PREFACE

I, the Chairman of the Committee on Subordinate Legislation, having been


authorized by the Committee, do hereby present on its behalf, this Two Hundred and
Forty-Eighth Report of the Committee.

2. A total of 522 Notifications containing Rules/Regulations, issued under


various provisions of Acts were laid on the Table of the Rajya Sabha during its
254th Session (19 th July – 11thAugust, 2021). There had been delay in laying of 72
Notifications, out of which, 29 Notifications were laid without any delay statement
from the concerned Minister giving reasons for the said delay. The Committee
considered these delays and submits this Report.

3. The Committee considered and adopted the draft 248th Report in its meeting
held on 16 th March, 2022.

4. The Committee’s observations/recommendations are printed in Chapter II


(paras 3 and 4) in the Report.

CHAPTER I

1. BACKGROUND

Rule 204 of the Rules of Procedure and Conduct of Business in the Council of
States (Rajya Sabha) provides that there shall be a Committee on Subordinate
Legislation to scrutinize and report to the Council whether the powers to make rules,
regulations, bye-laws, schemes or other statutory instruments conferred by the
Constitution or delegated by Parliament have been properly exercised within such
conferment or delegation, as the case may be.

1.2. Mandate

Legislations passed by the Parliament and subsequently enacted after being


assented to by the President of India, are implemented by the Executive i.e., various
Ministries/Departments of Government of India. It is a well recognized principle that
the laws enacted by Parliament cannot be exhaustive enough to visualize each and
every situation that may arise during the course of its implementation and to make
provisions for it in the Act in anticipation. The Central Acts, therefore, if
necessary, contain a provision authorizing the Government to frame detailed
rules/regulations, etc. to enable it to implement the provisions of the Act. These
rules/regulations framed in exercise of the powers conferred by an Act of Parliament
are termed as Subordinate Legislation.

Rule 209 of the Rules of Procedure and Conduct of Business in the Council of
States lays down that after each rule, regulation, bye-law, scheme or other statutory
instrument framed in pursuance of the Constitution/Act or the legislative functions
delegated by the Parliament to a subordinate authority and which is required to be laid
before Parliament, is so laid before the Council, the Committee shall, in particular
consider:

(i) Whether the Order is in accord with the provisions of the


Constitution/Act pursuant to which it is made;
(ii) Whether the Order contains matter which, in the opinion of the
Committee, should more properly be dealt within an Act of Parliament;
(iii) Whether the Order contains imposition of taxation;
(iv) Whether the Order directly or indirectly bars the jurisdiction of the
Courts;

(v) Whether the Order gives retrospective effect to any of the provisions
in respect of which the Constitution or the Act does not expressly give any
such power;
(vi) Whether the Order involves expenditure from the Consolidated Fund
of India or the public revenues;
(vii) Whether the Order appears to make some unusual or unexpected use
of the powers conferred by the Constitution or the Act pursuant to which it is
made;
(viii) Whether there appears to have been unjustifiable delay in its
publication or laying before Parliament; and
(ix) Whether for any reason, the form or purport of the order calls for any
elucidation.

1.3 Statutory Requirement for laying

The Committee on Subordinate Legislation, Rajya Sabha had, in its 10 th


Report presented to the House on the 24th May, 1971, inter-alia recommended, a
standard laying formula to be incorporated not only in new legislation but also in
existing Acts as and when Bills to amend them are brought before Parliament, which
is reproduced below:-
"Every rule made by the Central Government under this Act shall be laid, as
soon as may be after it is made, before each House of Parliament, while it is in
session, for a total period of thirty days which may be comprised in one
session or in two or more successive sessions, and if, before the expiry of the
session immediately following the session or the successive sessions
aforesaid, both Houses agree in making any modification to the rule or both
Houses agree that the rule should not be made, the rule shall thereafter have
effect only in such modified form or be of no effect, as the case may be; so,
however, that any such modification or annulment shall be without prejudice
to the validity of anything previously done under that rule.”

Now, all statutes contain the above cited provision for making
rules/regulations, for laying the same before both Houses of Parliament and for
amending or annulling the same.

