Statutory Instrument 146—2.

The Forests Rules.


(Under section 29 of the Act.)

1. Citation.

These Rules may be cited as the Forests Rules.

2. Application.

These Rules shall only apply to central forest reserves and open land, other
than open land in an area declared by statutory order to have an adequate
forest estate, and forest produce grown or produced on such reserves or land.

3. Classification of trees.

For the purpose of these Rules, trees shall be classified in the manner set out
in Part B of the First Schedule to these Rules. Trees of the species marked
with an asterisk in that Part of that Schedule shall be known as reserved
forest produce.

4. Forms.

Except when otherwise provided, every agreement to pay compensation


under section 27 of the Act and every licence or permit under the Act and
these Rules shall be in the appropriate form set out in the Second Schedule
to these Rules.

5. Licences.

(1) Any of the persons authorised under section 11(1) of the Act to
issue licences may dispose of forest produce by the issue of licences to cut,
take, work or remove forest produce—
(a) subject to rule 6 of these Rules, on payment of the fees set out in
Part A of the First Schedule of these Rules;
(b) where the licence is advertised for disposal by public tender, on
payment of such fees as may be decided by the issuing officer
after the tenders have been received;
(c) where the licence is disposed of by public auction or private
treaty, subject to and in accordance with rule 8 or 9 of these
Rules, as the case may be; or
(d) free of charge—
(i) to any person exempted from the payment of fees; or
(ii) if the issuing officer is satisfied that the disposal of any
forest produce without charge would be of advantage to the
Government.

(2) Every licence shall be subject to the conditions appearing in the


appropriate form of licence set out in the Second Schedule to these Rules;
except that the issuing officer may, at the time of issue, vary or cancel any
condition so appearing or impose additional conditions.

(3) A senior forest officer may at any time suspend or cancel a


licence if the holder contravenes or fails to comply with any condition of the
licence or is convicted of an offence under the Act.

6. Issue of licences at prescribed fees.

The issue of licences at the fees prescribed in Part A of the First Schedule to
these Rules shall be subject to the following conditions—
(a) where a maximum and minimum fee is prescribed the chief
conservator shall fix the fees after considering the species, the
accessibility and the potential market value of the produce
concerned;
(b) the fees prescribed shall apply to standing produce, that is to say
produce which has not been felled, cut up or gathered. The chief
conservator shall be entitled to charge extra fees for any expenses
the Government may incur in the felling, preparing, loading,
delivering or otherwise dealing with the produce or for
supervising that work;
(c) the fees shall be paid at the time when the licence is granted or at
such other time as may be stated on the licence.

7. Issue of licences by public tender.

The issue of licences by public tender shall be subject to the following


conditions—
(a) the chief conservator shall advertise the sale in such manner as he
or she thinks fit, and persons tendering in answer to the
advertisement shall abide by the conditions set out in the
advertisement;
(b) the chief conservator need not accept the highest or any tender;
(c) if the chief conservator is not satisfied with the tenders offered,
he or she may call for other tenders, or otherwise dispose of the
produce in accordance with the Act and these Rules.

8. Issue of licences by public auction.

The issue of licences by public auction shall be subject to the following


conditions—
(a) the chief conservator shall advertise the sale in such manner as he
or she thinks fit, and persons bidding at the auction shall abide by
the conditions set out in the advertisement;
(b) the chief conservator may fix a reserve price;
(c) the sale may be conditional on the purchaser paying on the day
of the sale the amount bid in full or on the payment of a deposit
as provided for in rule 11 of these Rules. If payment of the
deposit is not made, the auctioneer shall put the produce up for
auction again, or the chief conservator may order the produce to
be sold as otherwise provided in the Act or these Rules;
(d) the sale shall be in accordance with the Auctioneers Act.

9. Issue of licences by private treaty.

The issue of licences by private treaty shall be subject to such terms and
conditions, including terms and conditions as to the payment of fees, as may
be agreed.

