JUNIOR DRUG BUSTER

CONSTITUTION AND BY LAWS

PREAMBLE

We, the socio-problem conscious responsible Filipino youths,


embodying in us the spirit of dedication through service and direct
participation, aiming to educate the public and ourselves and be
harnessed as a ambassadors and evangelizers of bareness promulgate and
adopt this constitution.

ARTICLE I
NAME AND OFFICE

Section I. The organization shall be known by the name Junior Drug


Buster, or by its acronym JDB, and shall here be known as the
organization.

Section II. The organization offices shall be established by the respective


chapter organizers or pre-organizers and/or the regional executive
committee.
ARTICLE II
DECLARATION OF PRICIPLES

Section I. The organization recognizes the Philippine Constitution as the


supreme law of the land, and is therefore the basis of the framework of
the constitution.

Section II. The Junior Drug Buster adheres to the principles of dedication
through service and base participation by direct involvement as when
there is unity there is power.

Section III. The Junior Drug Buster recognizes the drug problem as a
national, societal, economic, environmental, cultural, and politician
dictator.

Section IV. The recognition of the problem through criticism alone would
only be right when an action to solve such is clearly manifested.

ARTICLE III
OBJECTIVES

Section I. The Junior Drug Buster aims to mobilize the youths as active
workers for the drug prevention and control by conductor’s symposium
for drug education and by actively participating in the activities of Anti-
Drug Abuse Council (ADAC) or Philippine Drug Enforcement Agency
(PDEA).

Section II. The Junior Drug Buster aims to inculcate a mentality concern
towards its members and the society as a whole by reaching out to
charitable institutions and assisting in their programs like holding of
sports fest aimed at directing their attention to useful activities and
avoiding drug addiction.

Section III. The Junior Drug Buster aims to jack up the consciousness
level of the public on the issue surrounding drug-related problems.

Section IV. The Junior Drug Buster practices and observed the Republic
Act no. 8049 otherwise known as the ‘ANTI HAZING LAW’ and its
salient provisions.

Section V. The Junior Drug Buster practices and observed the Republic
Act no. 9165 otherwise known as the ‘THE DANGEROUS DRUGS
ACT OF 1972’ and its salient provisions.
ARTICLE IV
MEMBERSHIP

Section I. Qualifications for membership are as follows:

a.) Any bonafide criminology student of University of


Mindanao in the current school year where he/she is
enrolled.

b.) The member has belief and commitment in the vision and
principle of the organization by involving themselves in
the organizational activities.

c.) All students who are at least second year can be applicants
for membership except graduating students.

Section II. Members shall undergo the following non-obligatory and/or


obligatory procedures for membership as may be agreed upon by the
Regional Executive Committee.

a.) Members shall be subjected to background investigation


to be done by Philippines Drug Enforcement Agency and
the Drug Abuse Prevention and Control.

b.) Applications for membership shall undergo orientation,


interview and physical and mental examination and shall
pass the same before they formally accepted.

c.) Renewal/evaluate of membership shall be mandatory to


each member every start of a semester by blue ribbon
committee.

ARTICLE V
RIGHTS AND PRIVILEGES

Section I. Every member shall enjoy his/her rights and privileges


embodied on the article of this constitution.

Section II. The rights and privileges of every member are.

a.) Participate in all activities of the organization.


b.) Be informed fully of all organizational matters.
c.) To vote and to be voted upon;
d.) Propose suggestions, comments and criticism which may
be viewed vial to the interest of the organization; and
e.) Approval any decisions and policies adopted by the
organization.

Section III. Other rights may be granted by the Regional Executive


Committee and other leading bodies, which shall not in any way be
contrary to the provision of the constitution.

ARTICLE VI
DUTIES AND OBLIGATIONS

Section I. It shall be the duty and obligation of every member to observe


the following:

a.) Attend and actively participate in the meetings, which


should be held every 1st Monday of the month. Activities
and implementation of projects and plans of the
organization

b.) Pay dues monthly;

c.) Actively recruit members;

d.) Abide the code of ethics and discipline set forth by the
regional executive committee and/or by the individual
executive committee;

e.) Take initiative by accepting new tasks and other works as


may be provided by the leading bodies; and

f.) Those members who have already a key position for the
other organization would not be qualified to hold a key
position in the JDB organization.
ARTICLE VII
ORGANIZATIONAL STRUCTURE

A. COUNCIL

Section I. The council shall be the highest policy making body. It shall
elect officers for the regional executive committee, amend and revise he
constitution upon the approval of the members, and shall determine the
activities and programs of the organization.

