DEED OF RELEASE BY HEIRS OF DECEASED

The Deed of Release by Heirs of Deceased is made on the 17th

day of March 2023 at Bhayander (West), Dist. Thane.

BETWEEN

1. Mrs. Tasneem Y. Najmi, Aged 40 years, Indian Inhabitant, Residing

at – 401, Razia Heights, Near Unity Park, Mitha Nagar, Kondhwa

Khurd, VTC: Pune, Maharashtra - 411 048 ; (2) Mr. Abbas Yusuf

Najmi, Aged 23 years, Indian Inhabitant, Residing at – 401, Razia

Heights, Near Unity Park, Mitha Nagar, Kondhwa Khurd, VTC:

Pune, Maharashtra - 411 0481; (3) Master. Juzer Yusuf Najmi,

Aged 15 years through the natural/legal guardian Mrs. Tasneem Y.

Najmi Residing at - 401, Razia Heights, Near Unity Park, Mitha

Nagar, Kondhwa Khurd, VTC: Pune, Maharashtra - 411 048;

(hereinafter called the “RELEASORS” which expression shall unless

repugnant to the context thereof shall deem to include heirs,

executors, administrators and assigns) of The First Part.

AND

Mr. Murtaza Saifuddin Najmi, Aged 52 years, Indian Inhabitant,

Residing at – 5-175/12, Roo No. 2 A2, Adam Manzil, 2nd Floor,

Yendada, Mubarak Colony, Visakhapatnam (Rural), Gitam

Engg. College, Visakhapatnam, Andhra Pradesh – 530 045;,

(hereinafter called the “RELEASEE”, which expression shall unless

repugnant to the context thereof shall deem to include heirs,

executors, administrators and assigns) OF The Second Part.

WHEREAS MR. SAIFUDDIN NAJMUDDIN NAJMI is a lawful

owner of, using and occupying the Flat no. 101, admeasuring

about 210 sq.fts. (Built-up) equivalent to 19.52 Sq.mtrs (Built-

up) on the First floor of the building known as HUSAINI-

TAHERI CO-OP. HSG. SOC. LTD, (Shiv Dham) comprising

Old Survey no. 2 & 722 B, New Survey no. 370 & 371, Hissa no.

2 at Fakhri Colony, building no. 8/9, Church Road, Bhayander

(West), Thane-401101, Dist. Thane within the limits of Mira-

Bhayander Municipal Corporation in the registration sub

District of Thane (hereinafter referred to as “The Said Flat”).

AND WHEREAS MR. SAIFUDDIN NAJMUDDIN NAJMI have

been 100% shares in the said Flat and also a member of the society

and holding 5 (Five) Shares from 31 to 35 of Rs. 250/- in Husaini-

Taheri Co-Op. Hsg. Soc. Ltd bearing Share Certificate No. 07.

AND WHEREAS MR. SAIFUDDIN NAJMUDDIN NAJMI is the

father-in-law of the Releasor No. 1 & the Grand-father of the

Releasor no. 2 & 3 and the father of the Releasee No. 1.

AND WHEREAS MR. SAIFUDDIN NAJMUDDIN NAJMI died

intestate on 23/11/2009 and his wife namely MRS. JAINAB S.

NAZAMI died intestate on 22/07/2002 and one of their married son

YUSUF SAIFUDDIN NAJMI died on 25/08/2023 namely leaving

behind his following surviving legal heirs –

AND WHEREAS except the Releasors and the Releasee, and the

married son of the Deceased MR. SAIFUDDIN NAJMUDDIN

NAJMI namely Late Yusuf Saifuddin Najmi died on 25/08/2023,

there is/are no other legal heir/s of the Deceased MR. SAIFUDDIN

NAJMUDDIN NAJMI.

AND WHEREAS after demise of MR. SAIFUDDIN

NAJMUDDIN NAJMI, the Releasors and Releasee have inherited

and acquired 100% [admeasuring about 210 sq.fts. (Built-up)

equivalent to 19.52 Sq.mtrs (Built-up)] undivided shares and interest

of deceased member in the said Flat in equal ratio.

AND WHEREAS during lifetime of MR. SAIFUDDIN

NAJMUDDIN NAJMI, he had expressed his desire to bequeath

and/or transfer his 100% shares and interest in the said Flat to and in

favour of the Releasee and the Releasors are also aware of the same.