10. Special licences and permits.

Notwithstanding any other provision of these Rules, the chief conservator,


with the approval of the Minister, may issue special licences and permits to
plant, cut, remove or otherwise deal with forest produce; and the licences or
permits shall be in such form and subject to such conditions, including
conditions as to the payment of fees, as the chief conservator, with the
approval of the Minister, may decide.

11. Security for fulfillment of obligations.


A person to whom any forest produce has been sold or to whom the use or
occupation of any land, sawmill or building has been granted under the
provisions of the Act or these Rules may be required to provide a cash
deposit, bank guarantee, surety bond or other security approved by the chief
conservator as security for the due fulfillment by that person of all his or her
obligations in respect of the produce, land, sawmill or building, including
payment of dues in respect thereof and any payment for damage to
Government property for which he or she may become liable; but provision
of the deposit, guarantee, bond or other security shall not release any such
person from his or her liability in excess of the value of the deposit,
guarantee, bond or other security for loss sustained by the Government
through the nonfulfillment of that person’s obligations or as a result of
damage for which that person is liable.

12. Conditions under which persons may be exempted from the


payment of fees.

(1) When any person or class of persons has been exempted from the
payment of fees for the cutting or removal of forest produce, the exemption
shall be subject to the following conditions—
(a) that the person or class of persons shall use the produce only for
his or her or their own personal use for buildings and domestic
purposes, for local authority buildings, for native tribal use, or for
such medical, educational, religious and other purposes as shall
have been authorised by the Minister;
(b) that no reserved forest produce is cut or removed without a
permit which shall be issued at the discretion of the issuing
officer and in no case shall the produce be cut if of less than the
minimum girth prescribed in the fourth column of Part B of the
First Schedule to these Rules;
(c) that no trees planted by or on behalf of the Government or by or
on behalf of the occupier of any open land or that person’s
forbearers are cut or removed;
(d) that no such produce is cut or removed in any area declared under
the Sleeping Sickness Act to be a restricted area or a closed area;
and
(e) that no such produce is sold, bartered, or exchanged or used to
pay, recompense or reward any person.

(2) Any person who cuts or removes any forest produce in


contravention of the conditions in subrule (1) of this rule shall be liable to
pay the forest fees normally chargeable for that produce; that liability shall
in no way affect the liability of that person to be prosecuted for the
contravention.

(3) Any person cutting or removing forest produce when exempted


from the payment of fees shall obey all reasonable orders given to him or her
by a forest officer.

13. Closing of areas.

(1) A senior forest officer may declare any area closed for the cutting
or removal of forest produce or any class of forest produce if he or she
considers it necessary—
(a) for the proper planning and administration of the area;
(b) in order that there should be proper regeneration of any forest
produce;
(c) to safeguard the requirements of a particular market; or
(d) to safeguard the economic or climatic value of any forest.

(2) Where an area has been closed under subrule (1) of this rule, it
shall be unlawful for any person to cut or remove forest produce in that area,
or, if the declaration has been made only in respect of certain forest produce,
to cut or remove that produce.

(3) A senior forest officer making a declaration under subrule (1) of


this rule shall advertise the declaration in such manner as he or she sees fit.

14. Permits.

(1) Permits to carry out any work or to do anything in a forest reserve


which is prohibited under section 13(2) of the Act may be granted by a senior
forest officer in his or her discretion and shall be subject to the conditions
appearing in the appropriate form of permit set out in the Second Schedule
to these Rules; except that the issuing officer may, at the time of issue, vary
or cancel any condition so appearing or impose additional conditions.

(2) No fee shall be payable on the grant of a permit under this rule.

(3) On the expiration or termination of a permit, unless there is a


written agreement to the contrary, the holder shall not be entitled to any
compensation for any improvements made by him or her to any land to which
the permit relates or for any crops planted by him or her in any such land, and
all fixtures on any such land shall become the property of the Government.

