CIRCULAR

SUBJECT : HEARING OF VERY URGENT MATTERS THROUGH


VIDEO CONFERENCING.

In continuation of this office circular dated 4 th April 2020


and in view of the direction received from central project coordinator,
Bombay High Court, in the wake of outbreak of Covid-19, the VC units
are already set up in City Civil Court, purely for the purpose of remand
and hearing in extremely urgent matters only between 12.00 pm to 02.00
p.m. on court working days.

In addition to the above facility, the Judicial Officer


assigned with duty to attend hearings of urgent matters may attend work
on V.C. from their official Desktop/Laptop or dedicated VC room and all
the Parties/Advocates may attend the matters by installing “Vidyo”
software on their Computer or Smart phone.

The Special Procedure/protocol for hearing exclusively


through Video Conferencing is annexed herewith as “Annexure-A”.

User manual for “Vidyo” software is published separately


on website of City Civil and Sessions Court, Mumbai.

ANNEXURE-A

THE SPECIAL PROCEDURE / ISNTRUCTIONS FOR REMOTE


HEARING THROUGH VIDEO CONFRENCING

1. Advocates willing to argue the matter as a remote hearing shall email


their application as per the circular dated 4 th April 2020(for the ready
reference the copy is annexed below) to the official email ID of concerned
Court Complex showing what is the extreme urgency for hearing not
exceeding more than 400 words, along with a duly signed soft copy only in
PDF format of the matter and undertaking that the Advocate will submit a
hard copy of the proceeding with the office of the concerned court
immediately after the lock down period. The application should be in one
volume of reasonable size (without images). Annexures are to be in
additional volumes and care should be taken to ensure that, the additional
volume digital files are not so large as cannot be transmitted efficiently.

2. Advocate who wish to mention urgent fresh matter before the VC


Court shall pay the requisite Court Fees online using the Government
Receipt Accounting System (GRAS) available at
https://gras.mahakosh.gov.in/echallan/ as per the regular method of the
City Civil Court, Mumbai.

3. Application(s) will not be taken up unless accompanied by the GRAS


Callan, Written undertaking, Vakalatnama for fresh matters and all
Annexures. Advocates shall mention their Bar Council
enrollment/registration number in the application and shall also attach a
soft copy of their Photo ID. So also unsigned/blank petitions/applications
will not be taken into consideration.

4. Permanent Registration number for fresh/new filling will be allotted


only after hard copy is submitted as per rule, once normal working is
restored.

5. In case of pending matters Advocate or party in person should


mention the court number, case number, Act and section of their
proceedings.
6. Advocates shall mention their Bar Council Enrollment Registration
number and phone number in the application and shall also attach a soft
copy of their Photo ID.

7. All applications shall be sent before 11.00 am on working days at


least one day in advance. Application received after the stipulated time
will not be responded to or placed before concerned judicial officers.

8. If the Judicial Officer allows the application for taking it up for the
hearing, the office shall communicate the date and time slot for hearing on
video conferencing and shall share the V.C., link and pin with Advocate
concerned on the same email-id. The said V.C. Link and pin shall be used
only for Video Conferencing of that particular case at the allotted date and
time. The Advocate concerned shall ensure that the V.C. Link and PIN are
not shared/forwarded except for notice to the opposite party’s Advocate,
The Applicant’s Advocate is required to give notice of the listing, serve a
soft copy of the application and share the V.C. Link and PIN provided with
Respondent/s.

9. Please ensure that camera is in a stable position and focused at your


eye level and there is sufficient light on you. Please don’t sit too far from
or too close to the camera. On the screen, the face should not be blurred
or dark but must be clearly identifiable.

10. To experience a good conference during multiparty hearing, please


maintain discipline by speaking one at a time. Please keep your
microphone muted and unmute it only when you speak. Only speaker’s
microphone should be unmuted at any given time.

11. Only the Advocate/duly authorized person shall address the Court
through V.C. The hosts and co-hosts are authorized to mute/unmute any of
the participants.

12. A Complaint in regard to the quality or audibility of feed, if any


shall be communicated on the Helpline No. 022-22842616 only during the
proceeding or immediately after its conclusion failing which no grievance
in regard to it shall be entertained thereafter.
13. All hearing conducted via Video Conferencing are being conducted
as if the Advocates are appearing before the court in person through V.C.
Therefore Advocates are reminded to comply with all court rules of Dress
and etiquette.

14. Person, whose presence is not necessary or those who disturb or


otherwise impede the smooth conduct or proceedings or violate the
etiquette will be removed without notice or warning. Persons removed
will not be able to re-join. No complaint will be entertained against
removal.

15. Recording/Copying/storing and/or broadcasting, by any means, of


the V.C. Court Proceeding/hearing in Video/audio and/or any other form is
strictly prohibited.
16. The word ‘Advocate’ wherever occurring in this protocol unless the
context otherwise requires, shall also include a Party-in-Person.

NOTICE

IT IS HEREBY NOTIFIED for the information of the Advocates

and the parties appearing in- person that from Tuesday 7th

April 2020, hearing of urgent matters if any per extant

assignment will be taken through Video Conferencing between

12:00 and 2:00 p.m. on the court working days. Advocates and

parties in person may mention urgent matters through the unit

installed in Computer Room, City Civil Court Mumbai (Fort, as

well as Dindoshi), as per the protocol annexed to this Notice.

PROCEDURE FOR HEARING THROUGH VIDEO CONFERENCING

1. The Judicial Officers concerned will take up mentioning/hearing


of extremely urgent matters through Video Conferencing
between 12 p.m. and 2.00 p.m. on the notified Court working
days.
2. The Advocate shall email the application for an urgent hearing
to ctcourt-mum@nic.infor Fort office and to
ctcivilcourtdinsc@indianjudiciary.gov.in for Dindoshi office.
Advocates shall mention their Bar Council
enrollment/registration number in the application and shall
also attach a soft copy of their Photo ID.
3. In case of pending matters Advocate or party in person should
mention the court number, case number, Act and section on
their proceedings and the nature of extreme urgency, not
exceeding more than 400 words, all fresh matters should
mention the same details as mentioned above excluding the
court no, and case number.
4. If the Judge allows the application, the Registry shall
communicate the date and time slot for hearing through Video
Conferencing to the Advocates concerned. On the date and at
the time specified the Advocates may make their application in
such urgent matters only through the VC unit installed in the
designated room in the Court premises.
5. Upon the registry specifying the date and time, the applicant’s
Advocate shall give notice of the listing and serve a soft copy
of the application on the Respondent/s.
