THE CRIMINAL TRIAL

CHILD ABUSE LEADING TO DEATH AND


CULPABLE HOMICIDE
The case involves a criminal trial in Brunei
Darussalam regarding child abuse leading to death
and culpable homicide not amounting to murder.

Introduction Parties involved: Defendant (local citizen), deceased


child (Miss X), child witness (Miss Y), police witnesses,
and judicial commissioner (Pg DP Hjh Rostaina).
Background
The defendant, a car washer, lived with his family
and his wife's nieces, Miss X and Miss Y, who were
under their care.

On the morning of 17th August 2016, the


defendant scolded and assaulted Miss X, leading
to her death.

Miss Y, the child witness, testified about the


defendant branding her with a cigarette on her
right leg.
The problem
The main problem is the defendant's
culpability in the death of Miss X and the
abuse of Miss Y.

This case is significant due to the severity of


the charges, involving child abuse and
culpable homicide.
