Weismanri Chief Counsel Citizens for Responsibility and Ethics in Washington 1400 1 (Eye) Street, NW Suite 450 Washington, DC 20005 Re: OSTPFOIA1I-51 Dear Ms. Weismann: On September 27, 2011, you sent the Office of Science and Technology Policy (OSTP) a request under the Freedom of Information Act, 5 U.S.C. 552, seeking: all records from January 1, 2009, to the present reflecting, discussing, or referring to LightSquared. You requested: (1) All records of communications between any individual employed by or acting on behalf of OSTP and any individual at the Federal Communications Commission (FCC) regarding or referring to LightSquared and its investor; (2) All records of communications between any individual employed by or acting on behalf of OSTP and any individual employed by or acting on behalf of LightSquared, including but not limited to Philip Falcone and Harbinger Capital Partners; and (3) All communications with any government officials within any agencies of the federal government regarding any aspect of LightSquareds proposed wireless broadband network. OSTP received your request on September 27, 2011. On September 27, 2011, OSTP informed you that it was processing your request and would release responsive records to you on a rolling basis as documents were processed and became available. OSTP conducted a search of its records and has enclosed 13,450 documents responsive to your request. The enclosed documents constitute OSTPs complete response to your request. OSTP has withheld documents or portions of responsive documents under 5 U.S.C. 552(b)(4), (b)(5), and (b)(6). In addition, OSTP has withheld under (b)(5) the attachments for emails marked with the notation Attachment Withheld.

If you consider this to be an inappropriate denial of your request, you may appeal in writing within 30 days of receipt of this letter to General Counsel Rachael Leonard at ostpfoiaostp.eop.gov or via fax at (202) 395-1224. The email should be clearly marked Freedom of Information Act Appeal.
