SUBJECT: ASSAULTING OR RESISTING A PEACE OFFICER AS DEFINED IN SECTION


176 OF THE CRIMINAL LAW CORDIFICATION AND REFORM ACT CHAPTER 9:23

CIRCUMSTANCES;

This memo serves to put on record that;

01. On the 18th day of March 2024 at Chirodzero business centre, number 078476Z
constable Pauta Mathew of ZRP Chinamhora had his right hand middle finger
bitten off by Godknows Chingwaru nr 25-136713-W-25, a male adult aged 24
years of Gukwe village chief Chinamhora, Domboshava while trying to resist
arrest.

02. Circumstances are that, on the 18th day of March 2024 at around 2100 hours, cst
Pauta, 083776K cst Mushayandebvu and number 074907N cst Kalonga where
deployed at Chirodzero business centre on patrol when they came across a road
traffic accident at 32 km peg along Harare- Makumbe road. A white Honda fit
registration number AFN 8821 driven by Gift Chereni nr 44-099196H44, a male
adult aged 31 years of Zimbiru village chief Chinamhora had a side-swipe with a
white Toyot Gaia registration number ABX 8996 driven by the accused person.

03. The police officers attended the scene and then ordered the two parties to drive
their vehicles to Chinamhora police station for further management. The accused
person refused and began to walk away from the scene with his car keys.

04. Cst Pauta persued the accused person and apprehended him in a bid to recover
the car keys. The accused person resisted to hand over the keys. He held cst
Pauta’s right hand middle finger, put it in his mouth and bit it off. The accused
person then spat the finger chop onto the ground.

05. Cst Pauta called for help. Cst Mushayandebvu and cst Kalonga then came and
managed to handcuff the accused person. Cst Mushayandebvu picked the
chopped finger tip and rushed cst Pauta to Makumbe hospital using a
wellwisher’s car registration number uknown at the moment. Cst Kalonga
remained at the scene and arranged for the towing of the accused’s vehicle to
the police station including the accused person.

06. Cst Pauta sustained a cut off right hand middle finger and is admitted at
Makumbe hospital. He is in a stable condition.

07. At the station the accused was charged and detained for resisting a peace
officer Db number 288/24. A report of road traffic accident was also filed by Gift
Chereni as the first party. The case is being investigated under Chinamhora rrb
5932783 while the road traffic accident is under rrb 5932786 refers.
