Take note of the following:


Submission of the first compulsory assignment will give a student admission to the
examination. Failure to submit the first assignment on time will result in automatic
cancellation of your registration and you will consequently not be allowed to write the
examination. The marks for this assignment will contribute 10% towards the student’s
final marks. The marks a student obtains for the second assignment, will contribute
another 10% towards the student’s final marks. The examination will then contribute 80%
towards the student’s final marks. [10% (assignment 01) + 10% (assignment 02) = 20%
+ 80% (examination) = 100%]
Consequently, students who only submit the first compulsory assignment will have
admission to the examination but will lose the opportunity of adding the marks to be
obtained for the second compulsory assignment to their final marks. They will
nevertheless be admitted to the examination.
The marks obtained for the assignments will - provided you obtain an examination mark
of at least 40% - count 20% of your final mark. YOU NEED TO OBTAIN A SUBMINIMUM
OF 40% IN THE EXAMINATION BEFORE YOUR YEAR MARK WILL BE TAKEN INTO
ACCOUNT.

ASSIGNMENT QUESTION

1. Study the case Clicks Retailers (Pty) Ltd v Madikwe and Others (JR 1924/19)
[2023] ZALCJHB 67 (14 March 2023) and write a two-page legal opinion about
the case. Your legal opinion must have the following -

• SUMMARY OF THE FACTS OF THE CASE (2)

• ISSUE(S) IN DISPUTE IN THE CASE (1)

• THE COURT’S DECISION (1)

ASSESSMENT CRITERIA:

This assignment contributes 10% towards your year mark. Your answer should not
exceed 2 typed pages (A4, single line spacing). If you exceed the page limitation,
you will be penalised.

Students who merely copy from the prescribed material will be penalised. Keep in mind
that a properly structured answer may earn you more marks, for example, consider
including an introduction and a conclusion in your LEGAL OPINION (bullet 4 of the
answer). Incorporating relevant authority into your answer may guarantee you an
excellent mark.
