For the reasons stated in the accompanying affidavit, it is therefore

prayed that this Hon'ble Court may be pleased to issue an appropriate

writ, order, or direction, more particularly one in the nature of Writ of


Mandamus declaring the high handed action of 3 rd respondent in

collussion with Respondent No 4 in not considering the represetations

of the petitioner dated 10.01.2024 and 11.02.2024 and allwing the

respondent No 4 to construct her house with out leaving set back as per

rule 20 and also the 3 rd Respondent not taken any steps to demolishing

the unauathorised and illegal portion of building construction made by 4

th Respondent is illegal arbitary violation of the rule 33 of Andhra

pradesh Grama Panchyathi Land Development (Layout and Building)

Rules 2002 apart from contrary to Articles 14, 19, 21 constitution of

India and conssequently direct the 3 rd respondent to demolish un

authorised and illegal construction portion of Building situated in Sy No

775/12 in 2 nd Ward of Pathuru, Kaligiri village and Mandal, SPSR

District, and to pass such other order or orders as this Hon’ble Court

may deems fit just and proper in the circumstances of the case

inspite of my representations ,

AFFIDAVIT

I, 1. Vemuluri Venkateswarlu, S/o. Late Subbaraidu, Aged about 45 years, occ.

carpentor, R/o. D.No. 77, pathuru, Kaligiri Village and Mandal, SPSR Nellor District.,

now having temporarily come down to Amaravati, do hereby solemnly and sincerely

affirm and state as follows:

1. I submit that I am Petitioner herein and as such I am well acquainted with the

facts of the case.

2. I submit that aggrieved by high handed action of 3 rd respondent in

collussion with Respondent No 4 in not considering the represetations of the

petitioner dated 10.01.2024 and 11.02.2024 and allwing the respondent No 4 to


construct her house with out leaving set back as per rule 20 and also the 3 rd

Respondent not taken any steps to demolishing the unauathorised and illegal portion

of building construction made by 4 th Respondent is illegal arbitary violation of the

rule 33 of Andhra pradesh Grama Panchyathi Land Development (Layout and

Building) Rules 2002 apart from contrary to Articles 14, 19, 21 constitution of India

3. I submit that i acquired the schedule house property from my mother to an

extent of 217.8 square yards of site in Sy. No. 775/12 in plot no 9 situted in 2 nd

ward of Pathuru, Kaligiri village Panchayat, Kaligiri Mandal, SPSR Nellore District,

through a registered WILL deed vide 24 of 2012 dated 14.11.2012. consequent to

death of my mother in recent past I have paid all these taxes to the municipality

without any pendency. Presently I am living with our family and the same is in our

possession and enjoyment without any interruption for the last 50 years. 4. I

submit that my Mother executed a WILL deed dated 14.11.2012 the same was

registered vide document no 24 of 2012 on the file of SRO Vinjamuru. while so in

the recent past the 4 th respondent started prepared to construct his house without

leaving minimum setback space abutting to my house, when I questioned them,

they have informed that they have highly influence in the society and no need to

leave the set backs as per law. When I approached to the 3 rd respondent with

written representation dated 10.01.2024 , the panchyath secretary assured me to

stall the construction and informed me to take action against the 4 th respondent.

Further the 3 rd respondent informed me that the 4 th respondent shall have to

leave 4 feet of site in your side and the 3 rd respondent assured me to be asked her

to construct as per the Rule 20 of Andhra pradesh Grama Panchyathi Land

Development (Layout and Building) Rules 2002. Where in the 4 th respondetn would
have to leave more than 4 feet while she got constructing the house. But he did not

do so, and colluded with them and allowed to her to constructing illegally with out

leaving single foot from my house site causing inconveneace to my family and

speedly proceded for construction.

5. I submit that I revolved arounnd their office with my reprsentation dated

10.01.2024. since they did not taken action I made another represetation dated

11.02.2024. inspite of my representations , the 3 rd respondent did not looked in to

the issue correspondeing to the rule 20 of Andhra pradesh Grama Panchyathi Land

Development (Layout and Building) Rules 2002. Wherein it is categerically stated as

follows :

20. Permissible Height and setback requirements. - (1) The minimum open
spaces/setbacks (Open to sky) and height restrictions shall be as follows for
considering the building permissions in Minor Gram Panchayats;
(i) Height permissible: 9 meters or G + 2 floors in Gram
Khan tarn and 13 meters or G + 2 floors height in
Revenue survey number areas;
(ii) Setbacks:
In Gram Khantam:
Front setback or building line. 1.50 meters
Rear Setback: 1.00 meters
(iii) Where the lighting and ventilation of a building is
through the means of a chowk or inner courtyard,
such open space shall be open to sky and of area at
least 3.0 Sq. meters and no side less than 1.5 meters.
33. Offences and Penalties. - (1) Any person who contravenes
any of the provisions of these rules or any requirements or
obligations imposed on him by virtue of these rules shall be
guilty of an offence by the District Panchayat Officer shall be
punished with a fine as prescribed in these rules by the District
Panchayat Officer and in case of continuing offence a daily fine
until the contravention is made good or removed;
(i) take suitable actions including demolition of unauthorized
works;
(ii) take suitable action against technical personnel, which
include prosecution or debarring him from further practice
up to three years;
6. It is submitted that as seen from the above rules the 3 rd Respndent would have

to be take action againest the 4 th respondent as per rule 33 of Andhra pradesh

Grama Panchyathi Land Development (Layout and Building) Rules 2002. Further

more the 3 rd respondent is pressurised me to compramise with the 4 th respondent

and threatning for dire consequnces in future without following due process of law is

illegal and arbitrary. Hence the Writ Petition.

7. In the circumstances stated above, the petitioner has no efficacious

alternative remedy, except seeking the indulgence of this Hon’ble Court to exercise

the extraordinary original jurisdiction vested in this Hon’ble Court by virtue of Article

226 of the Constitution of India.

The petitioner has not filed any writ petition, suit or other proceedings for the

relief or relieves sought herein.

It is therefore prayed that this Hon'ble Court may be pleased to issue

an appropriate writ, order, or direction, more particularly one in the

nature of Writ of Mandamus declaring the high handed action of 3 rd

respondent in collussing with 4 th Respondent in not considering the

represetations of the petitioner dated 10.01.2024 and 11.02.2024 and

allwing the respondent No 4 to construct her house with out leaving set

back as per rule 20 and also the 3 rd Respondent not taken any steps to

demolishing the unauathorised and illegal portion of building

construction made by 4 th Respondent is illegal arbitary violation of the

21 constitution of India and conssequently direct the 3 rd respondent to

situated in Sy No 775/12 in 2 nd Ward of Pathuru, Kaligiri village and

Mandal, SPSR District, and to pass such other order or orders as this

Hon’ble Court may deems fit just and proper in the circumstances of the

case.

It is therefore Further Prayed that this Hon'ble Court may be pleased to directed

the 3 rd respondent to demolish un authorised and illegal construction portion of

Building belonging to 4 Respondent situated in Sy No 775/12 in 2 nd Ward of

Pathuru, Kaligiri village and Mandal, SPSR District pending disposal of main writ

petition and pass such other order or orders as this Hon’ble Court may deems fit just

and proper in the circumstances of the case.
