AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (MOA), entered into this _____ day of


______, 2024 by and between:

The _________________________________,
hereinafter referred to as Municipal Accountant or City
Accountant;
and
The ___, a national government agency duly established by virtue
of __________________, with Principal office at the
______represented herein by the ______, hereinafter referred to
as ____.

Herein collectively referred to as the “PARTIES”.

WITNESSETH, that:

WHEREAS, the DSWD, as the lead government agency in social


protection, welfare and development, is mandated to assist local government units
(LGUs), non-governmental organizations, other national government agencies,
people's organizations, other members of civil society as well as individuals, in
effectively implementing programs, projects, and services that will alleviate poverty
and empower disadvantaged individuals, families and communities for an
improved quality of life; and to implement statutory and specialized programs
which are directly lodged with DSWD;

WHEREAS, the DSWD has continuously implemented poverty reduction


programs such as the Sustainable Livelihood Program (SLP) which is mainly a
community-based capacity-building program that involves a two-track system in
which participants are given the option to take either the (a) Microenterprise
Development track or the (b) Employment Facilitation track after participating in
social preparation and capacity-building activities to be conducted by the Project
Development Officers from different regions;

WHEREAS, the DSWD is an agency also mandated to lead the


implementation of the Pantawid Pamilyang Pilipino Program (4Ps) which is the
national poverty reduction strategy and a human capital investment program that
provides conditional cash transfer to poor households for a maximum period of
seven (7) years to improve the health, nutrition and education aspect of their lives
pursuant to Republic Act (R.A) No. 11310 or 4Ps Act;

WHEREAS, Sec. 13 of the Implementing Rules and Regulations (IRR) of


R.A. No. 11310 on Livelihood Interventions states that qualified households shall
be given priority in the availment of the modalities and interventions under
DSWD’s SLP or other appropriate or similar programs offered by other
government agencies or accredited private institutions, in accordance with their
policies and guidelines;

WHEREAS, Sec. 19 of RA 11310 on Convergence of Programs and Services


stipulates that “within the framework of a national poverty alleviation strategy and
a holistic social protection program, the various agencies of government

implementing multi-stakeholder programs and services for the poor shall
guarantee that the same complement and converge seamlessly intending to ensure
that the targeted household-beneficiaries are alleviated from poverty and remain
non-poor even after the prescribed maximum period for the conditional cash grant.
Such convergence shall focus on the enhancement of the operational efficiency and
strengthening of inter-agency partnerships and funding of the program. The
DSWD shall monitor the performance of these agencies to ensure the
sustainability and positive impact of its pro-poor programs.

WHEREAS, under E.O. No. 5, series of 2016, the government approved


and adopted the 25-year long-term vision entitled AmBisyon Natin 2040 as a
guide for development planning, toward building a prosperous, predominantly
middle-class society where no one is poor, a life that is strongly-rooted,
comfortable, and secure: matatag, maginhawa, at panatag;

WHEREAS, the PARTIES, in support of its Gender and Development


Agenda, ensure the protection and promotion of the rights of Filipino women,
especially those belonging to the marginalized sectors of the society, pursue gender
equality in all aspects of the development process to achieve the vision of a gender-
responsive society where women and men equally contribute to and benefit from
development as espoused in the Republic Act (R.A.) No. 9710 or the “Magna Carta
for Women”;

WHEREAS, the PARTIES both recognize the further need to establish a


partnership to institutionalize their cooperative efforts, utilizing resources and
capacities to deliver the intended impact of sustainable livelihoods through micro-
enterprise development to the participants;

WHEREAS, the PARTIES hereby agreed to execute this MOA on the


Livelihood Upscaling for Progressive Agrarian (LUPA), hereinafter
referred to as the “PROJECT”.

NOW, THEREFORE, for and in consideration of the foregoing premises


and the terms and considerations hereunder enumerated, the PARTIES hereunto
express and make their agreement to pursue the following:

ARTICLE I
PURPOSE

To establish livelihood complementation arrangement and to provide referral


mechanism between DSWD-FO 1 and DAR R1 for Sustainable Livelihood
Program Associations (SLPAs) and individual SLP participants to avail DAR’s
programs and services.

