MEMORANDUM OF AGREEMENT
ESTABLISHMENT OF LIVESTOCK AND POULTRY MULTIPLIER FARM IN VARIOUS
SITES
IN DAVAO DEL NORTE
Funded under the Department of Agriculture-Livestock Banner Program CY
2019

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (MOA), entered this _____________, at


Panabo City, Davao del Norte, by and between:

represented herein by its Governor, EDWIN I. JUBAHIB, pursuant to
EDWIN I. JUBAHIB

Sangguniang Panlalawigan Resolution No. ___, Series of 2021,


hereinafter referred to as “PLGU-DAVAO DEL NORTE”;

- And -

CITY OF PANABO, a Local Government Unit with office address at


New City Hall Compound, J.P Laurel, Panabo City, represented by its
City Mayor, JOSE E. RELAMPAGOS, pursuant to Sangguniang Panlungsod
Resolution No. ___, Series of 2021, now and hereinafter referred to as
“LGU PANABO CITY”.

W I T N E S S E T H:

WHEREAS, the Department of Agriculture (D.A.), through its


mandate under the Republic Act 8435 or the “Agriculture and Fisheries
Modernization Act (AFMA) of 1997” provides postharvest, infrastructure
and facilities to enable small farmers and fisher folks to have access
to provisions and technologies in order to improve the handling,
storage, processing and marketing of agricultural and fishery
products;

WHEREAS, pursuant to AFMA, the D.A. embraces food security,


poverty alleviation and social equity as among its guiding principles
and has considered the objectives of ensuring that the poorest sector

of society have equitable access to resources, income opportunities,


basic support services to improve their quality of life;

WHEREAS, the D.A. is implementing the Multiplier Farm Project


(MFP) to establish multiplier farms in strategic areas of the country
where deserving farmer recipients may avail animals like goats, native
chicken, ducks, rabbits, native pigs, sheep and honeybees for their
livelihood. Multiplier Farms (MFs) will enable farmers to access
free-source of poultry and livestock of excellent genetic profile and
engage in livelihood activities and augment their family income;

WHEREAS, Republic Act No. 7160 or the “Local Government Code of


1991” allows the Department of Agriculture (D.A.), a national agency,
to implement nationally funded projects jointly with Local Government
Units (LGUs);

WHEREAS, pursuant to the above mentioned law, LGU’s assume the


primary responsibility for the provision of basic agricultural support
services, infrastructures, extension and facilities and the
improvement of quality of life of their constituents;

WHEREAS, the Provincial Veterinary Office (PVO) of the Provincial


Local Government Unit of Davao del Norte is responsible for the
download and implementation of a fund amounting to Fifty Million Pesos
(PhP 50,000,000.00) from D.A. to be utilized in the establishment of
Livestock and Poultry Multiplier Farms in various sites in Davao del
Norte;

WHEREAS, the City Agriculturist’s Office and the City Veterinary


Office (CVO) of LGU PANABO CITY will be the implementing and
monitoring arm of the PLGU, through the PVO, and will assist in the
implementation of the project being a partner in promoting the

development of the livestock sector in the province given its
administrative and technical capabilities;

WHEREAS, PLGU-DAVAO DEL NORTE and LGU PANABO CITY are committed
to implement the project as set out in this MOA to ensure the success
and achieve the project’s desired goals and objectives;

WHEREAS, DA-RFO XI and PLGU-DAVAO DEL NORTE poses no objection to


the request of LGU PANABO CITY to avail the project;

NOW THEREFORE, for and in consideration of the mutual covenants


and premises hereinafter set forth, the parties hereto agree as
follows:

ARTICLE I
THE PROJECT

Under the project, the D.A. shall, in collaboration with PLGU-


DAVAO DEL NORTE, through the PVO, shall equitably establish livestock
and poultry Multiplier Farms (MFs) in an all MLGU/CLGU of DAVAO DEL
NORTE. Goat and native chicken shall be initially bred and produce in
the said production facility. The offspring of these animals shall
then be distributed to deserving and qualified farmers as a livelihood
starter as source of income and food.

ARTICLE II
RESPONSIBILITIES AND OBLIGATIONS OF THE PARTIES

Section 1. PLGU-DAVAO DEL NORTE, through the PVO, shall:

a) Validate the project sites of LGU PANABO CITY to be used for


the project and assess the feasibility of the proposed MF;

b) Allocate equitably the Php 50,000,000.00 transferred fund

from D.A. to PLGU and subsequently to LGU PANABO CITY in the

amount of Php 3,500,000.00 per LGU with the following


components as infrastructure: goat house and chicken pens,
breeder animals (goat and chicken), farm equipment
(incubator and generator), fencing, agricultural supplies
(feeds), drugs and biologics, pasture and forage development
and labor and wages for care taker, fuel, training,
representation and contingency for the project;

c) Take charge in the procurement, disbursement and liquidation


of the said initiative fund in accordance to government
rules and regulations and Republic Act 9184 and its
Implementing Rules and Regulation;

d) In partnership with LGU PANABO CITY, shall regularly keep


track of the progress of the project and for this purpose,
shall from time to time send its Project Monitoring Team
(PVO Staff) for field visits and inspection;

