At the outset each and every content/allegations/statements of your notice are denied as if the same have been traversed and denied in seriatim. 3. It is stated that no transaction ever took place between your client, M/s. Siblings and my clients. My client Mr. Chhatrapati Ranjit Rai never issued the Cheque No. 004653 dated 24.2.2024 for a sum of Rs.82,737/- (Rupees Eighty Two ‘Thousand Seven Hundred and Thirty Seven Only) in its personal capacity. The said Cheque was issued by C & R Textiles Private Limited. 4, Itis stated that Romil Rai and Vikrant Rai are neither signatory to the said cheque nor are responsible for day-to-day affairs of the Company, C & ReTextiles Private Limited. My clients are not personally liable to pay any monies to your client 5. Inlight of the above correct facts and events it is clear that no amount is due and payable by my client towards the alleged wrongful detention of the said cheque by your client. Further, no offence under Section 138 of the NI Act is made out against my client - 6. Its stated that since no amount is due and payable, your notice is bad in law, misconceived. In these circumstances I would request you to withdraw the notice under reply as the same is misconceived and based on wrong facts.
