Terms and Conditions of Contract
t. The bidder shall be required to deposit Rs. 200000/- (Rupees Two Lacs Only)as Earnest Money in
the form of DD/Bank Guaranteel Pay Order/Banker's Cheque from anationalized or scheduled bank in
favour of NIPER Ahmedabad and payable at Ahmedabad. Bid will be rejected without the requisite
Earnest Money and Bid Fee.
2. Entire work as per the enclosed technical specifications must be completed within 3 months
from the
date of award of work.
Time Schedule
Work period
Submission of duly approved structural designs 0-02 weeks
and drawings from the Govt. authorized personnel

3. Security deposit will be deducted from each RA bill @5% till it reaches 5% of the contract value
including EMD and same will be released after completion of the work or closure of the contract
whichever is later.

The successful tenderer will subrnit a Bank Guarantee equivalent to 5Yo of the total value of contract
towards performance guarantee which should be valid upto 6 months after completion of the project and
same shall be returned after six months of completion of the project or closure of the contract whichever
is later.
5. Bids would be rejected for award if it determines that the bidder recommended for award has, directly or
through an agent, engaged in corrupt, fraudulent, collusive or coercive practices in competing for the
contract in question.
6. The bids received after the deadline for submission of bids presuibed by the NIPER Ahmedabad will be
rejected and such bids shall be marked as late and not considered for further evaluation.
7. The NIPER Ahmedabad may, at its discretion, extend the deadline for submission of bids by amending
the bid docurnents in accordance with clause relating to Amendment of Bidding documents in which
case all rights and obligations of the NIPER Ahmedabad and Bidders previously subject to the deadline
will thereafter be subject to the deadline as extended.
8. The original and all copies of the bid shall be typed or written in indelible ink and shall be signed by the
bidder or a person or persons duly authorized to bind the bidder to the Contract. All pages of the bid,
except for un-amended printed literature, shall be initialed by the person or persons signing the bid.
Further, over-writings on documents, if any should be supported by signatures.
9, The bidders may subrnit their duly sealed Bid by post or by hand at the address specified in the Notice

Inviting Quotation not later than the time and date specified therein. In the event of the specified date
for the submission of bid being declared a holiday for the NIPER Ahmedabad, the bid wili be received
up to the appointed time on the next working day.
l0.Issuance of bid documents should not automatically be construed that the bidder is considered qualified.
The NIPER Ahmedabad Authority has the right to reject any bids without assigning any reason.
11. NIPER Ahmedabad shall not be responsible for any delay, loss or non-receipt of bid documents sent by
post.
12.Payment shall be made as per following schedule:
(a) I}Yo Payment will be released after receipt of the duly approved structural designs and
drawings from the Govt. authorized personnel as indicated in technical specification clause
No.9.0
(b) 05% payment will be released after receipt of total construction drawings specifications finishing
schedule along with bill of quantities.
(c) 25 o/o payment will be released after receipt of complete material at site against submission of
indemnity bond and insurance of material brought at site.
(d) 20 o/o paymentwill be released after structural erection roofing, false ceiling , plumbing electrical
and all other works complete as per design and BOe.
(e) 20 o/o payment will be released after finishing and painting.
(f) 20 Yo payment will be released after handing over of the completed project as per approved
design and BOQ.
13. All taxes, if applicable, should be quoted alongwith rates and during the execution paper should be
produced for complying the same with the government/statutory authority.
14. If the work is not carried out within the stipulated time, then liquid ated damage will be imposed at the
rate of |Yo of the contract value upto a maximum of I\Yo of the contract value.
15. The quotations must be valid for 90 days Qrlinety days) from the date of opening of the tender.
Accepted rates of lowest tenderer will be firm and it will not change till the completion of the project.
16.In the process of evaluation, comparison of bids, NIPER Ahmedabad reserves the right to reject any or
all bids without assigning any reason.
17.In case of complaint regarding quality of work, employer has right to reject the work and execute the
same at the risk and cost of tenderer.
18. All conigenda will only be notified on the NIPER Ahmedabad website.
19. The Director, NIPER Ahmedabad shall be the final Authority for settlement of any dispute and her
interpretation of any Clause/term/condition(s) of this document shall be final and binding. if the dispute
persists then the same will be settled in the iurisdiction for Court of Law at Ahmedabad.