Section II. The council shall be composed of the following:


1. The head of the Philippine Drug Enforcement Agency
2. The head of the Drug Abuse Prevention and Control Council
3. The Regional Executive Committee officers and Special Committee
officers and the members of all duly accredited chapters.

Section III. The council shall convene once in every six (6) months or
what is being agreed upon by the council.

Section IV. A simple majority of the members of the council shall


constitute a quorum.

Section V. Consensus shall be the primary method for the decision


making in the event where voting is necessary.

Section VI. The decision of the council shall be taken by the simple
majority of the social quorum.
B. REGIONAL EXECUTIVE COMMITTEE

Section VII. The Regional Executive Committee shall be composed of


the Regional Chairperson, Vice Chairperson. Internal President, Internal
Vice-President, External President, External Vice-President, Secretary,
Treasurer, Auditor and Public Information Officer.

Section VIII The Regional Executive Committee shall be held


responsible and accountable for the overall implementation of the
programs adopted by the council.

Section IX. The functions of the Regional Executive Committee Officers:

A.) THE CHAIRPERSON

a.1 Shall be the head of the organization

a.2 Shall be responsible for the overall

operation of the organization

a.3 Shall represent the organization in external affairs.

a.4 Shall be convener of the regional executive committee

a.5 Shall be one of the official spokesperson for the organization.

B.) THE VICE-CHAIRPERSON INTERNAL

b.1 Shall assume the responsibilities of the chairperson in the latter’s


removal from office, death, resignations and/or incapacity to perform
his/her duties and responsibilities.

b.2 Shall perform other duties delegated by the council and/or the
Regional Executive Committee on the chairperson.

c.3 Coordinate to the chairperson in the internal day to day


accomplishment report.

C.) THE VICE-CHAIRPERSON EXTERNAL

c.1 Shall be the head of the external affairs and activities

c.2 Shall be responsible on the outside campus projects and programs


related to the drug abuse prevention and control.
c.3 Shall coordinate to the chairperson or internal President in the day to
day accomplishment report.

D.) SECRETARY

d.1 Shall be the chief operation officer of the organization.

d.2 Shall be responsible for the taking of the minutes of the meetings.

d.3 Shall keeps the documents and correspondence of the organization

F. )TREASURER

f.1 Shall be the financial custodian of the organization

f.2 Shall be responsible for keeping the financial records of the


organization.

f.3 Shall be responsible for the liquidation of any or all accounts and dues
of the organization.

G. )THE AUDITOR

g.1 shall be the official examiner of the records and audit the money of
the organization.

g.2 Shall perform other duties and responsibilities delegated by the


chairperson.

g.3 Shall see to it that all disbursement made by the treasurer are in order
and in general, make sure that all funds and prosperities under custody of
the treasurer are properly kept at all times.

H. )THE P.I.O

h.1 Shall take charge of giving proper and due publicity to all activities of
the organization.

h.2 Shall perform other duties and responsibilities delegated by the


chairperson.

C. SPECIAL COMMITTEE

Section X. The Regional special Committee shall be composed of the


regional heads of the intelligence and Surveillance, Information, Drug,
Education, Custodian of Property, Finance, Special Project and Programs
and Special Blue Ribbon Committee.
Section XI. The Regional Special Committee shall be responsible and
accountable for the over all implementation of activities, programs, and
projects given and adopted by the Council and Executive committee.

I. )THE INTELLIGENCE AND SURVEILLANCE HEAD

i.1 Shall be responsible for the surveillance and making of reports.

i.2 Shall be responsible for all reports passed by his fellow members in
the place to be searched.

i.3 Shall take a command from the regional executive committee about
the action and decided activities.