1.4 Time limit for laying of rules/regulations

As per the recommendations contained in para 33 of the 1 st Report of the


Committee, all the Orders including rules etc., are required to be laid on the Table of
the House: -
(a) within a period of 15 days after their publication in the Gazette, if the
House is in session; and
(b) if the House is not in session, within a period of 15 days after the
commencement of the next session.

However, in case of notifications relating to a state under the President’s rule,
due to difficulties faced by certain Ministry, the Committee vide its recommendations
contained in its 6th Report (para 17-19) relaxed this time period to 30 days from the
date of publication of the rules, orders, notifications etc., in the State Gazette.

1.5 Motion for annulment or modification of rules/regulations laid on the


Table of the House

As per recommendations of the Committee contained in its 10th Report (cited


at para 1.3 ante), after the rules/regulations are laid on the Table of the House,
Members can move motion for modification or annulment of the rules/regulations.
The statutory period of laying of 30 days might be completed in one session or two or
more successive sessions. Further, as per the recommendation of the Committee
contained in its 75 th Report (Para 2.5), reproduced below:-

"The Committee agrees with the view of the Committee on Subordinate Legislation
Lok Sabha (Seventh Lok Sabha) expressed in its 20 th Report, that laying on the
Table of all Orders' in pursuance of powers delegated by Parliament is very
significant, as it affords an opportunity to Members of Parliament if they so desire
to move any amendment or modification to such 'order'; including a Motion for
their annulment.”

Hence, a reading of both these recommendations together indicates that


Members have a right to suggest/move motion for annulment/modifications in the
'Order' for a time period till one additional session immediately following the session
in which the period of 30 days is completed. If the modification or annulment is
carried by the Houses of Parliament, the rules/regulations stand annulled or modified
to the extent agreed to by the Houses of Parliament.

1.6 Role of the Committee on Subordinate Legislation, Rajya Sabha with


regard to unjustifiable delay in laying

One of the important functions of the Committee, according to Rule 209 (viii),
is to see whether there has been unjustifiable delay in the publication or laying of the
rules/regulations before the Parliament. The Committee monitors the laying of the
rules/regulations etc. on the Table of Rajya Sabha during its Session through its
Reports. This practice started with the 131st Report of the Committee on Statutory
Orders laid on the Table of the Rajya Sabha during its 190 th Session, presented to the
House on 15th December, 2000. During the meeting of the Committee held on 11 th
December, 2000, to adopt the said report, the Committee decided that henceforth, it
will regularly scrutinize the notifications laid on the Table of Rajya Sabha from

time to time and present a report to the Council in respect of each Session. This
practice has continued since then and the present report is in pursuance of the said
decision of the Committee.

CHAPTER II
LAYING OF STATUTORY ORDERS ON THE
TABLE OF RAJYA SABHA

During the 254th Session of the Rajya Sabha, (19 th July – 11 thAugust, 2021),
522 (Five Hundred Twenty-Two) Statutory Orders/Notifications relating to
Rules/Regulations/Schemes/Bye-laws etc., framed under the Constitution/Acts of
Parliament, were laid on the Table of the Council by various Ministries/Departments
of the Government of India. The details of the Gazette Notifications in which these
were published and the date of their laying on the Table of the Rajya Sabha have been
indicated Ministry-wise, in the Statement placed at Annexure.

