COMPROMISE/ SETTLEMENT DEED

THIS COMPROMISE DEED IS MADE AND EXECUTED AT


DELHI ON THIS 2nd, FEBRUARY, 2023.

BETWEEN

ABHI PANDEY, S/O. SUNIL PANDEY, AGED 25 Yrs.,


R/O. MAJHGAONWA, JAGATBELA, MAJHGAONWA,

(HEREINAFTER CALLED THE FIRST PARTY/
COMPLAINANT)
AND

MANISH PANDEY, S/O SH. ___________________, AGED 22

First Party and Second Party shall be hereinafter collectively be
referred to as “PARTIES”

WHEREAS the First Party is Complainant in the FIR No.


0002/2023, Dated 12.01.2024, U/s 323/325/34/506 IPC, P.S Bhonga

and Charge sheet/Challan is yet to be filed before the Hon’ble Trial
Court.

WHEREAS the Second Party are Accused persons in the


FIR No. 0002/2023, Dated 12.01.2024, U/s 323/325/34/506 IPC, P.S
DLF, District Bhonga and Charge sheet/Challan is yet to be filed
before the Hon’ble Trial Court.

AND WHEREAS due to temperamental differences and


indifferent attitudes arose between both the parties; the First Party
registered a Complaint against the Second Party which led to
registration of FIR No. 0002/2023, Dated 12.01.2024, U/s
323/325/34/506 IPC, P.S Bhonga against the Second Party, that both
the Parties have compromised-cum-settled in the FIR No. 0002/2023,
Dated 12.01.2024, U/s 323/325/34/506 IPC, P.S Bhonga, by mutual
consent.

AND WHEREAS as efforts and attempts were made by the


friends and elders as well as the respectable people of the society
thereby clarifying all the bonafide mistakes, misunderstandings
between the Parties. The Parties has thus agreed to settle the matter
amicably on the basis of compromise-cum-settlement deed on the
following terms and conditions: -

1. That both the Parties have settled all their disputes, claims,
grievances and differences with each other with certain terms
and conditions. That the Parties have further agreed that they

shall not file any type of case/complaint against each other
before any court of law and police authorities after execution of
this present compromise-cum-settlement deed.

2. That the First Party acknowledges the settlement of all claims


against the Second Party for a consolidated compensation
amount of Rs. 70,000/- (Rupees Seventy Thousand Only). That
both the Parties mutually agreed that this sum will be paid to the
First Party through a Bank Transfer, NEFT/RTGS/UPI mode,
into the designated bank account of the First Party at the time of
executing this compromise deed.

3. That the Parties shall be bound with the terms and conditions of
the present compromise-cum-settlement deed/MOU and shall
cooperate each other in filing of the
Affidavit/Compounding/Quashing of FIR before the appropriate
forum.

4. That after receiving the total amount of Rs. 70,000/- (Rupees


Seventy Thousand Only) by the First Party from the Second
Party as well as after the filing of

Affidavit/Compounding/Quashing of FIR before the appropriate
forum, the First Party undertake not to file any type of case
either civil or criminal or any type of complaint before any court
of law/authority/police station in any circumstances, in future.
Simultaneously, the Second Party undertakes not to file any type
of case against the First party case either civil or criminal or any
type of complaint.

5. That upon the First Party receiving the sum of Rs. 70,000/-
(Rupees Seventy Thousand Only) from the Second Party, it is
expressly agreed between the Parties that if the First Party
neglects to provide assistance to the Second Party in the filing of
an Affidavit/Compounding/Quashing of FIR before the
appropriate forum, the sum of Rs. 70,000/- (Rupees Seventy
Thousand Only) shall be deemed forfeited and promptly
refunded to the Second Party.

6. That the Parties hereby agree that in case of


breach/violation/willful/deliberate disobedience of the present
compromise-cum-settlement deed, the Party breaching the terms
shall be liable for contempt proceedings.

7. That as per the terms and conditions of the present compromise-


cum-settlement deed the Parties undertakes that after execution
of the present compromise-cum-settlement deed and after the
filing of Affidavit/Compounding/Quashing of FIR before the
appropriate forum, the Parties will not contact each other in any
manner like WhatsApp, e-mail, telephone and any other

electronic mode etc., and/or never contact or try meet their
family members, relatives and friends in future for any purposes
whatsoever.

8. That the Parties have entered into and executed this Compromise
deed/MOU without any coercion, undue influence and with their
own free will and desire. The Parties have decided to end all
their disputes fully and to live peacefully.

AND WHEREAS the Parties have executed this


Compromise-cum-Settlement Deed after understanding the
contents of the same in vernacular voluntarily and without
pressure, threat or coercion in the presence of their Parents,
relatives and witnesses.

AND WHEREAS any Complaint by the Parties against


each other shall stand withdrawn, cancelled and revoked finally
after signing of this mutual compromise deed.

AND WHEREAS the present FIR


Compounding/Quashing Compromise Deed is irrevocable and
violation of any of the terms of this compromise deed shall be
deemed to be violation of the compromise deed.

AND WHEREAS, both the parties shall be bound with


the terms and conditions of this Compromise Deed and shall not
challenge the terms and conditions of the Compromise Deed in
any court of law or Authority.
