1. Instructions about signing and returning the contract


1.1 Who must sign this contract?
The student must sign this contract.
If you are under the age of 18 years, your parent or guardian must also sign the contract as
evidence that they give you their permission to enter into this contract with UP.
If you are married in community of property, your spouse must also sign the contract.
If you are under the age of 25 years, the University requires a deed of surety to be signed by a
parent, guardian, or someone else. The surety takes responsibility for any overdue debt arising
from this contract. If a bursar is funding your studies, the University will still require a suretyship
by a person other than the person or entity who gave you the bursary.

1.2 How to sign the contract


The student:
• must use the Print/View PDF option – to review the completed contract.
• must print the contract.
• must initial each page in the space provided at the bottom of the page of the printed contract.
A witness must watch the student initial each page, and the witness must also initial each
page.
• must complete section 9 and sign in full; this must be done together with the relevant parties
mentioned in section 9.
• must scan and upload the contract via the UP-Student portal.

2. About this contract


This contract, the student application form and the module registration form make up the agreement
between the student ("you") and the University of Pretoria ("UPOnline" or "us" or "we" or "the
University").
The provisions of this contract are incorporated by reference into the module registration form, and it
must be read with the module registration form.
This contract takes effect when the student registers for the first time on UPOnline and is renewed
annually when the student registers again.

3. The University's responsibility to you


3.1 To provide high-quality education.

The University will take all reasonable steps to provide high-quality online teaching and learning.
The University will provide the support you need to complete the module on time. However, it
remains the responsibility of the student to comply with all the necessary deadlines and study
requirements.
The University will provide you with access to UPOnline Services and learning materials (refer to
point 5.5 for exclusions) required for your module.
The University will ensure that all module content remains relevant and has industry application.
Therefore, the contents of the module may change from time to time.
The University has a dedicated team of UPOnline support services staff. Note, however, that these
individuals may not be available outside of business hours.
The University reserves the right to cancel a module, and, in the event of such a cancellation, you
will receive a refund of the module tuition fees. For instance, the University may cancel a module if
there is insufficient demand for that module.
3.2 To look after your online safety.
The University will, to the best of its abilities, look after your online safety and the online safety of all
students, staff, or other individuals when they are using UPOnline services.
The University will monitor your use and other users' use of UPOnline services to ensure all users
are safe. The University also monitors UPOnline services to detect students falling behind in the
module.
If a person's online behaviour is dangerous or abusive to others or to you, the University will take the
necessary steps to address the situation. This can include the University removing the person from
the online module and alerting the relevant authorities.
3.3 To protect your personal information.
The University respects your personal information. We explain how we collect, use, and protect your
personal information in the student privacy notice. Please read this carefully.
We cannot guarantee that our security systems cannot be breached. You must notify us immediately
of any suspicious activity on your account.

4. The limits of the University's responsibility


The University will not be held liable for any loss that you may suffer as a result of your registration
for or participation in any module. The University will not accept any liability for loss that you may
suffer due to the use of UPOnline's services or unauthorised access to your account or computer
equipment.
You will indemnify and hold us harmless for any claim a third party might bring against us arising
from your registration for or participation in any module.
From time to time, UPOnline may be inaccessible because of one or more of the following reasons:
• maintenance procedures, downtime, or repairs;
• equipment malfunction or faults;
• causes beyond our control.
Any interruption of the UPOnline services will not be a breach of the agreement.

5. The student's responsibilities


5.1 You must follow the University of Pretoria's rules.
In this contract, we will refer to the University's policies, rules and regulations as "the rules".
The rules are published in the University Yearbook under General Rules and Regulations and the
rules of specific Faculties, on the University's website, on other official communication channels (e.g.
ClickUP, online notice boards, email notifications) or may be communicated to you by the University'
s employees when you make use of UPOnline services.
The rules may change from time to time. You must make sure that you understand and follow the
latest rules that apply to you.
If this contract contradicts the rules, the rules will apply.
Not complying with the rules may lead to disciplinary action, including expulsion from the online
module/programme and further legal action (e.g. a claim for damages or criminal proceedings, or
both).
5.2 You must make sure your fees are paid on time.
You must pay your module fees and any other fees before or on the start date of the registered
module. If you fail to pay on time, you will lose access to the UPOnline module.
You are responsible for making sure that the fees are paid, even if your fees are paid by someone
else (e.g. a sponsor or bursar).
5.3 You must provide accurate information.
You must provide accurate and complete information to the University. You must not make any
misleading or false representations, for instance, during the registration process.
The University has the right to independently verify the information you give us.
If you provide inaccurate, false, incomplete or misleading information, the Universtiy may cancel your
registration immediately.
You must ensure that you update the personal information which the University has about you as
soon as it changes.
You must regularly check the information the University has about you to ensure it is still accurate.
The student is responsible for submitting assessments on time and according to the minimum
requirements if the student hopes to complete the module on time.
5.4 You must assign your intellectual property to the University of Pretoria.
A By signing this contract, you assign all intellectual property rights in any work you create during your
studies or using UPOnline services and resources to the University.
B The intellectual property includes assignments, assessments, scripts, personal class notes,
summaries, posters, presentations, transcripts, recordings, software, hardware, data or databases,
or any other work you created, adapted, or amended.
C You are not entitled to distribute any module content or notes made during the module without the
University's written permission.
D The intellectual property in these works belongs to the University. You may not share or allow others
to copy or distribute these works or infringe the University's intellectual property rights.
E These clauses will apply unless the University has agreed in writing, that the intellectual property
rights may be shared or transferred.

F You must avoid infringing on the intellectual property rights of others, including third parties. You are
responsible for obtaining permission to use, share or copy the work where necessary. You must take
care to avoid committing plagiarism and must acknowledge the work or ideas of others.
This clause applies to all material made available to you to study.

5.5 You must provide your equipment, software and internet connection.

You must provide your own computer equipment. The University will not provide you with a computer
or the hardware required for an internet connection.

You must provide your own internet connection and data.

You may need software to browse the internet.

5.6 You must protect your online profile.

You must keep your login details confidential.

You must contact us immediately if someone else uses your login details.

6. Module cancellation
You can cancel your registration for an online module, in writing, within ten days after the module'
s start date. Your student account will be credited with the full module fee.
If you cancel the module after the 10th day after the start of the module, you will forfeit the module
fees.
You must send a cancellation request via email to uponline@up.ac.za.

7. Entire Agreement

The contract and all rules of the University comprise the entire agreement between the student
and the University.

8. Complaints
You are encouraged to directly approach the online module facilitator and staff regarding
academic issues.
If you want to complain about a module, our conduct or service offering, you must follow the
complaints procedure.