2.1 While scrutinizing these Orders, the Committee noted that there has been a
marked improvement in the performance of the Ministries/Departments of the
Government of India, in so far as the timely laying of the Gazette Notifications
brought out by them, is concerned. The annexed statement also indicates the period of
delay in cases where Notifications have not been laid as per the time schedule
prescribed by the Committee. During the 254 th Session, out of 522 Notifications that
were laid on the Table of Rajya Sabha, 450 were laid within the stipulated time, and
72 Notifications were delayed. Further, out of these 72 delayed Notifications, 40
Notifications were delayed by a period of upto 1 year; 26 Notifications were delayed
by periods ranging between 1 year to 2 years; and 6 Notifications were delayed by
more than 2 years. The Committee, however, observes that 43 (59.72%) out of these
72 delayed Notifications, was accompanied by delay statement from the concerned
Minister and 29 (40.28%) Notifications did not have any delay statement from the
concerned Minister enclosed along with the Notifications. The bulk of delayed
Notifications were from the Ministry of Commerce and Industry (Department for
Promotion of Industry and Internal Trade) with 17 Notifications, which comes to
around 23.61% of the total delayed Notifications, and Ministry of Power (13 delayed
Notifications) which comes to 18% of the total delayed Notifications, some other
Ministries also had a large number of delayed Notifications e.g., Department of
Revenue (6 delayed Notifications); Ministry of Health and Family Welfare (6 delayed
Notifications); Ministry of Road Transport and Highways (6 delayed Notifications).
and Ministry of Home Affairs ( 5 delayed Notifications); Hence, the Committee has
examined these data in detail and important issues have been highlighted for guidance
of the Ministries/Departments for the future. The following are the Ministry-wise
details of the Notifications that were laid during the Session, which were delayed:-

2.2 The Ministry of Commerce and Industry (Department of Commerce) laid 24
Notifications during the Session. However, 2 Notifications have been delayed by
periods ranging from 6 months to 7 months and no delay statement was appended to
any of these delayed Notifications.

2.3 The Ministry of Commerce and Industry (Department for Promotion of


Industry and Internal Trade) laid 24 Notifications during the Session, out of which 17
Notifications were delayed by a period ranging from 7 to 17 months and were
accompanied by delay statement and the reasons given by the Ministry for the delay
are as under:-

2.4 The Ministry of Consumer Affairs, Food and Public Distribution(Department


of Consumer Affairs)laid 5 Notifications during the session, out of which one
Notification was delayed by 9 months and a delay statement was appended thereto.
The Ministry had cited the reason for the delay as under:-

"This is regarding laying of Central Orders viz. S.O. 3776 (E), dated
23.10.2020 issued under Section 3 of the Essential Commodities Act, 1955 regarding
imposition of stock limit on Onions.
Central Order S.O. 3776 (E) was issued on 23.10.2020 when the Parliament
was not in session. The Order was to be laid during Budget Session of 2021. Earlier,
the Budget Session of 2021 was scheduled between 29.01.2021 and 08.04.2021 but the
session was adjourned sine-die on 25.03.2021 much ahead of its April 9 scheduled
closure owing to the Assembly election in some of the States and one Union Territory.
There was also three weeks recess between first part and second part of Budget
Session. In view of sudden closure and availability of insufficient working days of
Parliament during Budget Session, this order could not be laid and hence the order is
now being proposed to be laid on Monsoon Session of the Parliament, 2021.
Therefore, Rajya Sabha Secretariat is requested to accept the order for laying
on the Table of the House."

b) (Department of Food and Public Distribution)

2.5 The Ministry of Consumer Affairs, Food and Public Distribution(Department
of Food and Public Distribution) laid 8 Notifications during the Session, out of which,
2 Notifications were delayed by periods ranging from 10 to 12 months and both were
accompanied with delay statements. The reasons given by the Ministry for the delay
are as under:-

"Notification No. G.S.R. 564 (E) dated 16.09.2020 and No. G.S.R. 496 (E)
dated 07.08.2020 regarding amendment in Sugar Development Fund (SDF) Rules,
1983 were required to be laid on the Table of both the Houses of Parliament.

The Notification No. G.S.R. 564 (E) dated 16.08.2020 was sent for laying to
Lok Sabha Secretariat vide letter No. 17-9/2020-SDF dated 20.09.2020 and to Rajya
Sabha Secretariat vide letter No. 17-9/2020-SDF dated 21.09.2020. Further, the
Notification No. G.S.R. 496 (E) dated 07.08.2020 was sent for laying to Lok Sabha
Secretariat vide letter No. 17-5/2020-SDF dated 20/09/2020 and to Rajya Sabha
Secretariat vide letter NO. 17-5/2020-SDF dated 21/09/2020.

It is pertinent to mention that the Parliament Session was earlier scheduled


from 14th September, 2020 to 1st October, 2020. However, the session was curtailed
due to Covid-19 and was adjourned sine-die on 23rd September, 2020.