Therefore, The Releasors are ready and willing to release, relinquish,

transfer their 1/3 shares (each) out of 50% shares in 100% shares and

interest of deceased namely MR. SAIFUDDIN NAJMUDDIN

NAJMI i.e. [3.25 sq.mtrs (built-up)] each in Flat property i.e. Flat

no. 101, admeasuring about 210 sq.fts. (Built-up) equivalent to

19.52 Sq.mtrs (Built-up) on the First floor of the building known

as HUSAINI-TAHERI CO-OP. HSG. SOC. LTD, (Shiv Dham)

comprising Old Survey no. 2 & 722 B, New Survey no. 370 &

371, Hissa no. 2 at Fakhri Colony, building no. 8/9, Church

Road, Bhayander (West), Thane-401101, Dist. Thane within the

limits of Mira-Bhayander Municipal Corporation in the

registration sub District of Thane as being one of the legal heir of

the deceased in favour of Releasee and the Releasors have also

shown their readiness and willingness to execute necessary

documents by relinquishing their share and interest as a legal heir of

the deceased in the said Flat in favour of the Releasee.

AND WHEREAS without receiving any consideration or amount

from the Releasee, the Releasors has relinquished and released their

rights, share and interest to/in favour of Releasee which was

inherited and acquired as legal heir of the Deceased.

AND WHEREAS in respect of the share and interest of the

deceased members in said Flat, in order to make the Releasee owner

of thereof, the Releasors relinquishes and ceases to have any right,

title or interest therein.

Now These Deed/Indenture Witnesses:

1. Each Releasors have released, relinquished and transferred their 1/3

shares out of 50% shares and interests inherited from shares of the

deceased in Flat no. 101, admeasuring about 210 sq.fts. (Built-up)

equivalent to 19.52 Sq.mtrs (Built-up) on the First floor of the

building known as HUSAINI-TAHERI CO-OP. HSG. SOC.

LTD, (Shiv Dham) comprising Old Survey no. 2 & 722 B, New

Survey no. 370 & 371, Hissa no. 2 at Fakhri Colony, building no.

8/9, Church Road, Bhayander (West), Thane-401101, Dist.

Thane within the limits of Mira-Bhayander Municipal

Corporation in the registration sub District of Thane in favour of

the Releasee and entitles the Releasee to hold the same as one of the

owner thereof. And the Releasors do hereby declare that the releasee

shall become an owner of and entitle to share of the deceased in said

Flat.

2. That the Releasors, do hereby declare that the Releasee is entitled to

have his name incorporated as an one of the lawful owner of the said

Flat the records of the society by transferring 100% shares and

interest of the deceased in his name or in any other government and

semi government department. And the Releasors shall do every such

assurance or thing for further or more perfectly assuring shares and

interest of the deceased MR. SAIFUDDIN NAJMUDDIN NAJMI

released to the Releasee as may be reasonably required.

3. That the Releasors have voluntarily relinquished and released and

transferred their 50% shares and interests (Each Releasors have 1/3

share), being legal heirs of deceased in said Flat in favour of the

Releasee without consideration and any pressure, force, coercion,

under influence and threat from any person.

4. The Releasors hereby covenant to sign any other papers, writings,

documents brought by the Releasee herein concerning release,

relinquish and transfer of shares and interest of deceased in said Flat

premises and will always give due co-operation whenever required

concerning this.

5. The Releasors hereby covenant with the Releasee that, the Releasors

shall from time to time and at all times hereafter at the request and

cost of the Releasee do and execute or caused to be done or executed

all acts, deeds, matters, things and assurance and rights whatsoever

for the better and further more perfectly and absolutely releasing,

transferring right, Title, share and interest of the deceased member in

said flat and every part thereof vested in the Releasee.

6. The Releasors and the Releasee do hereby further confirm, covenant

and declare that they have entered into this Deed after going through

the terms, conditions and contents and with full knowledge and have

fully understood the same in letter and spirit.

7. That both the parties have read and understood the contents of the

said deed and signed/put the thumb impression on same.

8. Upon execution of the said deed, the Releasee shall become absolute

lawful owner of the said flat and entitle to become absolute member

of the society in respect of the said flat.

9. That all expenses pertaining to registration of the said deed shall be

borne by the RELEASEE alone.

SCHEDULE OF THE PROPERTY –

All That Piece and Parcel of 50% share and interest of Releasors

(Each Releasors have 1/3rd shares) i.e. 9.76 sq.meters inherited from

shares of the deceased out of total area admeasuring about 19.52

sq.meters (built-up) in Flat no. 101, admeasuring about 210 sq.fts.

(Built-up) equivalent to 19.52 Sq.mtrs (Built-up) on the First floor of

the building known as HUSAINI-TAHERI CO-OP. HSG. SOC.

LTD, (Shiv Dham) comprising Old Survey no. 2 & 722 B, New

Survey no. 370 & 371, Hissa no. 2 at Fakhri Colony, building no.

8/9, Church Road, Bhayander (West), Thane-401101, Dist. Thane

within the limits of Mira-Bhayander Municipal Corporation in the

registration sub District of Thane released, relinquished and

transferred in favour of the Releasee.

In Witness Whereof the parties hereto have executed these

instrument on the date, first hereinabove mentioned.
