CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease made and executed into by and between:

NANCY H. MENDOZA, of legal age, married, Filipino and a resident of 29 Datu


Sumakwel, Project 4, Quezon City, hereinafter referred to as the LESSOR by virtue of an SPA
executed by her daughter MARIA THERESA M. ARANDA.

-and-

JOSEPH B. LUGA, of legal age, married, Filipino and a resident of #61 Yale St., Brgy.
E. Rodriguez, Cubao, Quezon City, hereinafter referred to as the LESSEE.

1. That the LESSOR is the absolute owner of the residential / commercial unit located at
the Ground Floor 61 Yale, Cubao, Q.C;

2. That upon payment of the agreed rental and compliance with the agreed provisions of this
Contract, the LESSOR agrees to rent out the LESSEE of the above-mentioned
residential unit, effective January 5, 2024;

3. That this contract is effective for only (1) year starting from the due of the signing of the
same but renewable every year at the option of the LESSOR which monthly rental may
be increased as agreed by the contracting parties subject only to the provisions of existing
laws;

4. That the agreed starting monthly rental of the said residential/commercial unit is NINE
THOUSAND PESOS (₱9,000.00).

5. That the LESSEE shall occupy the premises ONLY upon complete payment of an
advance payment of one (1) month deposit and one (1) month advance.

6. That payment shall be made thru cash payment for 12 consecutive months;

7. That the LESSEE promises to the LESSOR to agree and follow the following terms and
conditions of the contract:

a. That the monthly payment for the premises shall be paid regularly to the
LESSOR every 30th of the month;

b. That the LESSEE promises to maintain the leased premises safe, clean and
habitable;

c. That the LESSEE shall not make or construct any changes on the premises
without the consent of the LESSOR and if ever changes/construction are made
without the consent of the LESSOR the same shall become property of the
LESSOR upon the termination of the contract;

d. Any all repairs necessary to maintain the premises in good tenantable condition
shall be for the account of the LESSOR provided that if such repairs shall have
become necessary. For reasons other than normal wear and tear, as for instance
due to carelessness or negligence of the LESSEE, member of his/her servant(s),
the cost of such repairs shall be for the account of the LESSEE;
e. That the rented premises shall only be use as stipulated in the contract;

f. That the premises shall be turned over by the LESSEE to the LESSOR upon
termination of the contract including the fixtures that were present at the start of
this contract with allowance to the ordinary wear and tear of the same;

g. That the LESSEE promises to pay on time all water, electric, and other services
during the effectivity of this contract;

h. That the LESSEE shall not-leased or assign to any other person, business
corporation or entity the rented premises or any part thereof and any violation of
this condition shall automatically terminate the effectivity of this contract;

i. That the LESSEE HEREBY ALLOW the LESSOR his /her authorized
representative/s to enter into the rented premises to periodically inspect the same
at the appropriate time without causing discomfort to the LESSEE;

j. That the ONE MONTH ADVANCE RENT may be used by the LESSEE as the
1st monthly rental at the termination of this contract while the ONE MONTH
RENTAL DEPOSIT may be used by the LESSOR for the payment of unpaid
Bills and for whatever expenses of the repair of whatever may have been
destroyed in the rented premises at the termination of this contract; the excess of
the rental deposit shall be returned to the LESSEE within thirty days after
termination or expiration of the contract.

8. That in the event the rented premises or any part thereof shall be destroyed by fire or any
other fortuitous event, the monthly rental may be reasonable reduce of this contract may
be terminated at the option of the LESSOR;

9. That in case the LESSEE unreasonably violates the conditions of this contract, the
LESSOR has the right to demand the termination of this contract and the eviction of the
LESSEE including the collection of whatever is rightfully due to the LESSOR by virtue
of this contract;

10. That the LESSEE shall be liable for any member of his/her family and for those whom
the LESSEE has allowed to stay/occupy the rented premises, for any violation of this
contract;

11. That the LESSEE shall be rented premises ONLY for ONE(1) year and renewable every
year;

12. Both LESSOR and the LESSEE mutually agree that in case there is a need to judicially
settle any violation/disagreement in the relation to the RENTAL CONTACT, the venue
of the same shall be proper courts in Quezon City.