1.0 Introduction
National Institute of Pharmaceutical Education &Research (NIPER) Ahmedabad
is setting up New Temporary
Portable PEB Building for Institutional Research Lab&Class rooms with admin
area for Ahmedabad pERD Center
Campus' This technical specification describes the vendor scope of design,
supply and erection of PEB-based rooms of the classroom &Laboratory.
Design and construction of PEB multistory building (Ground plus one) including laboratory
,classroom, conference
hall and toilets and other amenities as per the requirements of NIPER Ahmedabad and also as per
the enclosed
technicalspecifications and drawings with an area of 775 Sq Meter carpet area.

Notes:
' Overall base area of PEB Building shall be as per the typical layout mentioned above,

o For the above, relevant clauses of "Detailed specification of PEB Multi Storey Building"
shall be adopted,
The successful bidder shall have to get the structural design done as per the prevailing Indian standard
codes and lnternational Standard. The structural design of PEB Multi Storey Lab of each
type shall have to be proof checked by any GOVT. APPROVED ENGINEER OR
AGENCY.
The architectural drawing of double skin insulated roofing & cladding system are given in the tender relevant
Drawing (Pre Engineered Building Drawing No:) to provide general idea about work to be performed under
the scope of the contract, The PEB shall have robust water tightness at all joints and connections, The
building shall have a high class durability and performance during the adverse weather conditions.
PUF insulated panels Metal Sheet for Roofing and side cladding consist of external sheet as troughed
permanently colour coated sheet & internal sheet as plain permanently colour coated sheet.
Chemical composition of Troughed permanently colour metal sheet for roofing and side cladding shall
conform to the provisions of applicable standard ,
Plain permanently colour coated steel metal sheet for ridge and hips, flashing, trimming, closure for vertical
and horizontal joints, capping etc, shall conform to the same requirements as those of troughed permanently
colour coated metal sheet for roof and side cladding,
Fillers blocks as a trough filler shall be used to seal cavities formed between the profiled sheet and the
support or flashing, The fillers blocks shall be manufactured from black synthetic rubber or any other materiat
approved by engineer.

Wall Insulation:
Both the walls should be separated by spacers system made up of cold formed steel bars and fastened
throughzinc /zinc-tin coated self-drilling screws.The internal wall of Toilets & Wash Room area shall be
stainless steel to prevent corrosion due to high water frow & Humidity,
Doors Frames:
Door frames shall be of C Section Powder Coated lron frame of mild steel with Aluminum Door Frame
Sections. All doors shall beprovided necessary fittings like hinges, handles, Handel locks, tower bolts,
stopper, hydraulic door closer, etc, of Cp brass complete,
White/ lvory powder coated aluminum doors shall be with extruded built up standard tubular sections,
appropriate Zsections and other sections of approved make and standard quality.
Windows Frame:
Window Frame shall be C Section fabricated from Stainless Steel Grade to Fit Aluminum White / lvory
powder coated section, frame as per approved design. Tinted glass and aluminum grill shall be provided.
False Ceiling:
Supply and Installation of Tiles (Tegular & Square edge) as specified & Approved by NIPER including
providing & Fixing of sus;pended grid which is suitable for tiles
Note: Additional supporting arrangements, if required, shatt be provided near openings for tight fittings
diffusers etc. shall include making cut-outs for tube rghfs, spo/ lights of specified size etc,., shall also include
for providing additional trimming around cut-outs for light fittings etc,, and also for providing additionat
supporfs from ceiling where main/cross members are cut for light fittings etc.,
Electrification &Lighting:
Vendor shall ensure that the room is designed to utilize maximum natural light during the day, Vendor shall
also ensure that supply of Electric Fixtures for the room with electric lights to achieve average illumination as
per NIPER Requirements. Vender Shall Supply Fan & Light with Required Elechical Enclosures Switches
Switch Board Distribution Board, Panels, Wires & Cables with Casing Capping & all other relevant
Accessories,
Dead Load: Self Weight of Structure including Purlins, Sheeting, Girts, Bracings, weight of turbo ventilators to
be added as Dead load etc.
Earthquake Load: All PEB structures shall be designed for Seismic forces,
Primary Members: Primary structural framing shall include the transverse rigid frames, cotumns, corner
columns,end wallwind columns, beams, truss member, base pate.

