Respected Sir,
(1) I say that Mr. Hasmukhbhai Lavjibhai Savliya alias Harsukh Patel &
Mr. Jaisukh Lavji Patel were the joint lawful owner, using and
occupying the Flat No. 409, on the Fourth Floor, admeasuring area
36.43 sq.mtrs (Built-up area), in the building and the society known
as The Diwakar Bhavan Co-op Hsg. Soc. Ltd., at Plot no. 12 & 13
Narayan Nagar, Bhayandar (West), Taluka & District Thane-401
101, constructed on plot of land bearing Old Survey no. 16, 17, 18;
New Survey no. 352, 355, 353 and Hissa no. 1P,1P,2P at revenue
village of Bhayander, Taluka & Dist. Thane.
(2) I say that Mr. Hasmukhbhai Lavjibhai Savliya alias Harsukh Patel &
Mr. Jaisukh Lavji Patel was a bona-fide member of the society and
holding share certificate no. 61 for five fully paid up shares of Rs.
50/- each number from No. 301 to 305 (both inclusive).
(3) That Mr. Hasmukhbhai Lavjibhai Savliya alias Harsukh Patel died
intestate on 13/07/2023 and leaving behind his following surviving
legal heirs –

myself, my grandmother namely (1) Mrs. Nathibhai Lavjibhai Savliya

alias Nathibhai Patel, my mother namely (2) Mrs. Vijya
Hasmukhbhai Savaliya & my brother namely (3) Mr. Jigar
Hasmukhbhai Savaliya, there is/are no other legal heir/s of the
Deceased Mr. Hasmukhbhai Lavjibhai Savliya alias Harsukh Patel.
(5) After demise of Mr. Hasmukhbhai Lavjibhai Savliya alias Harsukh
Patel me, my grandmother namely (1) Mrs. Nathibhai Lavjibhai
Savliya alias Nathibhai Patel, my mother namely (2) Mrs. Vijya
Hasmukhbhai Savaliya & my brother namely (3) Mr. Jigar
Hasmukhbhai Savaliya, have inherited and acquired 100% shares and
interest of deceased member in the said Flat in equal ratio as per
Hindu Succession Act.
(6) I say that being legal heirs of the deceased my grandmother namely
(1) Mrs. Nathibhai Lavjibhai Savliya alias Nathibhai Patel, my
mother namely (2) Mrs. Vijya Hasmukhbhai Savaliya & my brother
namely (3) Mr. Jigar Hasmukhbhai Savaliya,, released, relinquished
 and transferred their undivided share and interest in said Flat in my
favour by executing a Deed of Release by heirs of deceased dated
____ February 2024 registered with office of sub-assurance of
Registrar, Thane– 7 bearing registration no. _____________. In view
of the said Deed, I am entitled to make an application for membership
of the Society for transfer of shares and interest of the deceased
member in the capital/property of the Society to my name as per rule
35 of bye-laws of the society.
(7) I remit herewith an amount of Rs. 100/- as entrance fee our
particulars for the purpose of consideration of my application for
membership of the Society are as under:

(8) I undertake to discharge the present and future liabilities to the
Society. I have got understood the bye-laws of the Society and
undertake to abide by the same and any modifications that the
Registering Authority may make in them. I request you to please
admit me as a member of the Society and transfer the shares and
interest of the deceased member in the capital/property of the Society
to my name.
(9) The share certificate held by the deceased member is enclosed
herewith. I undertake to use the Flat for purpose for which it was
allotted to or acquired by the deceased member and that any change
of user will be made with prior approval of the society.

Note:
(1) The expression “a member of a family” means as defined under bye-law
no. 3 (xxv).
(2) The undertaking about registration of the Flat is not necessary if the
nominee is related to the deceased member within the meaning of Section
2(41) of the Income-tax Act
