THE UNSOLVED ARUSHI MURDER
This information is in response to newspaper & news media publications

The most exciting case, of the Murder of Aarushi, a fourteen years old girl, in mysterious
circumstances, became mind bugling news in May 2008 (15 years since). This case baffled the
judiciary of entire India and world. It is still continuing with newly additional problems in Supreme
Court of India.

The case in brief: -

On the previous night of the incidence Aarushi went to sleep in her bed room after dinner.
It was locked from outside by her father. No outsider but she herself only can open it from
inside.

The next early morning her father Dr.Rajesh Talwar discovered that Arushi’s room
remained open. He detected, to his dismay that Aarushi was murdered and searching other
rooms he found Hemraj, their cook cum house hold help, was found no-where. The evidence of
his escaping out was further noted by not finding him in his bed room. and the gate of their
compound remained open. This made the parents concluded that their cook cum servant is the
villain. On ringing to his (Hemaraj) phone there found a ring which was stopped immediately.
There was no response on repetition.

After F.I.R came the investigating police officers. His initial local-field study found that a
sharp-cut injury on throat killed her. Also there found the evidence of rape. Her buttock area of
the bed was found cleaned well recently. The investigating officer did not give any importance to
it. Other activities like postmortem that included different injuries & there affect on her body,
neck, head and her privet parts were recorded. Her funeral activities like burning the body and
disposal of the ashes in river Ganga was done in undue haste.

During her postmortem there was some attempt to influence doctors to omit evidence of
rape from the report. So much so that the swab and fluid from the privet parts could not be
thoroughly examined and the affair on rape was tried to be hushed up. The cleaning of the
buttock area & wearing under wear, though appears unusual, did receive no attention of
investing official or onlookers.
Next day another enquiring police officer located an adjacent terrace with the door
locked. Opening it a dead body was found. It was of Hemaraj the servant who was considered
as the murderer till then.

The trial lasted for more than a decade. During the trail Hemaraj’s friends and the doctor
with his wife were suspected to be the murderers. At last the verdict went against Dr. Talwar
and his wife Nupur Talwar. They were given life term. On appeal in senior court; they were
released. But Dr. Talwar filed a revised petition and retrial started. The judgment went against
Dr. Couple that proved honor-killing.

The author, a retired professor ENT who has medico legal experience in his earlier
period of service, had followed the case. He contacted Arushi’s father, the investigating officials,
and lawyers, judges (active and retired) in earlier period of trail.

No or very rare help was found to give any new light on this litigation or murder to the
author. But he found some intricate knowledge from his medical knowledge that is lacking in
common people. These are the physiology of human body, psycho neurology of brain &
compelling physiology induced by hormonal glands which changes with age & circumstances.

Points to note: -

1. The first police officer did not give sufficient attention to the surrounding of the
incident. Bottle of wine in the entrance room of the Dr. Talwarsr’s house – good
evidence that one or many outsiders entered the room. There should be search for
the origin of the bottle – its source and date of purchase or from doctor’s own stock.
2. The thorough wash-up of bed cover at the site of the pelvic region of the victim was
very important but it was not collected & given due importance. The bed cover and
the cloth used for cleaning were important materials to identify the culprit / culprits
from seminal fluids or other biological materials. Injuries in private parts - fresh, post
mortem or older ones would add to diagnosis.
3. Hush up telephones to the doctor’s doing postmortem, undue hurry in funeral
function and Disposal of ashes in the Ganga River are never considered unusual.
There were desperate attempts to negate any evidence of rape or other sexual harm
on the girl.
The collected viscera or swabs were made lost (or neglected). All this
indicates some hidden activities to wash up the evidence of rape and sexual
misconduct. The cleaning materials used to clean the victim’s bed are the sure shot
for finding the assailants.
4. The use of golf sticks to kill the girl and her paramour during their active intercourse
in sleeping position is not acceptable as the striking area of gulf stick-head is small
and can’t injure the temporal area of both. Also it is impossible that a loving couple
remain so sub conscious so that Dr, Talwar could search the stick and came to a
position to strike for honor killing. The movement of a polo-stick in a hose can gather
no momentum. Similarly the surgical blade attributed to cut the throat of Aarushi and
Hemraj is next to impossible. These blades are meant for incising mucous
membrane of gum and at a stroke can cut 1/4th of a millimeter deep.
5. Maternal Sentiment on her children’s prestige is so high that Dr,Nupur
Talwar accepted imprisonment of both, the husband & wife, than to open up the
truth that their daughter was character less and can mix with a low grade persons.
6. What a sincere, devoted, pious true love materialized in a catastrophe? The girl
would not face a throat cut if she was character less.
7. Most person without scientific knowledge in body physiology, hormonal control &
psycho-neurology can’t understand the true love and the maternal affection to
preserve the good name of their children.

One probability imagined that may be true.

The girl was enticed by the house hold servant. He was elated and became proud of
such achievement. And so he might have boasted of this achievement to his intimate friends.
They might have doubted and so Hemraj promised a life demonstration.

On the fateful night as soon as Dr Talwar locked the door of Aarushi, she went to bed
and he himself went to his bed. Then the invited friend (probably two) sneaked into Talwars
house and enjoyed a drink.

The hero then demonstrated his prideful achievement – went near the girl’s room &
tapped. The girl, as if in waiting, opened her door. And then there started the high drama.

Could inebriated friends tolerate that scene? They would enter the room and forcefully
demanded their share.

The girl, honest and sincere in her love bravely resisted the unholy attempts of goons till
she lost her life in throat cut.
The affectionate mother, facing gallows and claim of compensation by the wife of Hemraj
is struggling for saving her daughter from bad name. July 5 -23