e) Execute a Memorandum of Agreement (MOA) between PLGU and LGU


PANABO CITY as a recipient prior to turn-over of the project
to ensure commitment of LGU PANABO CITY;

f) Provide technical assistance to LGU PANABO CITY as needed in


various aspects of implementation, management and operation;

g) Non-performance of LGU PANABO CITY will be used as basis for

their exclusions in future Livestock Program Projects or be


excluded as qualified recipients;

h) In cases of mortalities of breeder stocks (goat and chicken)


in the MF, the PVO shall prepare the Necropsy Reports
especially for LGUs that do not have registered
veterinarians, while other requirements will be complied by
the recipient LGU through its CAGRO, MAGRO and CVO as
stipulated in Article 2 Section 2 par. K of this MOA.

Section 2. LGU PANABO CITY shall:

a.) Submit to PLGU-PVO all the documents required for the


execution of this agreement including Sangguniang
Panglungsod Resolution authorizing the Local Chief
Executive to enter and sign a MOA for the establishment of
Multiplier Farm, Letter of Intent, Project Proposal and the
name and qualification of the proposed manager of the MF;

b.) Provide an area suitable for the MF located in a


strategic place, accessible to people and shall have full
accountability to the problem or issue arising to it;

c.) Furnish land title or a Deed of Usufruct containing not


less than 25 years or any legal document that would show
entitlement to the use of the site for MF and intended

development;

d.) Operate, manage, and supervise the MF that will be the


source of quality goat and chicken stocks and show
competence and readiness to sustain and operate a livestock
and poultry production facility and be able to prove that
the MF would benefit livestock and poultry farmers in the
locality;

e.) Provide optimum nutrition and health care to the animals


and yearly financial allocation for pasture and forage
materials, feeds, veterinary drugs, biologics, utilities
and other needs for the maintenance of MF including
manpower, labor and supervision for the day to day
operations of MF especially when the allocated budget have
already been utilized;

f.) Shoulder the cost outside the support of DA-RFO XI for the
project;

g.) Comply with the terms that the MF shall be the source of
quality foundation stocks in putting up other multiplier
farm modules;

h.) Ensure the utilization of the project in accordance to its


intended use and shall not in any way sell, lease or
mortgage the same;

i.) Shoulder all taxes, fees and other government impositions


on the project;

j.) Maintain Records for the MF and provide reports to PLGU and

information;

k.) Report on mortalities shall be properly accounted for and
requirements for relief of accountabilities shall be
immediately complied in compliance to Commission on Audit
Circular 92-386;

l.) Identify the farmer-beneficiaries or recipients of the


project and submit the same to PLGU-DAVAO DEL NORTE;

m.) Acknowledge the receipt of the animals and facilitate the


signing of contract of the farmer-beneficiaries or
recipients; and

n.) Provide administrative and management mechanism necessary


for the sustainability of the project;

ARTICLE III
Monitoring, Evaluation and Reporting

a.) LGU PANABO CITY shall comply with the procedures and
guidelines for monitoring and reporting as prescribed by
PLGU and DA-RFO XI;
b.)PLGU-DAVAO DEL NORTE, through the PVO, shall undertake
monitoring and evaluation of the performance of LGU PANABO
CITY in carrying out the tasks, responsibilities and
obligations set forth in this Agreement;
c.)Quarterly accomplishment report on the project shall be

submitted by LGU PANABO CITY to PLGU-DAVAO DEL NORTE;


d.)In the event that the performance of MLGU/CLGU LGU PANABO
CITY fall short of the agreed objectives, PLGU-DAVAO DEL
NORTE shall notify the DA-RFO XI in writing the reason for
the violations without prejudice to all legal remedies
available to DA-RFO XI;
e.)Ensure unimpeded access by the D.A. and PLGU to the
PROJECT, documents, and other relevant information in
monitoring and evaluating the progress of the PROJECT;

f.)Submit pre, during, and post-project implementation


digital photos/videos of site works accomplishments and
ensure that the above-mentioned requirements are
implemented according to the plan, programs and priorities
of the DA;

g.)Submit monthly report on the status/progress of the Project


to DA- RFU X1- Livestock Division; and

h.)Notify DA-RFO X1 in writing of any changes, delay or any


concern relating to the complete and effective implementation
of the identified projects;

ARTICLE IV
EFFECTIVITY AND TERMINATION

This agreement shall take effect upon signing by the parties and
shall remain valid and binding for One (1) year or until the
completion of the project unless rescinded by the parties by giving
sixty (60) days advance written notice.

Any breach or violation by a party of its obligations under this


MOA shall entitle the other party to immediately rescind, cancel or
terminate this Agreement by giving the party guilty of breach/
violation written notice to that effect, without prejudice to the
right of the aggrieved party to require the payment of damages
resulting from the breach.

ARTICLE V
MODIFICATIONS OR AMENDMENTS

No modifications or amendments to this agreement and the approved


project documents shall be allowed without the written consent of both
parties involved. All amendment/s that will be appended to this
agreement shall be in writing and must be delivered to the address of
the parties indicated herein.

IN WITNESS WHEREOF, the parties have hereunto affixed their