ARTICLE II
AREAS OF PARTNERSHIP

a. Areas covered by SLP Regular Implementation


b. Areas where both DSWD-FO 1 and DAR R1 are in partnership with other
government agencies in the implementation of convergence livelihood
programs or projects; and

c. Other areas agreed upon by DSWD-FO 1 and DAR R1

ARTICLE III
COVERAGE

This partnership agreement shall cover new or existing SLPAs and individual SLP
participants in Region 1. All DSWD-FO 1 and DAR R1 provincial offices shall be
provided a copy of the MOA for the actual implementation of activities and
deepening of cooperation as agreed by both parties.

ARTICLE IV
OBLIGATIONS AND RESPONSIBILITIES OF THE PARTIES

A. The PARTIES shall:

1. Designate, through issuance of orders, permanent and alternate project


focal persons at the regional, provincial and city/municipal levels to
implement and monitor the partnership projects;
2. Convene to formulate the strategic plan for common targeted
participants including the implementation phases and its timeline of
operations through the Regional and Provincial Sustainable Livelihood
Councils;
3. Ensure attendance of member agency’s focal and/or
alternate/representative in the conduct of Quarterly Regional and
Provincial Sustainable Livelihood Council meetings, consultation, or
special meetings if necessary, and establish a feedback and monitoring
mechanism to properly coordinate the implementation of the livelihood
projects with stakeholders;
4. Share data and/or documents on existing programs and partnership
projects where common participants can be linked;
5. Monitor, evaluate, and report accomplishments, best practices, and
challenges encountered in the implementation of the partnership
projects;
6. Promote the partnership projects in the Parties’ respective digital
platforms and shall be in accordance with the standards and guidelines
of DSWD-FO1 and DAR R1;
7. Conduct annual regional project assessment and evaluation of the
livelihood project implementation;
8. Furnish their respective Regional and Provincial Offices a copy of the
signed MOA; and
9. Be guided by the existing guidelines, guidance notes, and advisories in
the implementation of the MOA.

B. The DSWD-FO 1 shall:

1. Facilitate the coordination of the Parties at the regional and provincial


level;
2. Provide guidance and technical assistance in the implementation of the
Regional MOA;
3. Endorse micro-enterprises of SLP participants to DAR R1 for
supplementary/ complementary intervention;
4. Co-develop modules and training design for the SLP participants;
5. Coordinate and assist DAR R1 in the conduct of social preparation and
capability building for the qualified program participants with the

necessary specific implementation agreements and work plans consistent
with this Regional MOA;
6. Assist the qualified program participants in preparing and developing
their project proposals;
7. Provide seed capital funds and community mobilization funds to
approved complementing projects pursued by the qualified program
participants based on the assessment of the DSWD SLP staff and existing
SLP guidelines;
8. Serve as the secretariat in the Regional and Provincial Sustainable
Livelihood Councils and conduct quarterly partnership meetings, or as
needed with the regional/ provincial counterparts to discuss
implementation concerns, updates, and evaluation of the PROJECT to
determine areas for improvement and/or expansion.

C. The DAR R1 shall:

1. Provide complementary support services to SLP Associations with


members who are also listed as Agrarian Reform Beneficiaries (ARBs)
through rural infrastructure and necessary facilities for improved farm
productivity;
2. Assist in the crafting of SLPAs’ project proposal through the provision of
technical assistance; and
3. Provide capacity development support and technical assistance to SLP
Associations with members who are also listed as ARBs, particularly on
product development and diversification.

ARTICLE V
IMPLEMENTATION OF THE MOA

A. The existing guidelines, guidance notes, and advisories of the PARTIES


shall be followed in the implementation of this MOA.

B. The Regional and Provincial Sustainable Livelihood Councils (R/PSLC) shall


be established to ensure that the implementation of the project is in
accordance with this Regional MOA. Hereunder is the structure:

C. The Regional and Provincial Sustainable Livelihood Councils shall have the
following duties and responsibilities:

1. Ensure that the implementation is in accordance with the Regional


MOA, and other appropriate laws, policies, guidelines, guidance notes,
and advisories;
2. Ensure regular communication with the concerned PARTIES and other
stakeholders to ensure objectives are met and the implementation is
within the agreed timeline;
3. Ensure delivery of the required project outputs and reports (e.g. status
and accomplishment reports); and
4. Resolve policy issues, if any, in accordance with the Regional MOA of
this PROJECT.

