b) basic or minimum rate, service and other charges shown on the front
page; c) in the event that you do not purchase the fuel option shown on the front
page, you will pay fuel and a refueling charge if the Vehicle is returned with less fuel
than when rented. (d) all applicable taxes; (e) all tolls (unless Sunpass is purchased
as shown on the front page), parking and traffic fines, administrative fees, citations,
penalties, forfeitures, court costs, towing and storage and out of pocket expenses
assessed against Renter, the Vehicle or us unless these charges are due to our
fault; (f) our costs and expenses including reasonable attorney’s fees incurred in
collecting any payment due hereunder or in repossessing the Vehicle; Renter will be
charged and pay interest at the highest legal rate of interest on any unpaid charges;
and (g) all damage to, or loss or theft of the Vehicle, including damage caused by
weather, road conditions and acts of nature, whether or not you are at fault (h) lost
or stolen keys, (i) Lost or stolen equipment such as GPS, Car Seats. You are
responsible for the cost of repair, or the actual cash retail value of the Vehicle on the
date of the loss if the Vehicle is not repairable or if we elect not to repair the Vehicle
and the damages to us caused by the loss of use of the vehicle. In the event that the
Renter desires for any reason to turn in the Vehicle prior to the Date Due In, Renter
shall be charged and agrees to pay an early termination fee that will vary depending
on the rate of the season. Rent Smart will not Issue refunds, only store credit to be
used in future rentals.
YOU ARE REQUIRED TO PROVIDE YOUR CREDIT CARD TO US AT THE TIME
OF THE RENTAL WHICH WILL BE USED FOR THE PAYMENT OF ALL RENTAL
CHARGES AND SECURITY DEPOSITS REQUIRED BY THE TERMS OF THIS
RENTAL AGREEMENT. YOU AUTHORIZE RENT SMART TO PROCESS CREDIT
CARD VOUCHERS IN YOUR NAME FOR PAYMENT TO RENT SMART FOR ALL
SUMS DUE TO RENT SMART UNDER THIS AGREEMENT.
5. Comprehensive/Collision Damage Waiver ("C/CDW"). If you purchase C/CDW
with no excess, we waive our right to collect from you for comprehensive and
collision damage to Vehicle. We will not waive this right if damage to the Vehicle is
caused by conduct prohibited under the terms of Paragraphs 1 and 2, above, or if
the damage or loss consists of missing Vehicle parts or interior damage caused by
Vehicle occupants, driver's negligence or animals transported in the Vehicle. If you
purchase the C/CDW with excess coverage and the vehicle is involved in an
accident or incident, you will be responsible to pay for the excess damages upon
vehicle return.
6. Insurance, Liability for Damage or Injury to Others and Indemnity: We are in
full compliance with the Florida financial responsibility requirements. Our exposure
for personal injury or property damage claims by third parties is the minimum limits
required by state law and shall be applicable only after all other valid and collectible
insurance has been paid and exhausted to the full limits of such policies. No other
insurance or coverages such as but not limited to under/over insured motorist
coverage, no-fault, supplemental no-fault or other optional coverages are provided
to Renter or authorized driver named in this rental agreement unless if available and
separately purchased at the time of rental. Our policy does not cover (1) any
obligation for which you or an authorized driver named in the rental agreement or
the employer of either or any insurance carrier, may be held liable under any
workers’ compensation or disability benefits or similar law (2) any obligation which
you or the driver assumes under any express or implied contract (3) any loss
occurring which the Vehicle is being used in violation of the terms and provisions of
this Agreement (4) medical payments required by persons sustaining injuries while
riding or alighting from or getting into or on the Vehicle. (5) damage to any object
towed by the Vehicle. To the fullest extent Renter and any authorized driver named
in this rental agreement agree to hold us (Rent Smart) and its owners, officers,
directors, agents and employees) harmless, defend and indemnify us from any and
all claims, losses, expenses and damages, including reasonable attorneys’ fees, for
injury or damage to persons or property of any kind or nature whatsoever (including
death resulting from such injury), caused by, resulting from, arising out of or
occurring in connection with the rental of the Vehicle. Notwithstanding that Renter
and/or authorized driver may be a resident of another state or country, Renter and
authorized driver agree to cooperate fully in the investigation and defense of any
accident claim or lawsuit, including but not limited to providing sworn statements,
appearing for depositions and for necessary court appearances.
