BARANGAY HABAG SENIOR CITIZENS ASSOCIATION

Habag, Lanuza, Surigao del Sur

THE CONSTITUTION AND BY-LAWS

PREAMBLE
We, the Senior Citizens of Barangay Habag, Lanuza Surigao del Sur, imploring the aid
and guidance of the Devine Providence in order to establish unity, promote and enhance honor
and dignity of the senior citizens and to preserve the values respect to the elderly, hereby
organize ourselves into an association and pledge to be guided at all times, do ordain and
promulgate this Constitution and By-Laws.

ARTICLE I - NAME AND LOCATION


Section 1 - The association shall be named “Barangay Habag Senior Citizens Association.”
Section 2 - It shall be considered as the Unit Organization to represented or affiliate to the
federation through its president.
Section 3 - The office shall be located at the Barangay, Habag, Lanuza Surigao del Sur.

ARTICLE II - PURPOSE AND OBJECTIVES


The Organization has the following objectives:
Section 1 - To attain, the objectives of the association, the following are the basic purposes:
a) To encourage and motivate the senior citizens to contribute in nation building
pursuant to RA7432, all its amendments and Implementing Rules and
Regulations.
b) To promote unity, harmony, brotherhood and sisterhood, and goodwill among
members of the association.
c) To provide medical assistance to ailing members as funds are available.
d) To provide mortuary assistance to beneficiaries of deserving members.
e) To actively participate in socio-economic activities beneficial to its members.

ARTICLE III – MEMBERSHIP


Section 1 - Membership to the Association and to the Federation is voluntary in nature.
Section 2 - All Senior Citizens of Barangay Habag, provided under RA 7432 are eligible for
membership provided:
a) That he/she is 60 years old or above at the time of membership;
b) That he/she is mentally and physically fit to be evaluated and determined by
the officers of the association.
c) That he/she is willing to attend on every meeting, participate in every
programs and activities of the association.
Section 3 - All senior citizens are required to register with the Office of the Senior Citizens
Affairs (OSCA), Lanuza, Surigao del Sur.
a) Identification Card (ID) is provided for by the OSCA as proof of registration.
b) The association shall be furnished with a photo copy of Senior Citizen ID upon
membership.
Section 4 - Transferees
Any member who wishes to transfer in his/her membership shall present duly
approved, signed clearance and or certification from his/her original unit.

ARTICLE IV – OFFICERS
The officers of the association shall be the following:
1. President
2. Vice- President
3. Secretary
4. Treasurer
5. Auditor
6. Public Information Officer
7. Sgt. At Arms
8. Business Manager

ARTICLE V – DUTIES AND RESPONSIBILITIES OF OFFICERS


A. President
1. Presides over the meeting of the association.
2. Has the power to call for special or emergency meeting of the association.
3. Represents the association in all official functions and transactions, however,
major transactions shall be decided by the majority of the members.
4. Prepares project plans in coordination with the proper committee and subject
for the adaptation and approval of the body.
5. Conceptualize ideas of new programs and projects that benefit each members of
the association.
6. Oversee budgeting, source funding and cost forecasting of programs, projects
and activities of the association.
B. Vice-President
1. Perform the duties and function of the President in case of the latter’s absence,
disability, death or resignation.
2. Perform functions that maybe assigned to him by the President.
C. Secretary
1. Take down minutes of the meetings of the association.
2. Be the custodian of the roster of officers and members, minutes of the meeting,
resolutions correspondence and documents as well as printed and/or written
policies, projects and activities of the association.
3. Submit to the DOLE and OSCA of Association members, list of offices, and other
respective addresses, minutes of election and list of voters within 30 days from
the date of election or from the occurrence of the change in association officers
and such other documents or papers as may be required.
D. Treasurer
1. Collect, receive and issue receipts for all money, funds and contribution to the
association.
2. Collect fees and dues of the members of the association.
3. Records and keeps all receipt and disbursement of funds in the Books of
Accounts provided for the purpose.
4. Disburses the funds only upon approved by the President and majority of the
members of the association.
5. Prepares and reports the financial status of the association during monthly
meeting and/or as needed.
E. Auditor
1. Audit, verify and examine all financial accounts of the association from time to
time and certify to the correctness of the reports.
2. See to it that the expenses and disbursements shall be within the provisions of
the constitution and By-Laws.
3. Shall render a report of audit or summary of records of the Treasurer’s
collection and Disbursements as maybe required or by resolution of majority of
the general membership.
F. Public Information Officer
1. He shall be in charge of matters involving public information of the association
and make such releases as maybe necessary in the interest of the association
subject to the approval of the President.
2. With the approval of the President and of the General Membership, he may
establish an official publication for the association.
G. Sgt. At Arms
1. He shall be in charge of the preservation of Peace and Order during the meeting
of the association.
H. Business Manager
1. He shall be in charge of matter/s involving the operation of the Association,
based on the approved work program of the General Assembly
2. He/she is also responsible for recommending to the association projects, plans
strategies, for further improvement.

