LEASE AGREEMENT

This agreement is made at Patna on this 7th day of July 2015


Between
Smt. Gayatri Devi, W/O Sri Arun Kumar, Residing at House No. 26, Vasant Vihar Colony ,
Boring Road, Patna -800001 (hereinafter called and referred to as “Lessor” which expression
shall wherever the context so requires or admits mean and include their heirs, executors,
administrators and assigns) of the ONE PART.
Mr. Rajnikant, S/O Sri Krishna Singh, R/O Road no- 1A, House no- 3, New P.P Colony, Patna-
800013 (hereinafter called the “Lessee”which expression shall wherever the context so requires
or admits mean and include its successors and assigns ) of the OTHER PART.
WHEREAS the Lessor is the owner and in possession of a Commercial premises being Office No.
32, 3rd Floor, situated at ASHIYANA GALAXY, off Exhibition Road, Patna-800001 and is desirous
to let-out the said premises, measuring a total area of about 1200 sq. ft (Super built-top Area)
(herein after called “ the premises”).
AND WHEREAS the Lessee desires to take on lease the said premises for the Purpose of Running
a SMART CLASSROOM COACHING THROUGH VSAT.
AND WHEREAS the Lessor has agreed to let out the said premises together for a term of 36
months commencing from 07-07-2015 and ending on 06-07-2018 paying therefore Monthly
Rental of Rs.23500/-(Twenty three thousand five hundred only) excluding monthly
maintenance charges payable at the Society of the said Complex and upon such terms and
conditions and covenants set out herein below.

NOW THESE PRESENTS WITNESSETH AND IT IS AGREED BY AND BETWEEN THE PARTIES HERETO
AS FOLLOWS:
1. THE LESSEE HEREBY CONVENANTS WITH THE LESSOR AS FOLLOWS:-
a) To pay to the Lessor of Rs.23500/- (Twenty three thousand five hundred only)
Monthly rental payable hereunder every month on or before the 7 th day of each
calendar month by the way of cash/account Payee local Cheque.

b) The lessee has deposited to the Lessor a sum of Rs.70,500 (Seventy thousand five
hundred only) an amount equal to 3 month’s rent as interest free refundable
security deposit and Rs.23500/- (Twenty three thousand five hundred only as
advanced Rent for the period of 07-07-2015 to 06-08-2015, by cash
c) That the lessee will take the new electricity connection from PESU and pay the
charge to the PESU directly.

d) To keep the interior of the said premises in good and tenantable condition during
the period of lease and to be responsible for the ordinary routine maintenance of
the fixtures and fittings in the said premises.

e) That the lessee can make partitions, toilet, Kitchen etc if necessary without the
previous consent of the Lessor in writing he is at liberty to install in the said premises
all such furniture, air- conditioners, fittings as may be deemed fit and necessary by
the Lessee for proper use and enjoyment of the premises.

f) That the minor repairs in the electrical installation which as fuse replacement, bulbs
and tubes replacements etc. shall be carried out by the Lessee at their own cost.

g) That the lessee shall not store inflammable or combustible or explosive and/or any
dangerous materials whatsoever in the said premises or near thereof beyond the
permissible limits.

h) That the lessee will not to assign, transfer, sub-let or part with the possession
without the written consent of the Lessor of the said premises or any part thereof at
any time during the continuation of the lease.

i) To permit the lessor or lessee’s duly authorized agent, workmen to enter upon to
inspect the said premises to carry out any repair therein after due notice in writing.

j) If the lessee shall be in arrears of rent payable for the demised premises by one
month from due date of payment thereof or shall otherwise commit a breach in the
payment, observance or performance of any of the lessee’s obligation a notice in
writing of such arrears breach or failure as the case may be and if the lessee does
not rectify or fulfill the arrears or relevant obligation within thirty days of receipt of
notice, then the lessor may at its option forthwith terminate the lease.

k) To deliver to the lessor on the expiry or termination of the lease, the possession of
the said premises, with all fixtures and fittings in the same working condition as on
day which was taken on lease without any damage. In case the lessee fails to hand
over vacant possession, the lessee will pay Rs. 1500/- (Rupees One thousand five
hundred) per day as compensation till the vacation of the flat.
2. THE LESSOR HEREBY COVENANTS WITH THE LESSEE AS FOLLOWS:-
a) To pay the house tax, ground rent and Municipal and other Taxes, levies and charges
and all normal outgoings payable to Municipal or any other central or State Govt.
authorities in respect of demised premises and not to allow the same fall in arrears.

b) The lessor covenants to the lessee that all articles, things, installation, fixtures and
fittings installed at the Demised premises by the lessee shall be the absolute property of
the lessee and the lessee shall be entitled to dismantle, remove and take away the same
from time to time and when it vacates the demise Premises on expiry or termination of
the lease or any renewal thereof.

3. PROVIDED ALWAYS AND IT IS HEREBY AGREED AND DECLARED BETWEEN THE PARTIES
AS FOLLOWS:
a) The lessee paying the rent hereby reserved and observing and performing the several
covenants and stipulations herein contained on its part to be observed and performed
and shall peaceably hold and enjoy the said premises during the term of the lease or any
extension thereof without any interruption by the lessor or any person lawfully claiming
under through or in trust for the lessor.

b) If inspite of one month’s written notice given by the lessor, to the lessee in that behalf,
the rent hereby reserved or any part thereof shall remain unpaid for a period exceeding
Two month after becoming due and payable (whether formally demanded or not) or if
any covenant on the part of the lessee therein contained shall not be performed or
observed, it shall be lawful for the lessor or any person or persons duly authorized by
the lessor in that behalf to terminate the lease and to re-enter and take possession of
the said premises.

c) This agreement may be terminated by the both parties at any time by giving a written
notice of “One month’s to each other of their intention to do so but not before 11
months which will be the locking period.

d) On the expiry of the lease may be extended for further periods upon terms and
condition as agreed to between the parties. In case of such extension, an increase of
10% in the previous monthly rent will be allowed per extension.
e) The lessor shall refund to the Lessee without interest the deposit amount of Rs. 70,500/-
(Rupees Seventy thousand five hundred Only) mentioned in Clause 1(b) above,
immediately on termination of the agreement hereby created and on the lessee
vacating with all persons using the premises with all their belongings after deducting, if
any arrears due from Lessee.

f) If, by fire, tempest or flood or violence of any army or of a mob or other irresistible
force, any material part of the said premises be wholly destroyed or rendered
substantially and permanently unfit for the purpose for which it is let, the Lease shall at
the option of the Lessee.

g) The lessee according to his requirement can do any change/modification/ alteration in


the said premises without affecting the structure of the building.

IN WITNESS WHEREOF these presents have been executed by the parties hereto on the 7 th day,
month of July, 2015 herein above written.