The DSWD-FO 1 SLP, through the respective Partnership Officers, shall


serve as the Secretariat for this PROJECT.

ARTICLE VI
REPORTING OF ACCOMPLISHMENTS

Reporting of accomplishments under this Regional MOA and its partnership


projects shall use the agreed prescribed templates by both DSWD-FO 1 and DAR
R1 offices and may be reported as joint accomplishments under the same and
related convergence programs/ projects, the Philippine Development Plan,
Sustainable Development Goals, and the participating programs of the PARTIES.

ARTICLE VII
SUPPORT FROM OTHER PARTNERS

A. The PARTIES may partner with other potential government and/or private
sector partners, at the regional and provincial levels, who intend to support the
original partners on the PROJECT;

B. A Letter of Intent with corresponding commitments for the PROJECT by


potential partners may be submitted during the Regional and Provincial
Sustainable Livelihood Council meetings, and the proposed partnership may
be approved by the PARTIES or their designated representatives in said
meetings without the need to amend this Regional MOA; and

C. The duly approved partnership will become an integral part of this Regional
MOA.

ARTICLE VIII
VOLUNTARY COMMITMENT

This Memorandum of Agreement is a voluntary commitment between the parties,
and does not obligate the parties to engage solely with the other, nor restrict any
activity of each party to engage in partnership with other groups or agencies for
the delivery and/or implementation of social protection interventions. No party
shall have any right, power, or authority to create any obligation, express or
implied, for and on behalf of the other party.

ARTICLE IX
CONFIDENTIALITY AND DATA SHARING

In the performance of their obligations under this Regional MOA, the


PARTIES shall ensure the privacy and security of any confidential, privileged,
personal, and/or sensitive information that the PARTIES and their officers,
employees, or agents may have access to; and shall store, use, process, and dispose
of such information in accordance with R.A. No. 10173 or the "Data Privacy Act of
2012", its corresponding Implementing Rules and Regulations (IRR), and
applicable National Privacy Commission issuances. Any violation of this clause and
any of the provisions of the said law and issuances committed by the
aforementioned persons shall be subject to corresponding sanctions, penalties,
and/or fines under the said law without prejudice to any other applicable criminal
and/or civil liability. This clause shall survive the termination or expiration of this
Regional MOA. A separate Data Sharing Agreement (DSA) shall accompany this
Regional MOA in accordance with the Data Privacy Act of 2012 and its
corresponding implementing rules and regulations.

ARTICLE X
LIABILITIES

The DSWD-FO 1 and DAR R1 shall hold the other Party/ies and their
representatives entirely free and harmless from any liability, claim, loss, or damage
caused to any person or property arising from the performance of their obligations
under this MOA.

ARTICLE XI
GRIEVANCE REDRESS SYSTEM

To maximize their existing grievance redress systems, the DSWD-FO1 and DAR
R1 shall address grievances received concerning their respective office by
maximizing their own existing grievance redress system. Issues and concerns
involving both parties or the other party shall be discussed and resolved through
Sustainable Livelihood Council meetings.

ARTICLE XII
EFFECTIVITY

This MOA shall take effect immediately upon signing and shall continue to be in
force and effect until December 31, 2029. Existing activities will continue unless
modified or revoked for a cause or discontinued.

ARTICLE XIII
PRE-TERMINATION

The PARTIES reserves the right to terminate this Agreement before the end of the
effectivity period of this Regional MOA for breach of any provisions hereof by

serving written notice of termination at least one (1) month prior to the intended
termination date.

ARTICLE XIV
AMENDMENT

This Agreement may be modified or revised only by means of a written instrument


executed by and among the partners and signed by their respective duly
authorized representatives before the end of the Regional MOA’s effectivity.

ARTICLE XV
DISPUTE RESOLUTION

Upon request of the PARTIES, the PARTIES may opt for mediation and
conciliation to address any problems/disputes which may arise relative to the
implementation of this Regional MOA. If issues are not resolved, the same shall be
resolved in the manner prescribed under Chapter 14, Book IV of the Administrative
Code of 1987. This is nonetheless, without prejudice to the filing of appropriate
civil, administrative, and/or criminal actions against erring officers and employees.
