THE JUDICIAL SEPARATION: A CORRELATIONAL STUDY ON ITS

EFFECTS TO
THE MENTAL, BEHAVIORAL, AND PHYSICAL HEALTH OF CHILDREN

Identify a problem

Annulment/separation and the implications of non-marital

childbearing/cohabitation are leading a growing number of children to endure

family instability around the world. Another course of action to stable marriage is

most widespread in western countries (including Australia and new zealand) and

is becoming more frequent in developing Asia. Cohabitation, which is more

unstable than marriage, is very widespread in northern and Western Europe, and

it helps reduce divorce rates but not for single-parent households (Stevens,

2017). The United States has been a "leader" in family change, with an early

(beginning in the late 1960s) and high growth in divorce, followed by an explosion

in non-marital birth with or without cohabitation. Most Western countries had an

increase in divorce a decade or two later, whereas industrializing Asia appears to

be in transition. Only over 60% of children in the United States, second only to

Latvia, live with their married birth parents. Some people believe that family

instability is a severe public health issue for children.

In contrast, others believe that separation is often harmless, even good,

especially for women in unhappy marriages or children who are constantly

exposed to conflict (Santiago, 2015). It is undeniable that people's ideas of the

concept of the family began to shift during the twentieth century. As a result of

this divergent perspective on family, motherhood has become a distinct entity

from marriage. When contrasted to previous generations, it has been suggested

that technological advancements are associated with a shift in attitudes on

marriage and having children. Having two distinct personalities results in the

possibility of conflict and diversity in a family formed by "two separate people."

This is a natural effect of having two distinct personalities. To expect two

individuals with distinct personalities who were raised in different environments to

live harmoniously for years is unrealistic because a family, which should be seen

as a haven from life's challenges, can sometimes turn into a stormy sea that

creates problems rather than solving them, resulting in a rift between spouses.

Beyond the fact that a widowed woman or man never has to deal with the various

social and psychological ramifications of being divorced or widowed in this

manner within society after her or his spouse's death, she or he and her children

have a loving and respectful memory of the deceased. While it is true that a

bereaved spouse is considerably more likely to marry and have children than a

divorced spouse, it is also true that the child will grow up in a more natural

setting.

A child of an unfaithful mother will never grow up in an entire family. A child's

ability to overcome issues as he or she grows is therefore dependent on the

understanding and empathy shown by others in the child's immediate

environment for her or his situation. Families today, in contrast to conventional

families, devote all their financial and emotional resources to their children's

upbringing, as well as all their time and energy. A woman's ability to bear children

after marriage is no longer an unavoidable function for her; instead, it is a

moment of personal decision and responsibility on her side. Society's advances,

such as having children out of wedlock, and technical achievements, such as

giving birth through sperm banks without the consent of the putative father, are

said to be contributing to a shift in attitudes on marriage and parenthood (Herlitz,

Nilsson, & Backman, 2012). It is generally widely understood that a woman does

not automatically become a mother simply because she gets married. Having a

child is a personal decision chosen by the woman rather than the wedding

ceremony. As a result, it is claimed that parenthood does not have a conventional

relationship with marriage or with other forms of family life. It is also said that, as

a result of these changes, the child's emotional value, which differs from that of

traditional families, has expanded even further as a result of these developments.

The rapid increase in divorce rates is widely regarded as the most remarkable

significant change in family life during the twentieth century, surpassing all others.

The nature of family life has altered substantially in all industrialized countries

during the last several decades. The increase in divorce rates throughout the

second half of the twentieth century was significant; in fact, the divorce rate in

most Westernized countries more than doubled between 1960 and 1980

(Bethanny, 2016). In particular, the increase in divorces has had a severe

influence on children, who have experienced millions of instances of parental

separation. Furthermore, recent increases in non-marital births, primarily due to

rising rates of childbirth among cohabiting couples, have resulted in a higher

percentage of children seeing the separation of their never-married parents.

Many children born into cohabiting partnerships may witness the dissolution of

their parents' union when their parents' cohabiting relationships end. This is

because cohabiting partnerships are less secure than marriages.

The researchers' study involved a parent-child relationship that acquires

observation to understand the reason behind all factors to the child's behavior.