ARTICLE VI – TERM OF OFFICE


Section 1 - The Officers of the Association shall hold for a period of three (3) years from the
date of their election until their successor shall have been duly elected and
qualified,
Section 2 - Officers of the Association may seek for re-election after the position has already
served, provided that they remain members of the Association of good standing.
Section 3 - Vacancies in the position cause by death, permanent disability, dismissal or
resignation of an officer, except the position of the President, shall be filled up by
appointing any member(s) as authorized by the general membership, the
remaining or un-expired term shall be served by the newly appointed officer
until the next election be made.
ARTICLE VII – MEETING OF THE ASSOCIATION
Section 1 - Regular monthly meeting shall be held every last Saturday of the Month.
Section 2 - Special and emergency meeting shall be called by the President as the need
arises.
Section 3 - Food or snacks to be served during meetings is voluntary unless the association
opted to shoulder the expenses.
Section 4 - Representative is allowed in behalf of the registered member is not able to
attend the meeting.
Section 5 - Order of Business
The following shall be the order of business during regular and special or
emergency meetings.
1. Invocation/Opening Prayer
2. Call to Order
3. Attendance/Roll Call
4. Reading and Approval of the minutes of previous meeting
5. President’s Report
6. Treasurer’s Report
7. Business of the Day/Agenda
8. Other Matters
9. Adjournment

ARTICLE VIII – QUORUM AND RULES OF ORDER


Section 1 - Quorum shall be declared when one-half plus one (1/2+1) of the total members
are present during meetings.
Section 2 - All members present during meetings shall observe proper decorum at all times.
Section 3 - All decisions are arrived by majority votes of the members present.

ARTICLE IX - ELECTION
Section 1 - The election of officers shall be held every three (3) years immediately following
the last record.
Section 2 - The election shall be administered and observed by representative from the
Office of the Senior Citizen Affairs (OSCA) and/or Municipal Social Welfare and
Development Office (MSWDO).
Section 3 - Qualifications of the Officers
1. Must be a bonafide member of the association of senior citizen.
2. Must be a registered voter and resident of Habag, Lanuza, Surigao del Sur.
3. Must be physically and mentally fit.
4. Must have a good track record.
Section 4 - Conduct of Election
1. Nomination of Candidates shall be done by either self-nomination or from any
members.
2. Voting shall be by secret ballot or by merely raising hands.
ARTICLE X – FUNDS AND FINANCIAL OBLIGATION
Section 1 - New members are required to pay One Hundred Pesos (₱100.00) as
Membership Fee that goes to the General Fund.
Section 2 - All members must contribute an amount of One Hundred Pesos (₱100.00) in
advance as part of the Mortuary Fund.
Section 3 - Compulsory monthly dues of Twenty Pesos (₱20.00) shall be collected every
monthly meeting.
Section 4 - Legitimate member shall be entitled to the amount of Five Thousand Pesos
(PhP5,000.00) as Mortuary Benefit and be given immediately by the Treasurer
after his/her death.
Section 5 - Only legitimate beneficiaries and/or immediate family members can claim the
mortuary benefit after submission of duly approved death certificate of the
deceased member.
Section 6 - The association is authorized to raise funds through solicitation, fund raising,
donations and other fund raising activities pursuant to RA 7432, as amended
and its Implementing Rules and Regulations.
Section 7 - The officers and members will decide as to where or how to spend the
accumulated funds, if any, provided it is for the best interest of the association.
Section 8 - The association shall open and maintain Bank Account when deemed necessary
where collections are properly deposited and withdrawals are properly
authorized.

ARTICLE XI – DISMISSAL AND REINSTATEMENT


Section 1 - Any member who fails to pay his/her financial obligation for three (3)
consecutive months shall be subject for dismissal and be dropped from the
rolls of members.
a. He/She shall be notified ahead regarding his/her obligation before any dismissal
be made.
b. Proper dismissal notice shall be sent to person concerned.
Section 2 - Voluntary Dis-membership
Any member, who voluntarily surrenders his/her membership from the
association for any reason, shall properly notify the association and such
decision shall be respected and granted unconditionally.
Section 3 - In case of members who previously surrendered their membership but decided
to rejoin the association shall pay financial obligation required as a new member
and comply all rules and regulations as provided in this Constitution and By-
laws.
Section 4 - For the officers of the Association, any of the following shall be a ground for
dismissal:
a. Malicious attacks against the association, its officers and members.
b. Failure to return any money or property of the association within a specified
period of time.
c. Misappropriation of association’s funds and property. This is without prejudice
to the filing of an appropriate criminal or civil action against the responsible
officers by any interested party.
d. Gross misconduct unbecoming of an officer of the Association.
e. Willful violation of any provisions of this Constitution, rules and regulation,
resolution and decisions of this association.

ARTICLE XII – FISCAL YEAR


Section 1 - The Association’s fiscal year start on January and end on December 31 of every
year.

ARTICLE XIII – AMENDMENTS


Section 1 - Amendments to this Constitution and By-Laws maybe proposed during monthly
meeting provided that:
a. Proposal shall be submitted in writing 20 days ahead of monthly meeting.
b. Two-third (2/3) of the members present constituting a quorum approve the
amendments.

ARTICLE XIV – ADOPTION AND EFFECTIVY


Section 1 - The foregoing Constitution and By-Laws are hereby adopted and approved by
the majority on the members of the Association and shall take effect on the day
following its ratification.

This Constitution and By-laws is hereby adopted and ratified this _____ day of
________________ at Habag, Lanuza, Surigao del Sur with the list of members, together with their
signatures, who ratified the same appearing in Annex “A” hereof.