The aforesaid notifications were laid on the Table of Lok Sabha on


02.02.2021. However, the aforesaid notifications could not be laid on the Table of
Rajya Sabha.

Thereafter, a 'Delay Statement' regarding laying of aforesaid notifications


before the Table of Rajya Sabha, was authenticated by Hon'be Minister of State for
Consumer Affairs, Food & Public Distribution and the same was forwarded, along
with the aforesaid notifications, to Rajya Sabha Secretariat vide Department's letter
No. 17-9/2020-SDF dated 15.03.2021.

However, the aforesaid notifications again could not be laid on the Table of
Rajya Sabha, as the session was curtailed due to Covid-19 and was adjourned sine-die
on 25.03.2021.

As the Two Hundred and Fifty Fourth session of Rajya SAbha and six session
of Seventeenth Lok Sabha have commenced from 19th July, 2021, the said notifications
are now laid on the Table of the Rajya Sabha."

2.6 The Ministry of Corporate Affairs laid 30 Notifications during the Session, out
of which, only 1 Notification which was delayed by huge period of 71 months and a
delay statement was also appended to it. The Ministry had cited the reason for delay as
under:-.

"The Notification regarding to the G.S.S. No. 692 (E) dated 09.09.2015 on the
Companies (Filing of Documents and Forms in Extensible Business Reporting
Language) Rules, 2015 was required to be laid before both the Houses of Parliament
during the Monsoon Session, 2021.
The above Notification G.S.R. No. 692 (E) dated 09.09.2015 on the Companies
(Filing of Documents and Forms in Extensible Business Reporting Language) Rules,
2015 was sent to Government Press for e-printing. The said notification could not be
laid before both the Houses of Parliament due to reason that the said notification was
voluminous, delay in printing and also there is change in work allocation of the
concerned officer, the same could not be laid. Hence, it may kindly be condoned."

"A Notification dated 26.08.2020 was issued by this Department in the Debts
Recovery Tribunal (Procedure) Rules, 1991 regarding change in working days of the

2. This Notification had to be laid before both the houses of Parliament as the
Notification was issued by this Department in exercise of powers conferred under
Section 36 (1) and (2) of the RDB Act, 1993 Section 36 (1) mentions the matters
regarding which the Central government has the powers to make rules.

3. Inadvertently, the same could not be placed before the Parliament so far due to
COVID-19 pandemic and shifting of the DRT Section from 03rd Floor of Jeevan Deep
Building, Sansad Marg to 01st Floor of the said building and mixing of files. Also, the
Section Officer of DRT Section was away on COVID Duty from 16.01.2021 to
10.03.2021 and prior to that most of the DRT Section was infected with COVID-19.

4. The Note was placed for laying the papers before both the houses of
Parliament on 26.03.2021 but by that time both the houses were adjourned sine die on
25.03.2021.

5. In view of above, the said notification could not be laid before the Rajya
Sabha. Delay in this regard is deeply regretted and may please be condoned."

2.11 The Department of Revenue, Ministry of Finance laid 164 Notifications, out

"The notifications upon their issuance are required to be placed before both

The Board (Central Board of Indirect Taxes and Customs) has issued

December, 2020] amending the Courier Imports and Exports (Electronic Declaration
and Procession) Regulation, 2010.

The earlier practice was to send as many as Notifications in the same session

before the 02 houses of Parliament in the next session.

This Notification could not be laid before the Rajya Sabha during the last
session as the house was in session for less than 30 days and the total sittings were
only 23. Since it has been administratively difficult to lay such Notifications which are
issued during any short session of the Rajya Sabha, the past practice has been to lay
the same in the next session. However, it is ensured that maximum number of
notifications issued during a session are laid during the same session.

The same are being tabled now during the monsoon session immediately after
the budget session."

As per the requirement of Sub-section 5 under Section 3 of the Passport (Entry

The authenticated copies of the above said notifications were sent for laying on
the Table of Rajya Sabha during the 251st session on 25.03.2020. However, due to
COVID-19 pandemic, the house was adjourned on 23.03.2020.