15. Cancellation of permit.

A senior forest officer may at any time suspend or cancel a permit if the
holder of the permit contravenes or fails to comply with any condition of the
permit or is convicted of an offence under the Act.

16. Oath to be taken by honorary forest officers.

Every honorary forest officer shall before assuming his or her duties take an
oath before a magistrate in the following form—
“I, ________________, swear that I will be faithful and bear true
allegiance to the Republic of Uganda, and that I will faithfully
serve the Government of Uganda in the office of honorary forest
officer in Uganda. So help me God.”

17. Prohibition of possessing inflammable materials.

No person shall possess in or bring into a forest reserve, unless that person
lawfully resides in the reserve, any articles or materials of any inflammable
or combustible nature unless those materials are necessarily required for the
lawful cutting or removing of forest produce.

18. Exemption of certain persons from payment of fees.

The persons set out in the first column of the Third Schedule to these Rules
are exempted from the payment of the fees set out in the second column of
that Schedule.

19. Trade names of timbers for export.

The timbers set out in the first column of the Fourth Schedule to these Rules
shall, where any such timber is intended for export, be referred to only by the
name set out in the second column of that Schedule or, in any case where no
name is included in the second column, by the name or one of the names
appearing in the third column of that Schedule.

Conditions.

1. The licensee shall cut and take only such forest produce as shall have
been marked or otherwise designated for that purpose by a forest officer.

2. The licensee shall not remove from the place of felling or collection any
forest produce allowed by this licence until the produce has been measured and/or
marked by a forest officer with the forest department hammer mark.

3. The licensee shall take all necessary precautions to prevent damage to


other forest produce arising out of his or her operations under this licence and shall
be responsible for the acts of his or her servants, employees or agents.

4. The licensee and his or her servants and employees shall at all times
assist forest officers in the prevention and extinction of fires in or threatening the
area the subject of this licence, and in the prevention and detection of forest
offences.

5. In the event of a breach of the Forests Act or any rules made under it
or any term or condition of this licence, this licence may be cancelled and the forest
produce forfeited, without prejudice to any proceedings which may be taken in
respect of the breach.

6. The licensee shall, on the expiry of this licence or on the earlier removal
of the forest produce allowed by the licence, produce this licence to a forest officer
for endorsement.

7. In the case of produce allowed free to persons exempted for the


payment of fees—
(a) this licence entitles only the person named above or his or her agent or
partner named below to fell, work and remove the produce specified
________________________________________________________;
(b) the produce may be used only for the purpose of __________________

(c) no part of the produce allowed shall be sold, bartered or exchanged or
used to pay, reward or recompense any persons;
(d) the produce may not be cut, collected or removed from any area
declared under the Sleeping Sickness Act to be a restricted area or a
closed area;
(e) the holder shall on the expiry of this licence or when the produce
allowed by it has been taken, whichever is the earlier, surrender this
licence to the issuing officer.

Unless otherwise stated, at breast height, i.e., 1.3 metres above the ground.
Conditions.

1. The licensee shall fell only such trees or collect such produce as shall
have been marked or otherwise designated for felling or collection by a forest
officer.

2. Within seven days of felling the trees or collecting the produce allowed,
the licensee shall notify a forest officer of the felling or collection in order that the
forest officer may measure the trees or produce.

3. The licensee shall not commence to saw up or convert any trees the
felling of which is allowed by this licence or remove from the place of felling or
collection any trees or produce the felling or collection of which is allowed by this
licence until he or she has been authorised to do so by a licence to take forest
produce in Form A.

4. The licensee shall take all necessary precautions to prevent damage to


other forest produce arising out of his or her operations under this licence and shall
be responsible for the acts of his or her servants, employees or agents.

5. The licensee and his or her servants and employees shall at all times
assist forest officers in the prevention and extinction of fires in or threatening the
area subject of this licence, and in the prevention and detection of forest offences.

