LETTER OF INDEMNITY (BANK GUARANTEE)

In consideration of you having executed at my/our request a Guarantee to:

(hereinafter referred to as “the Bank”)
To cover the due performance of

(hereinafter referred to as “the Contractor”)

In the sum of RM 11,500.00

(hereinafter referred to as “the Guaranteed Sum”)

(either) Pursuant to a Tender which is annexed as “Appendix A”

(or) Pursuant to a Contract which is annexed as “Appendix A”

I/We hereby jointly or severally undertake and covenant with you that:

1) In consideration of you having given such Indemnity or having entered into such Guarantee
as aforesaid I/We at all times hereafter keep you and your assigns and successors-in-title
indemnified against all actions proceedings liability claims damage costs and expenses in
relation to or arising out of the said Indemnity or Guarantee on your part contained in the
same.

2) You are at liberty without prior reference to me/us to pay what you say, in your absolute
discretion consider to be your liability under the said Indemnity or Guarantee.

3) A statement from you as to the amount or amounts of our liability to you under Clause 1
hereof shall be accepted by me/us as being final and conclusive evidence that such amount
or amounts are due by me/us. I/We will make payment thereof within seven (7) days of
receipt of a demand made by you for the same and until payment is made I/We will pay
interest thereon at 9% above prime rate calculated from the date of such demand.

4) My/Our liability hereunder is irrevocable and shall remain in full force or effect until your
liability under the said Indemnity or Guarantee is discharged and the same shall have been
returned to you for cancellation.

5) Nothing herein or in such Indemnity or Guarantee contained shall prejudice or affect any lien
to which you are by law entitled or any other security which you may at any time held from
me/us or the Contractor or on my/our or the Contractor’s account.

6) This Indemnity or Guarantee for the amount of the Guaranteed Sum shall not be determined
or in any way prejudiced by my/our death or retirement or the admission of myself/ourselves
or other person as partners, incorporation, amalgamation reconstruction rearrangement or
otherwise of any firm concern or company in which I/We are partners or shareholders but
shall inure and be available for all intents and purposes as if my/our heirs executors
administrators and successors in title or the resulting firm concern or company had been the
one whose obligations were originally secured.

7) Any demand hereunder may be effectually made by prior notice to me/us by any of your
officer or by notice in writing under the hand of any such officer either served personally on
me/us or left or sent by post to me/us at my/our usual or last known place of business or
address in Malaysia and any demand sent by post shall be deemed to have been served on
the day when in the ordinary course of post it would have been delivered.

8) You may enforce this Indemnity or Guarantee against me/us at any time jointly or severally
and you may for that purpose treat me/us as if I/We liable to you as your principal debtors.