Hence, shows the effects of parent-child on behavior regulation. Based on the

study of Acar, Torquati, Garcia, and Ren presented an established result from an

extensive demographic survey finding that when a child experiences a

combination of low parent- child close connection and a high teacher-child

conflict, the child will show low levels of behavior regulation. Furthermore, their

study highlighted the importance of building an independent and cooperative

parent-child relationship to manage children's behavior.

The effects of parent's support on adolescents in career maturity, the children

need it in every aspect of his life; According to Lim and You, to identify the factors

influencing adolescent career development by using the three waves longitudinal

data. He examines the direct and indirect effects of parent's support on career

maturity; it is a mediating effect of a child on their self-esteem and their

relationship with their parents. He also examines that every sex difference in the

relationship is around estimates 4,000 adolescents who progressed from seventh

grade in 2010 to ninth grade in 2012. The result is that every parental support of

their career maturity has a significant impact on their self-esteem.

The effects of child-parent after separation are traumatic for the child and

parents should understand the importance of the relationship to the child.

According to Osafsky, Adults need to recognize and understand the importance

of the parents-child relationship because it supports the infants and young

children who are exposed to traumatic events. All children need the support,

security and safety that come with a consistent, emotionally available relationship

because young adults have a limited understanding and ability to cope in a

trauma than older children. That is why their security in a relationship is even

more important. The young child depends on trusting, nurturing relationships with

the parents who are available to understand their behavior and protecting them

by providing physical and emotional safety.

The child's development correlates to a specific guardian's physical and mental

presence, specifically the parents. The study of Cheung and Pomerantz shows

the results of the benefits of parents' involvement in the children's learning as the

reason for being a part of valuing development. The researchers conducted a

study on high school students' participation and resulted in the perception values

from their parents affected their school achievements, the motivation that can

enhance grades, and how they value themselves— examining normative change

in children's level of social competence-based from parent- child's interactions

from kindergarten through high school. Based on the study of Gadaire, Henrich,

and Finn-Stevenson, results indicated discrepancies between parent and teacher

reports of their child's social development. Research highlights the importance of

viewing children's social competence as a dynamic variable related to many

individuals, familial, and social factors. In addition, the parent-children

relationship is a potential target for interventions aimed at enhancing

competence.

An emotional and mental state is related to the factors of the cognitive and

behavioral aspects of the researcher's study. Thus, related to the study of Mind

and Neyer, individuals who experience the feeling of loneliness may perceive it

as a discrepancy to their quantity and quality of social relationships. The research

further explained the importance of loneliness for various health-related aspects.

The aftermath of loneliness may show predicting personality traits and late

development from late adolescence to early adulthood. Furthermore, the effects

of loneliness will show in the future which the individuals experience hardship on

overcoming one’s internal problem.

The impact of communication on parents and their surroundings can be

affected too. The study of Yogan, Freedle, and Ringenberg connected to mental,

emotional, and social adjustment when loneliness occurs. The study explored the

effects of parent's and student's communication patterns on social, emotional,

and academic adjustment in a work environment, specifically school. On average,

parents and students often communicate weekly and commonly on text

messaging. Parents tend to overestimate texting or e-mail frequently positively

associated with students' self-reported emotional and social adjustment. In

contrast to real-time communication methods such as phone calls, video chats,

and in-person visits, the child's adjustment to the surroundings is negatively

associated.

Establish the Research Gap

The previous studies have focused on The agreements between parents

about their parental powers and duties in case of annulment, divorce or judicial

separation. (Joan Marsal, Elena Lauroba 2012). In our research study it tested

the significant relationship between Judicial Separation and its Effects to the

Mental, Behavioral, and Physical Health of Children. This study made use of the

descriptive correlation method of research and purposive sampling, after

determining the sample size, from the Davao City National High School Students

for the academic year 2022-2023.

The researchers highly believe that the result of this study is provided with

actual circumstances that are arranged into rational order with no biases or

perceptions. This study focuses on the experiences of children who encounter

family annulment. However, this study provides positive outcomes and will be

beneficial to people. This study will be helpful to the following:

- Children

Children can benefit in this study as they become older, they will know that a

family is the most solid foundation, that separation is not the best decision that

you will do in the future.

- Parents

Parents can also benefit from this research; they will know that their decision

about separating can cause so much damage to the mental health, behavior, and

physical health of their children.

- Future Researchers

Future researchers can also benefit from this research. As they explore the same

issue, this study can be a help to them. They can expound the idea within this

problem to create more information and draw aspiring researchers' attention to

produce a sustainable solution in the future.
