RE: EMPLOYMENT CONTRACT

We are pleased to inform you that Xerode Civil & Building Contractors Ltd is willing to offer you employment on
the following terms and conditions of service.

1. Duties
a. Your Job title shall be a ______________________________. A job description detailing your duties
and responsibilities will be provided by your foreman. However, your duties and /or job title may be
changed from time to time at management discretion. In this event, you will be advised in writing of your
revised terms.
b. You will initially be based at The Lot 1 Project KM40 but you may be deployed to work in other areas at
the discretion of the company.
c. Subject to acceptance of this offer, you shall be given induction training and orientation to ensure that
you understand your duties, rights and responsibilities.

2. Commencement and duration:


The effective date of this employment contract is 1ST MAY 2024 and shall be in force for one(1) month
ending on 31ST MAY 2024 subject to availability of work. Renewal or extension of contract shall purely be
on the basis of your performance and availability of work to be done.

You shall be paid on a daily rate basis at the rate of KES _______________. The company offers
accommodation and transport to and from site.

3. Termination of Employment:
Either party wishing to terminate this contract will give the other 1 day written notice or payment in
lieu of similar notice. Alternatively, the contract shall be deemed as terminated upon expiry of the
contract period, with none of the parties having any contractual obligation beyond the natural expiry.

4. Standard Working Hours and Overtime:


You are required to work for 45 hours a week spread out from Monday through Saturday. However, given
the nature of your position, you may occasionally be required to work extra hours and even on public
holidays. Overtime so worked shall be payable at a rate of __________ per extra hour worked .

5. Health and Safety:


a. You shall report any injury at all in the course of work to your immediate supervisor and immediately it
occurs.
b. To ensure your health and safety, you will be issued with personal protective equipment (PPE) as per
the Company PPE list. It is an offence to refuse, neglect and/or fail to wear uniforms and PPE, and in
the prescribed manner. Failure to do so will result in disciplinary action.
c. It’s your obligation to advice on any injury/illness that you may have incurred prior to employment with
the
Company.
d. By appending your signature on this contract, you accept to a bind by all company Health and safety
rules, regulations and procedures including but not limited to accepting to be tested of alcoholic content
using the alcoblow gadget at any time during working hours. If the alcohol level is detected but reading
0.3 and below,
a warning letter shall be issued to you. Three such warnings shall result into termination of your
contract. Readings from 0.3 upwards shall be subjected to dismissal.

6. Sick leave
For cases where you are injured at the workplace or in the course of your work, you will be entitled to sick
leave as per the medical report recommendation and compensation in accordance with the Work Injury
Benefit Act 2007 (WIBA).

7. Union Membership and Industrial Action (strike)


There are set procedures laid down by the Ministry of Labour with regard to Industrial Action. If you take part
in any Strike of any type without following the procedures set down by the Ministry of Labour you will be
deemed to be striking illegally and will be liable to disciplinary action.
Union check off shall be effected if you subscribe to the union with recognition agreement. If you benefit from
the provisions of the CBA (including but not limited to medical allowance) while you are not a member of the
union, then agency fee shall be recovered from your pay.

8. Company Core Values - STEWARDSHIP


It is expected that you shall acquaint yourself with all company Values and uphold them at all time. These

to treat company property; both in your custody and in other peoples’ custody as your own property.

9. Confidential Matters:
You shall not, without the prior consent of the Company, disclose any of its secrets or any confidential
matters to anyone not authorized to receive them. If you are found to have divulged such confidential
material, you will be liable to summary dismissal

10. Standing Orders:


a. The Company Staff Regulations must be read in conjunction with this offer and shall form part of the
terms and conditions provided herein in writing. These regulations will be found in the HR office.
b. You are required to read the Company Staff Regulations or have someone explain them to you before
you accept this offer, and confirm your understanding thereof in writing.
c. It is your responsibility to regularly familiarize yourself with the Staff Regulations as these are routinely
updated.
d. You are required to read all standing instructions, circulars etc. That have been issued or shall be
issued from time to time by the Company. As applicable, these standing orders form part of your terms
and conditions of employment.

11. Acceptance:
If you wish to accept this offer and the terms and conditions attached thereto, please sign both copies, retain
one copy and give the other to the Company. The terms and conditions of employment offered herein are
personal and do not reflect or constitute a precedent for any other purpose.