Due to Covid-19 pandemic, the situation remained grim in Delhi for several
months with minimal attendance in offices, travel restrictions, frequent closure of
offices for sanitization, and increased number of Covid-19 positive cases in the office
itself. Hence the above notifications could not be laid on the Table of Rajya Sabha
during the 252 nd Session in 2020 (14.09.2020 – 23.09.2020).

The notifications were sent again on 22.03.2021 for laying on the Table of
Rajya Sabha in the second part of Budget Session (session no. 253). However, due to
COVID-19 pandemic, the house was adjourned on 25.03.2021.

Hence, the notifications are being sent for laying on the Table of Rajya Sabha

on 18th November, 2019 has published/notified following three ordinances in the
gazette:

i. Ordinance 7 of 2019: Recruitment rules for the post of campus Director.

3. OBSERVATIONS OF THE COMMITTEE

3.1 The Committee observes that there has been delay in laying of
Notifications for periods ranges from 5 months to as much as 4 years and 4
months. The following data indicates the period of delays and the performance of

RECOMMENDATIONS/OBSERVATIONS

At the outset, the Committee would like to commend the


Ministries/Departments of the Government of India for putting in a good effort
in laying a total of 522 Notifications during the 254th (Monsoon) Session.
However, out of the Notifications laid, 72 Notifications were delayed and 37 of
them were delayed by a period of more than 11 months, some of which were
delayed by a period ranging from 2 years to 5 years, which is unreasonable and
need deeper introspection by the concerned Ministries/Department.

The Committee observes that 37 Notifications, which account for (51.4%)


of all the delayed Notifications were late by more than 11 months; 5
Notifications, which come to (6.94%) of all the delayed Notifications, were late by
10 months; 6 Notifications (8.33%) were late by 9 months; 2 Notifications (2.8%)
were late by 8 months; 12 Notifications (16.7%) were late by 7 months; and 10
Notifications (13.9%) were late by 6 months. This shows that though most of the
Ministries/Departments have put in a good effort, more needs to be done to
obviate delay in placing these Notifications on the Table of Rajya Sabha.

The Committee observes that some of the Ministries, which had multiple
delayed Notifications, e.g., Ministry of Commerce and Industry (Department for
Promotion of Industry and Internal Trade); Ministry of Finance (Department of
Revenue); Ministry of Health and Family Welfare; Ministry of Home Affairs;
Ministry of Power; and Ministry of Road Transport and Highways etc. need to
review the procedure followed by them for laying of their Gazette Notifications
and if necessary, issue instructions to all their Departments
and subordinate/attached offices/organizations, impressing upon them the
importance of laying all notifications within the stipulated time and if there is any
delay, then to attach a delay statement, explaining cogent reasons for the delay
and to take steps to obviate such delays in future. The Committee, after
considering the above data, makes the following recommendations and directs
that these recommendations may be circulated to all the Ministries/Departments
for strict compliance. The Ministry of Parliamentary Affairs may take necessary
step to co-ordinate with other Ministries/Departments on this serious issue.

4. RECOMMENDATIONS OF THE COMMITTEE

a) Delay in Laying of Orders/Rules/Regulations

4.1 The Committee notes that out of 72 delayed notifications laid by the
Ministries/Departments of Government of India, during the 254th Session of
Rajya Sabha, 10 Notifications were delayed by 6 months; 12 Notifications were
delayed by 7 months; 2 Notifications were delayed by 8 months; 6 Notifications
were delayed by 9 months; 5 Notifications were delayed by 10 months; and 37
Notifications by 11 months and 34 Notifications were delayed by one year or
more. The Committee would like to draw the attention of few Ministries, which
laid large number of Notifications on the Table of Rajya Sabha after a
considerable delay e.g., Commerce and Industry (Department for Promotion of
Industry and Internal Trade) – 17 Notifications delayed out of a total of 24
Notifications and 11 Notifications were delayed for more than 11 months;
Environment, Forest and Climate Change – 4 Notifications delayed out of a total
of 13 and all of these Notifications were delayed by periods between 2 years and
5 month to 3 years and 4 months; Health and Family Welfare – 6 Notifications
were delayed, out of a total of 11 Notifications and 3 Notifications were
delayed by periods ranging from 10 months to 2 years and 1 month; Home
Affairs – 5 Notifications were delayed, out of a total of 9 Notifications and all 5
Notifications were delayed by 17 months each; and Power – 13 Notifications were
delayed, out of a total of 19 Notifications and these were delayed by periods
ranging from 6 months to 18 months. The Committee, once again, impresses
upon all Ministries/Departments in general and specifically those mentioned
above, to avoid such delays in the future. The Committee feels that such delays
are totally avoidable and in violation of its recommendations contained in its
131st Report wherein it had recommended:-

