APPLICATION UNDER SECTION 151 CPC

FOR INTERIM CUSTODY OF THE MINOR WITH
NIGHT STAY FOR THE OCCASIONAL HOLIDAYS
It is most respectfully submitted on behalf of the above-named
applicant, that this Honorable Court may kindly allow the instant
application and pass the order for Interim Custody of the minor from 29-
09-2023 to 05-10-2023 (including night stays), as the Wedding ceremony
of the Applicant’s brother (Meternal Uncle of Minor) is being arranged.
on 30th September Mehandi, , 2nd October Wedding & 4th October Valima
ceremony to be held. however, on 29.09.2023 Mayon and family
gathering will be arranged at the Applicant’s house therefore, the
applicant prays for interim custody of the minor as she is the only baby of
the applicant and he is the last maternal uncle who left for married and it
is last marriage of his family so Minor will be spend a memorable time
and enjoys the all events of Wedding.

It is worthwhile to mention it here that on Nikah of My brother

interim custody is allowed but Respondent didn’t give the custody to
beliff and made fake usual excuses that minor is ill. It is humble request to
this honourable court to allow Police aid of SHO saudabad so that
Respondent family will not create any hurdles and in past honourable
court knows that Respondent and her Family beaten the court beliff and
also applicants on various custody handover dates.

It is therefore, requested may kindly grant this application by allowing the

interim custody of the minor from 29.09.2023 till 05.010.2023 (including
night stays) to the Applicant because Applicant is ready to Pick & drop
the minor from school. Hence this application in the larger interests of
justice however, the applicant is ready to furnish P.R Bond or submit his
original CNIC for kind satisfaction of this Honorable Court.

AFFIDAVIT

I, Syed Muhammad Wastain Raza Zaidi S/o. Syed Khursheed

Amir Zaidi, Muslim, Adult, Resident of Karachi, do hereby state on Oath
as under:-

1. That I am the applicant in the above noted matter and deponent of

this affidavit as such fully aware to facts and contents of the same.
2. That the accompanying application for interim custody of the
minor on the occasion of the Nikah Ceremony is drafted and filed
by me which contents is absolutely true and correct and same may
be treated as part and parcel of this affidavit which I not repeat
here for the sake of brevity.
3. That I say that I am ready to furnish P.R Bond so also to submit
Original CNIC for kind satisfaction of this Honorable Court.
4. That until and unless my accompanying application is allowed, I
shall seriously be prejudiced and suffer irreparable loss.
5. That whatever stated above is true and correct to the best of my
knowledge and belief.