Secondary Members: Secondary structuralframing shall include the purlins, girts, eave struts, bracing,
flange bracing, base angles, clips, flashings and other miscellaneous struciural parts,
Suitable wind bracing-s
sag rods to be reckoned while designing the structure.
Sealant: Sealant used for cladding shall be butyl based two parts poly sulphide or equivalent approved,
no
staining material and be flexible enough not to interface with fit of the sheets.
Glosures: Solid or closed cell closures matching the profiles of the panel shall be installed
along the
eaves, rakeand other locations.
Flashing and Trim: Flashing and / or trim shall be furnished at the rake, corners, eaves, and framed
openings and wherever necessary to provide weather tightness and finished appearance,
Color shall be
matching with the color of wall. Material shall be 26 gauge thick conforming to
the physical specifications of
sheeting,
Gutters and Down Gomers: Gutters shall be fabricated out of same metal sheet, Material shall be
sameasthatof sheeting, Downcomersshall beof galvanizedsteel pipesorPVCdesignedtoensureproper
roof drainage system,
All steel materials supplied by the Agency shall be in a sound condition, of recent manufacture, free from
defects,
loose mill scale, slag intrusions, larninations, pitting, flaky, rust, etc. and be of full weight and thickness
specified.
Brick work using bricks as specified in cement mortarl:6 at and at all depths /heights above/below plinth
level
in foundation, superstructure in line, leveland plumb, raking out joints above ground leveland simultaneous
pointing below ground level, curing steel scaffolding wherever required etc., c-omplete
as specified and
directed in superstructurr;.
. Flooring Work:
Non-Skid Ceramic tile flooring, dado/skirting using 6 mm/9mm thick ceramic tiles of sizes as mentioned
below, glossf or matt finish, of 1st quality as approved by NlpER.
Providing and fixing/laying with necessary clamps or embedded in floor/concealed in walls approved quality
PVC rain water pipes and fittings of standard quality.
Providing and fixing sanitary fittings and fixtures of applicable standards of NlpER.
8.0 Detailed specification of Electrification Work

electrical system as per applicable standard and

specifications, data sheets and drawings attached de1ned in
with the tender and required for completion of the job
including but not limited to
General:
All the supply and work shall be in accordance with the relevant
l.S.Specification and recognized standards
and modern approved practice and shall meet the requirement
of the latest issue of applicable codes, factory
rates and regulations, supply codes and all standard accepted practice
in locality *h.ru the installation is to
be made' All the materials and ac_cessories provided by
Contractor under terms of this contract shall conform
to the relevant Indian Standard Specifications. Samples of all equipment,
materials anJ accessories to be
supplied by the Contractor shall be submitted for the approval
oitt'r. rutprR before they are supplied and
used' Conhactor shall provide all necessary labour, tools, and other
requisite work like drilling, cutting,
welding etc' at his own cost, Good workmans-hip is the essence
of this contract and shall be complied with at
all time' The Contractor shall have the works supervised by qualified
and experienced engineers, All the
defects pointed out by the engineer shall be rectified immediately
by the iontractor free of cost. The
installation shall generally be cinied out strictly in conformity