“Orders required to be laid before the House should be laid (i) if the House
is not in Session, during the Session immediately following the date of publication
of the Order in the Official Gazette and (ii) if the House is in Session, on the date
of the publication of the Order, during its continuance and in case the time lag
between the date of publication and the date of the closing of the Session is less
than 15 clear days, before the expiry of the Session immediately following the
said Session. All the Ministries/Departments of Government of India should
henceforth comply with this schedule in the matter of laying of the Orders issued
under various Acts of Parliament on the Table of the Rajya Sabha.”

The Committee, while reiterating its above recommendations, once again


recommends that the Ministries of Commerce and Industry (Department for
Promotion of Industry and Internal Trade); Environment, Forest and Climate
Change; Health and Family Welfare; Home Affairs; Power; and Road Transport

and Highways should ensure that all its notifications are laid on the Table of
Rajya Sabha within the prescribed time of 15 days.

b) Non-attachment of ‘Delay Statements’ to the delayed Notifications laid

4.2 The Committee feels that the most disconcerting point is that 29
Notifications, out of a total 72 delayed Notifications, were laid during this
Session, without any delay statement appended to them, which goes against the
recommendation of the Committee contained in its earlier Report (135 th Report)
reproduced below:-

“The Committee has, time and again, emphasized that it is essential that in
case there is a delay in the laying of Statutory Orders, the concerned
Ministry/Department should invariably append a delay statement along with the
Notifications being laid so as to apprise the Parliament of the causes of delay. The
Committee desires all Ministries/Departments to take a note of this, since the
intention is that through the process of formulation of a delay statement, the
Ministry is able to introspect, identify bottlenecks and devise remedial
measures”.

The Committee recommends that all the Ministries/Departments must


adhere to the time schedule for laying of Notifications as prescribed in
Committee’s 131st Report and in case, the delay in laying of Notifications is
unavoidable, the Ministry should attach a delay statement from their Minister
citing cogent reasons for the delay. The delay statement gives an opportunity, to
the Ministry to clarify the reasons for the delay in laying of the Notification but
also a reason for the Ministry/Department to introspect and improve their
functioning. In case this longstanding recommendation of the Committee is not
followed, then the accountability of the Ministries to the Parliament and the
Constitutional Mandate of the Parliament to monitor the functioning of the
Executive would become a futile exercise and the Committee has every right to
take this matter very seriously.

c) Format of Delay Statements

4.3 The Committee observes that many of the Ministries/Departments, whose


Notifications were delayed, has not made any sincere effort to identify the
reasons for the delay in laying them by citing reasons like "curtailment/sudden
closure of Session, due to Covid pandemic, sine-die adjournment", "due to
voluminous notification and delay in printing", "change in work allocation of
officers, intermittent transfer of staff/officer, shifting of section" etc. The
Committee, therefore, strongly recommends that the Ministries/Departments
should cite cogent, logical and self explanatory reasons for the delay in the laying
of Notifications so that accountability of the Ministries/Departments to the
Parliament is maintained in its true letter and spirit and to ensure that, it does
remain a mere formality. The Committee recommends that all the

Ministries/Departments should put in more effort to ensure timely delivery of
these Notifications and also to follow the guidelines issued by the Table Office,
Rajya Sabha Secretariat to all the Ministries/Departments of Government of
India on the eve of each Session, so as to avoid such difficulties and also to
facilitate the laying of Gazette Notifications on the Table of Rajya Sabha
smoothly. The Committee would also like to re-iterate its earlier
recommendations contained in para 2(xii) of its 189 th Report, which is
reproduced below:-

“The Committee is not happy at the casual manner in which the


Ministries have treated its recommendations with regard to the delay in the
laying of the Notifications despite the Committee’s reiteration in all its reports.
The Committee takes serious note of the fact that, in most cases, the Ministries
fail to append delay statements explaining the reasons for the delay. Therefore,
the Committee reiterates, that the Ministries should take proactive measures so
as to avoid any delay, whatsoever, in the laying of the Notifications and that the
Committee is unable to accept the flimsy grounds given by the Ministries
regarding the reasons for delay.”

