A Petition under Section 107 of Cr. P. C

The 1st party most respectfully begs to submit as follows —

1. That, the 1st party is permanent resident of above mention locality

and she is now temporary residing in a rented house situated at
Bongaigaon town , near Deputy Commissioner office .
2. That, the 1st party is working lady presently posted under a company
at B. R. P. L, Daligaon , B T R (Assam). She is fear, honest and law
abiding lady. On the other hand the 2nd party are cruel dirty persons
always creating panic and havoc in the their society breaking social
peace and tranquility.
3. That, the 1st party has already lodged on F I R and Ejahar at
Abhayapuri police station against the 2nd parties and on Mrimoy Das
 and as they have committed certain offences against the 1st party.
The 1st party lodged the said F I R and Ejahar on 11/08/2023 and
the same has been registered as Abhayapuri PS Case No. 361/ 2023
under section 417, 313, 493, and 34 of Indian penal code. The
opposite parties and said Mrimoy Das to get rid of police arrest are
trying to obtain pre-arrest Bail. The accused Mrimoy Das has already
filed a Bail application under section 438 of Cr. P. C to obtain
Anticipatory Bail before the Ld. Court of Additional District and
Session judge North Salmara, Abhayapuri, vide Mise criminal no.
104/2023 but, the Ld. Court was pleased to pass and order on
25/08/2023, rejection the said Bail petition of Mrimoy Das. The 1st
party has came to know from a reliable source that the opposite
parties and the main accused Mrimoy Das are going to file a pre
arrest Bail petition before the Honorable Guwahati High Court.
4. That, the opposite parties binge highly dissatisfy with the aforesaid
rejection of Bail are now threating the 1st party with dire
consequences of life. The opposite parties are threatening the 1st
party now and then and prasharaised her to withdraw or compromise
the Abhayapuri PS Case No. 361/2023, otherwise the opposite parties
will physically assault the 1st party.
5. That, on 02/09/2023. At about 8.30 P. M the 1st party went to
Abhayapuri market and when she was shopping at Devdaru
stationary
 near the Abhayapuri cinema hall, then the 1st party found
that the opposite parties are standing in the opposite road
side of the said shop . When the 1st party came out from
the shop and waiting for an E. Rickshaw, suddenly the
opposite parties came near the 1st party and rebuked her
with filthy and slang languages and told her to withdraw the
Abhayapuri PS Case no 361/2023 and threatened her by
telling that they have enough man and money power even
they have power to purchase to investigation officer of
aforesaid PS Case and they will make her (1st party)
disappear .
6. That , since 02/09/2023 the 1st party passing her days
under panic due to threating made by the 2nd party , her
life is not safe at this moment and she can not move outside
her house freely and for this reason she unable to do her
daily office works, shopping, marketing and etc.
7. That , the 2nd party at any moment cause injures to 1st
party and by any unlawful act of the 2nd party, there is
 every possibility of breach of social peace and tranquility of
the opposite parties to restrain the 2nd party from doing any

unlawful act , so the 2nd parties are required to bind with a

hard Bond .

It, is therefore, humbly pray that the Ld. Court pleased admit this petition
and draw a proceeding against the 2nd party under section 107 of Cr. P. C
and to restrain them from doing any act which may breach the social peace
and tranquility of the 1st party bind them with a hard Bond for at list one
year for the ends of justice.