Indian Electricity Act, 1910 as amended and the lndian Electriclty
Rules, 1g56 framed there under and all
others statutory regulations that may be relevant to the instillation.
No alteration which may affect the
structures and architecture of building shall be done without the prior
approval of the engineer. All work shall
be carried out in such a manner that it should not cause any
inconvenience to other works which are under
progress' The Contractor shall co-operate with other
ageniies in the area for the smooth execution of all
works' Accidental damage to any property shall be ieported immediately
to site engineers and letter

09.0 General conditions applicable during supply, installation and commissioning phase
Vendor shall organize construciion power supply on their own. Accordingly, if required, DG sets of suitable
capacity shall be deployed by the vendor for construction works,
Similarly, water required for construction works shall be arranged by the vendor through water tankers.
All machinery such as cranes, hydra, JCBs, forklifts, transport trucks, trolleys, concrete mixers, Ajax machines eic
necessary for movement and installation of materials shall be organized by the vendor,
All necessary tools and tackles such as screw driver set, power screw drivers, cutting pliers, nose pliers,spanner
sets, adjustable spanners, hole saw cuiter set, bending tools, torque wrenches, hack saw blades,pipe wrenches,
flat / round files, drilling machines, welding machines, steel bar bending tools / templatesfor RCC works, spade,
shovel, hammer etc shall be organized by the vendor.
All necessary measuring instruments such as measuring tapes, digital millimeters, electrical testers,meggers etc
shall be organized by the vendor.
Vendor shall make their own arrangements for necessary food, drinking water and accommodation for their labour
and employees posted at the site. Similarly, food and drinking water required at the site, during the construction
operations, shall also be in scope of vendor.
Vendor shall organize all necessary steps to meet statutory requirements such as labour license, PF,ESl,
insurance etc and also ensure compliance with relevant acts such as minimum wages act, income tax acr,
employee insurance act etc fcrr their labour deployed at site.
Vendor shall organize activities such as receipt of all supply items of PEB rooms at site, unloading from the trucks,
safe storage at site, movement from storage location to point of construction etc. Vendor shall deploy their own
security watch and ward to safeguard their supply items from pilferage, Insurance for the supplied items until the
completion of erection of all the PEB rooms shall be the responsibility of vendor,
Vendor shall maintain updated labour register, with name, age, qualification, salary, attendance details etc at the
site.
Vendor shall use danger boards, wherever required, to ensure safety of the persons during the work atsite.
Vendor shall adhere to all necessary safety norms such as use of helmet, goggles, hand gloves, gumboots, aprons
etc. lt is the ultimate responsibility of the vendor in all respect to prevent accidents at the site and safeguard their
labour from accidents.
Vendor shall, at the completion of every work, clear off the debris, which resulted out of the work.
Vendor shall carry out the work without causing inconvenience to other contract groups at the site. Incase of
conflicts with other groups, vendor shall ensure that the matter is resolved at once amicably sothat the progress of
work is not affected, Any damages on the other buildings, structures etc of the site, if attributable to the acts of
labor employees of vendor, shall be rectified and made good by the vendor at their own cost,

No child labour shall be employed for execution of the present contract as per child labour prohibition act..
Any miscellaneous materials, which are found essential for technical completion of the conkact but not mentioned
explicitly in this specification, shall be deemed to be included in the specification, Accordingly, such materials shall
be included by the vendor as part of the offer
NIPER shall witness routine / acceptance tests performed at rnanufacturer works for the items supplied by vendor,
Vendor shall accordingly provide inspection call to NIPER with submission of quality assurance plan in advance.
For the items bought out from dealers, test certificates, as per relevant lS / IEC standards, as issued by
manufacturer shall be submitted to NIPER. However, prior approval shall be obtained from NIPER for procurement
of the item from dealers.
Any deviations during construction shall be discussed with director, NIPER and implementation shall be taken up
only after approvalfrom NIPER ,
Vendor shall submit periodic status report, on daily as well as weekly consolidated basis, to NIPER on theprogress
of the contract,
