APPLICATION FOR CANCELLATION/ STAY OF


THE WARRANT OF ARREST AND COMPOUNDING
THE SAID MATTER.

MOST RESPECTFULLY SHOWETH

1. That a notice bearing no. 4294017 was issued


to the accused/ applicant today i.e. 30.03.2022
at 4 PM. The notice is herein annexed as
Annexure A1.
2. That the Accused/Applicant is the owner of the
vehicle bearing no. DL1CT5543 and is alleged to
commit an offense u/s 112/183 MV Act, 1988
i.e. over-speeding.
3. That the Applicant/ Accused is appearing
through his husband and through pleader as
the Applicant/ Accused is blessed with a baby
who is a toddler and as the immunity of the
baby is weak, the consulting doctor has advised
not to take the baby out in public and not to
keep the child alone, thus the
Applicant/Accused is not appeared before the
Hon’ble Court due to the aforesaid reason.
4. That due to the same reason the Applicant
failed to appear before the concerned authority
in the previous instances but now is appearing
through her husband and pleader.
5. That the non-appearance is neither deliberate
nor intentional and is appeared through her
husband and pleader.
6. That the said offense is of compounding one,
thus the Applicant seeks the leave of this
Hon’ble Court to compound the said matter and
the husband of the Applicant is ready to pay the
requisite penalty as per law before the Hon’ble
Court.
7. That the reason for default in the appearance of
Applicant/Accused before this Hon’ble Court is
neither deliberate nor wilful but only because of
the above mentioned reason.
8. That the Applicant/Accused has no past
antecedents regarding any violation of traffic
rules and law.
9. That the Hon’ble Court has the jurisdiction to
hear the present matter and no other
application is pending adjudication in any
Hon’ble Courts or Hon’ble High Courts
including the Hon’ble Supreme Court of India.
10. Thus this application.
PRAYER

It is most humbly prayed to this Hon’ble Court


that;
a. To pass an order to cancel/stay Warrant of
Arrest against the Applicant and allow to
appear through her husband and pleader;
b. To pass an order for compounding the said
matter and the husband shall pay the
requisite penalty as per the law.
c. Pass any such order(s) as the Hon’ble Court
deems fit in the interest of justice.