7. Release of Information to Third Parties: Renter and authorized driver expressly
authorizes Rent Smart to provide information in Rent Smart’s possession regarding
Renter and authorized driver, including but not limited to, their names, addresses,
driver’s licenses and charge cards to legal authorities or other third parties in
connection with Rent Smart’s enforcement of its rights under or arising out of this
rental agreement.
8 . Responsibility for Property: You release us from all claims for loss of, or
damage to your personal property that we received, handled or stored or that was
left by you in or on the offices, the Vehicle, shuttle bus or in any service vehicle,
whether or not the loss or damage was caused by our negligence or was otherwise
our responsibility. Rent Smart shall have a lien on Renter’s or authorized driver’s
property transported in the vehicle for all charges and expenses incurred under the
terms of this agreement. In the event of Renter’s failure to pay all charges when due
Rent Smart shall have the option to sell, at public or private, sale, with or without
notice to Renter or authorized driver transported in the vehicle in satisfaction of the
unpaid charges and cost of collection.
9. Power of Attorney: Renter and authorized driver hereby grant and appoint Rent
Smart a limited power of attorney: (a) to present insurance claims of any type to
Renter’s insurance carrier and/or credit card company if (I) vehicle is damaged, lost
or stolen during the rental period and if Renter fails to pay for any damages, or (ii)
any liability claims against Rent Smart arise in connection with this rental transaction
and Renter fails to defend, indemnify and hold Rent Smart harmless from such
claims; and (b) to endorse Renter’s name to enable Rent Smart to receive
insurance, credit or debit card payments directly for any such claims, liabilities or
rental charges. To the extent permitted by law, Renter authorizes us to process a
credit card voucher in Renter’s name for payments due to us under this Agreement,
either at the time of the opening of the Rental Agreement or after the close of the
Rental Agreement.
1 0 . Incident Reports: Renter shall immediately report to us any accident or
incident involving the Vehicle orally as quickly as possible and thereafter deliver to
us a written accident/incident report. Should Renter and/or authorized driver receive
or be served with any notice, process, pleadings or paper of any kind relating to any
claim, suit or proceedings connected with any accident or incident involving the
Vehicle, Renter shall deliver such information and documents to us and at our
request to our insurance company. If damages to our vehicle are not reported by
the client in written form, the customer will be responsible to pay for the cost
of repairing the vehicle and authorize Rent Smart Car Rental to charge all the
damages to the credit card on file.
11. Limitation of Remedies: You release Rent Smart and understand and agree
that Rent Smart shall have no liability for indirect, special, consequential or punitive
damages arising in connection with the furnishing, performance or use of the
Vehicle or for any claim based upon Rent Smart’s alleged breach of this Agreement.
If Vehicle has any mechanical failure or other failure not caused by Renter and if
Rent Smart is liable under applicable law for such breach or vehicle failure, Rent
Smart’s sole liability to Renter and Renter’s sole remedy is the substitution of
another similar vehicle by Rent Smart to Renter and to recovery by Renter of the pro
rata daily rental rate for the period in which Renter did not have use of vehicle or
substitute vehicle.
12. MISCELLANEOUS: Renter and Authorized Driver agree to defend and
indemnify Rent Smart and to hold Rent Smart harmless from all claims, demands
and lawsuits related to: (1) the issuance of a warrant for the arrest of Renter and
Authorized Driver; (2) any action by Rent Smart to enforce the terms of this
Agreement; and (3) Renter and Authorized Driver breach of this Agreement. This
Rental Agreement can only be modified in writing and signed by both Rent Smart
and the Renter. Renter at no time shall be considered as an agent, servant or
employee of Rent Smart. This contract shall be construed and governed by the laws
of the State of Florida regardless of the residence of the Renter or Authorized
Driver. Notwithstanding the fact that the Renter and/or Authorized Driver may have
residence in a different state or country or a different county in the State of Florida,
Renter and/or Authorized Driver venue of any action filed by either Rent Smart or
the Renter and/or Authorized Driver shall be in the state court having appropriate
jurisdictional limits sitting in Miami-Dade County, Florida.
NOTE: In case of travel cancellation or reschedule, the amount paid in
advance will be applied on your next reservation and must be informed at
least 48 hours in advance. In case of No show or cancellation without a 48
hours notice, the reservation payment will not be refunded nor credited.