K. )THE DRUG EDUCATION HEAD

k.1 Shall be person in charge of disseminating information and likewise


give lectures about drugs.

k.2 Shall be the one responsible for the holding of seminars about the
important matter in drug prevention and control.

k.3 Shall be responsible for making, manufacturing and disseminating


reading materials to every member.

k.4 Shall conduct orientation regarding drug information.

k.5 Shall educate the new members about the organization.

L. )THE PROPERTY CUSTODIAN HEAD

l.1 Shall keep the records of the office equipment and other facilities of
the organization

l.2 Shall perform other duties and responsibilities given by the council
and chairperson.

M. )THE BLUE RIBBON COMMITTEE HEAD

m.1 Shall conduct investigation in any matters within the organization


likewise to orient neophytes, new recruit or any aspirants.

m.2 Shall responsible to conduct investigation to any regional executive


and special committee officers as well as the members who violates the
rules and regulations by this organization.
ARTICLE VIII

GROUNDS FOR DISCIPLINARY ACTION

Section I. Grounds for Removal of Officers for their position.

a. Officer may remove through impeachment, with two-third {2/3} voter


of present attendance to hold for that purpose.

Section II. Grounds for impeachment of Officers.

a. if the officer does not hold his position regularly and failure to perform
such responsibility assigned herein in Article 6 {Duties and Obligation}
of his constitution.

b. Failure to attend to two (2) consecutive meetings or a total of eight (8)


absences annually in other regular and emergency meeting without
justifiable reason as well as failure to attend to the internal and external
activities of the organization.

c. Any officer who in this possession found may drug paraphernalia or


using any prohibited drugs without proper prescription form the doctor.

d. Any officer who abuses his/her authority lie using the funds of the
organization as a result of his negligence in the performance of his duty.

e. if the officer ruined the reputation, dignity of the organization as a


result of his negligence in the performance of his duty.

Section 3. Suspension of Members

a.1 Verbal Warming for the first or second offense by the head of
Intelligence and Surveillance Committee or the head of the Blue Ribbon
Committee.

a.2 Memorandum order from the chairperson for the third and final
offence requiring the offender to accomplished a certain agreement as
agreed upon by both parties

B. Grounds for Suspension of Members

b.1 Any members who violates the rules and regulations of the JDB
office.

b.2 Any members who failed to attend three (3) consecutive meeting or a
total of ten (10) annually absences in both regular and emergency
meeting, without justifiable reason as well as failure to attend internal or
external activities of the organization.

b.3 Any members who failed to pay the monthly dues within two (2)
months or other payments as required and agreed upon majority of the
members.

Section 4. Expulsion of Officers and Members.

A. Procedure

a.1 The Blue Ribbon Committee and the Intelligence and


Surveillance Committee shall be responsible to conduct an
investigation determined whether there is a reasonable grounds
to expelled any officers or members of the organization.

a.2 The chairman of the Blue Ribbon Committee an intelligence


and Surveillance shall coordinate to the Regional Executive
Committee for proper immediate action.

B. Grounds

b.1 Any officers or members, who in his possession found any


drug paraphernalia or caught using any prohibited drugs without
proper prescription form the doctor.

b.2 Any officers or members who violently used the


Identification Card or the organization for their own interest that
will affect the good image, reputation of the organization.

ARTICLE IX

ELECTION

Section 1. The regular election of the Junior Drug Buster organization


officers shall be held annually every second Saturday of the month of
March.

Section 2. Election of officers shall be held at large. The term of office of


every officer shall be one (1) year starting from the date of the induction
of officers.

Section 3. No person shall be qualified for any electives position unless


he/she is recognized as regular member of JDB.
Section 4. In case of vacancy or permanent vacancy for election, those
officers who have already a key position are not qualified to be elected
such vacant position.

ARTICLE X

AMENDMENTS

Section 1. Any amendment or revision of this constitution and By-laws


may be proposed by the Regional Executive Committee by a 2/3 votes of
all its members or majority votes of members present in General
Assembly and its ratification. Provided, that such proposed amendments
or revision, shall be submitted in writing to the General Assembly for
consultation one (1) week before its ratification.

Section 2. No amendment or revision shall be made with one (1) year


following the ratification of the Constitution and By-Laws.