The Committee, therefore, recommends these Ministries/Departments to


not only ensure timely laying of Notifications but also follow the practice of
enclosing a delay statement in case(s) of delays.

d) Need for proper Gazette Notification Numbering (G.S.R./S.O. No.) and


nomenclature in Short Titles

The Committee notes that many of the Gazette Notifications were


published without their unique G.S.R./S.O. Nos. and the file numbers have
been used as Notification numbers, which is against the guidelines issued by the
Government of India in this regard. Further, few Notifications regarding
amendments to rules/regulations have been notified with proper nomenclature in
the short title e.g., 1 st amendment or 2nd amendment etc. has not been indicated
in the short title thereby resulting in the same title in subsequent amendments to
the rules/regulations. The Committee, therefore, recommends that:-

i. All Gazette Notification must have a unique G.S.R./S.O./S.R.O.


number and giving file number as Gazette Notification
numbers must be discontinued;
ii. The short title of amendments to rules/regulations etc. must
indicate whether the amendment is 1st or 2nd or so on for easy
identification.

e) EARLIER IMPORTANT RECOMMENDATIONS OF THE COMMITTEE
ON SUBORDINATELEGISLATION, RAJYA SABHA

4.4 The Committee in its earlier recommendations, for strict compliance by all the
Ministries/Departments of the Government of India, had stated that:-

Formula for laying of Statutory Rules

The Committee approve the following draft revised formula for laying of
Statutory Rules before both Houses of Parliament which the Ministry of Law and
Justice propose to incorporate in all future legislation which provide for making
of rules by the Central Government:—

"Every rule made by the Central Government under this Act shall be
laid, as soon as may be after it is made, before each House of Parliament,
while it is in session, for a total period of thirty days which may be
comprised in one session or in two or more successive sessions, and if, before
the expiry of the session immediately following the session or the successive
sessions aforesaid, both Houses agree in making any modification in the rule
or both Houses agree that the rule should not be made, the rule shall
thereafter have effect only in such modified form or be of no effect, as the
case may be; so, however that any such modification or annulment shall be
without prejudice to the validity of anything previously done under that
rule."

The Committee recommends that the revised formula should be


incorporated not only in new legislation but also in the existing Acts as and when
Bills to amend them are brought before Parliament. The Ministry should also
incorporate the new formula in the Bills pending before Parliament. This will, in
the opinion of the Committee, bring about uniformity in the matter expeditiously.

Incorporating corrections and amendments in the order

“The Committee desires that for the convenience of the public and
Members, Ministries should henceforth send copies of 'order' duly authenticated
by the Ministers concerned, incorporating therein all the corrections and

amendments issued till date of laying such 'orders' instead of laying the
uncorrected copy along with corrigenda. The Committee feels that to obviate any
legal or technical difficulty, Ministries should examine whether there is any
necessity of assigning a separate G.S.R. No. to a corrigendum at the time of its
publication in the Gazette and whether such a corrigendum should not be
published without assigning any G.S.R. No. The Committee would, therefore, like
to impress upon all Ministries of the Government of India that the present
practice of laying the rules without incorporating corrigenda in the body of the
rules is not a healthy one. The Committee hopes that the Ministries will ensure
supply of only corrected copies of the rules for laying on the Table so that they
depict a true and correct picture and serve the desired purpose."

notification should be published/laid which does not carry a notification number.

reasons why they cannot make rules within the time limit and seek
extension of time for completing the rule-making process.”