6. In the event of a breach of the Forests Act or any rules made under it
or any term or condition of this licence, this licence may be cancelled and the forest
produce forfeited without prejudice to any proceedings which may be taken in
respect of the breach.

7. The licensee shall, on the expiry of this licence or when the trees or
produce allowed by it have been measured by a forest officer, whichever is the
sooner, surrender this licence to the issuing officer.

8. If the fees due in accordance with the First Schedule to the Forests
Rules on the produce felled or collected under this licence are paid within one month
of the date on which the trees or produce are measured and provided that the
licensee has fulfilled the conditions of this licence, these fees will be reduced by the
amount paid on this licence.

Conditions.

A. Applicable to all Form C permits.

1. The permit holder shall take all necessary precautions to prevent


damage to other forest produce arising out of his or her operations under this
permit and shall be responsible for the acts of his or her servants, employees
or agents.

2. The permit holder and his or her servants and employees shall at
all times assist forest officers in the prevention and extinction of fires in or

threatening the area the subject of this permit, and in the prevention and
detection of forest offences.

3. In the event of a breach of the Forests Act or any rules made


under it or any term or condition of this permit, this permit may be cancelled
without prejudice to any proceedings which may be taken in respect of the
breach.

4. The permit holder shall, on the expiry of this permit, surrender it


to the issuing officer.

B. Applicable to permits to reside and/or cultivate.

5. The permit holder shall demarcate the area clearly as directed by


a forest officer.

6. Only those persons registered as the family of the permit holder

may reside and/or cultivate in the area, together with children below the age
of twelve years, provided that children of the above on reaching the age of
twelve years may be added to the permit by a senior forest officer on the
application of the permit holder.

7. The permit holder shall at all times practise good husbandry on


the area under cultivation and shall comply with any reasonable direction of
an agricultural officer regarding cultivation.

8. No perennial crops shall be planted on the area allowed by this


permit, except with the express permission of a senior forest officer
expressed in writing.

9. The permit holder shall remove at his or her own expense all
buildings and crops erected or planted under this permit within _____ months
of the expiry of this permit.

10. The permit holder may at any time terminate this permit by giving
the issuing officer not less than three months’ notice of the termination.

C. Applicable to permits to graze.


11. No huts or cattle bomas shall be built in forest reserves without
the prior approval of a forest officer and then only in such places and
numbers as he or she may direct.

12. If at any time a senior forest officer considers that the continuance
of grazing is likely to lead to deterioration of the soil or vegetation on the
area the subject of this permit, he or she may terminate the permit by giving
the permit holder one month’s written notice of the termination.

13. The permit holder may at any time terminate this permit by giving
the issuing officer not less than one month’s notice of the termination.

D. Additional special conditions.

1. The permit holder shall demarcate the area clearly as directed by


a forest officer.

2. No new houses shall be built within the encroachment, and no


extensions may be made to houses already within the encroachment at the
time of issue of this permit.

3. No trees (including shrubs, bamboos, etc.) shall be cut outside the


demarcation area for any purpose other than building and domestic use of the
permit holder and his or her family in accordance with the Forests Act.

4. The permit holder and his or her family shall at all times assist
forest officers in the prevention and extinction of fires and the prevention and
detection of forest offences in the _______________ Central Forest Reserve.

5. In the event of the breach of any of the conditions of this permit,


the permit may be cancelled on three months’ notice, and all property of the
permit holder remaining in the area at the expiration of this period shall be
liable to be forfeited to the Government.

6. The permit holder shall obtain annually a temporary occupation


licence in respect of the encroachment, and the terms of the licence shall be
binding in addition to the conditions set out in this permit.

7. A forest officer may at any time plant mvule or mahogany trees


within the encroachment, and the permit holder shall at all times take due
care to ensure that no damage is done to these trees. The spacing of the trees
shall be such that no planted trees shall be closer than ten feet to any other
planted tree.