“In addition to the concern expressed by the Committee over delay in


laying of Notifications on the Table of the House, the Committee also express
their deep concern over delay in framing of rules/regulations under different
Acts. The Committee in its 47th report presented to the House on 14.9.1981 has

recommended that the rule-making process should be completed within a period
of six months of the coming into force of an Act. The Committee has further
recommended that in case a Ministry is not able to adhere to this time limit, it
should seek extension of time for completing the rule-making process. The
recommendation of the committee reads as follows:-

“The Committee feels that the rule-making process could well have been
completed within the time limit of six months which the Committee has laid down
for making of rules under an Act after coming into force of that Act. Where
however, a Ministry does not find it possible to adhere to the time limit, they
should inform the Committee of the reasons why they cannot make rules within
the time limit and seek extension of time for completing the rule-making
process.”

The Committee is constrained to take note of the fact that the


Ministries/Departments of Government of India are not complying with the
Committee’s recommendation to complete the process of framing of subordinate
legislation contemplated under various Acts of Parliament within a period of six
months. At the same time, the Committee also does not receive requests for
extension of time for completing the rule-making process in terms of its
recommendations as above from most of the Ministries/Departments. The
Committee takes a serious note of the prevailing situation in which the
Ministries/Departments are neither able to complete the task of framing
rules/regulations under different Acts within the given six months’ period nor do
they suo-motu approach the Committee for seeking extension of time. The
Committee further notes that in order to ensure timely framing of
rules/regulations it has taken an initiative to monitor the progress of framing of
subordinate legislation in respect of all legislations brought about by different
Ministries/Departments of Government of India from the year 2003 onwards
with a view to ensure that the framing of subordinate legislation is not delayed.
The Committee, however, finds that the responses from the
Ministries/Departments have not been prompt in this monitoring exercise
undertaken on behalf of the Committee.

In view of the above position, the Committee once again reiterates its
recommendation that the Ministries/Departments should ensure putting in place
subordinate legislation positively within a period of six months of coming into
force of the Act. The Committee further recommends that in case the Ministry
fails to meet with this deadline, they should invariably approach the Committee
for seeking extension of time. The Committee further recommends that in cases
where the time limit of six months is not adhered to, they should, while laying
rules/regulations before the Parliament invariably lay a statement explaining the
reasons why the framing of rules/regulations was delayed beyond six months so

as to keep the Parliament apprised of the compliance of the Parliament’s
mandate conferred upon the Executive.”

The Committee observes that the whole process of enacting laws is


defeated if rules are not framed and laid on the Table of the House in time. A
reasonable delay could be understood but unjustifiably long delays should be
avoided and the Ministries should work towards improving this position. The
Committee hopes that Ministry would strive to keep the delay to the minimum
and take care that Notifications are laid on the Table of the House at the first
available opportunity after publication of Notifications.

The Committee would like to impress upon the Ministry that it is their
responsibility to ensure that copies of the Notifications are printed timely and for
this purpose, they need to evolve a suitable mechanism to ensure that
notifications are laid in time. The Committee is happy that the Ministry has
evolved an internal mechanism/ procedure for this purpose. The Committee
hopes that it would take action accordingly in order to comply with the
prescribed schedule in the matter of laying of statutory Notifications.

The Ministry must take appropriate step to remove lacuna, if any,


administrative or otherwise, causing such long delay by being little proactive and
prompt. Further, the Ministries should take it up with the Ministry of Urban
Development for late receiving of printed copies of the Notification.

Uploading Notifications on websites

Rules/Regulations/Orders/bye-laws are laid by different Ministries on the


Table of the House under various provisions of parent Acts passed by
Parliament. These Rules/ Regulations/Orders/bye-laws are published in the
official Gazette before being laid on the Table of the House. Even after they are
laid, it is very difficult to get access to these Notifications. The Committee
recommends that such Rules/Regulations/Orders, etc. laid on the Table of the
House should be invariably uploaded on the websites of respective Ministries
immediately on the same day when they have been laid on the Table of the House,
for information of Members of Parliament and people at large for their easy
access.

“The Committee is not inclined to accept the late availability of printed


copies of Notifications from the Government of India Press as the reason for
delay in laying of the Notifications. The Committee directs all the Ministries that

requisite number of copies in cyclostyled form for laying in the Parliament. The
