1. Tính cấp thiết của đề tài

Con người vừa là mục tiêu, vừa là động lực cho sự phát triển xã hội, muốn phát triển xã hội
phải chăm lo nhân tố con người về thể chất và tinh thần, nhất là về học vấn, nhận thức về thế giới
xung quanh để họ có thể góp phần xây dựng và cải tạo xã hội. Bác Hồ đã từng nói: “Một dân tộc dốt
là một dân tộc yếu” bởi không có tri thức, hiểu biết về xã hội, tự nhiên và chính bản thân mình, con
người sẽ luôn lệ thuộc, bất lực trước những sức mạnh cản trở sự phát triển của dân tộc, đất nước
mình.
Cũng như các mối quan hệ xã hội khác, Giáo dục được điều chỉnh bởi nhiều công cụ khác
nhau. Trong đó, pháp luật và đạo đức là hai công cụ điều chỉnh quan trọng nhất. Cả hai công cụ này
đều có những ưu điểm cũng như hạn chế nhất định, song giữa chúng có mối quan hệ mật thiết qua lại,
bổ sung, hỗ trợ lẫn nhau. Do đó, trong quá trình điều chỉnh các Giáo dục cần phải có sự kết hợp chặt
chẽ, hài hòa giữa pháp luật và đạo đức để phát huy tối đa những ưu điểm, hạn chế nhược điểm của
chúng nhằm đạt được hiệu quả tốt nhất trong hoạt động quản lý xã hội.
Xã hội càng phát triển, pháp luật càng có vai trò to lớn trong việc điều chỉnh các mối quan hệ
xã hội, đặc biệt là các mối quan hệ có tính chất phức tạp. Đó là vì pháp luật được nhà nước ban hành
và đảm bảo bằng quyền lực, sức mạnh cưỡng chế của nhà nước. Thậm chí ngay cả các mối quan hệ
quốc tế hiện nay cũng đề cao vai trò, sự điều chỉnh của các quy phạm pháp luật. Có thể nói, pháp luật
là một công cụ điều chỉnh, quản lý xã hội quan trọng, không thể thiếu của bất kỳ một quốc gia nào
muốn xây dựng một nhà nước pháp quyền văn minh, tiến bộ nhằm đảm bảo sự ổn định và phát triển
của xã hội.
Tuy nhiên, pháp luật không phải là công cụ vạn năng có thể xác lập hay xóa bỏ một mối quan
hệ xã hội nào đó một cách duy ý chí. Cũng không phải tất cả các vấn đề của xã hội đều có thể giải
quyết bằng các quy định của pháp luật. Pháp luật của mỗi quốc gia hay quốc tế cũng đều phải dựa
trên các quy luật mang tính khách quan, theo sự vận động và phát triển của các mối quan hệ xã hội
nhằm điều chỉnh một cách phù hợp nhất. Đồng thời, cũng cần đến những công cụ, chuẩn mực điều
chỉnh xã hội khác như: đạo đức; phong tục, tập quán; tôn giáo… bổ sung. Việc quá đề cao hay xem
nhẹ pháp luật đều có thể gây ảnh hưởng tiêu cực đến việc quản lý, điều chỉnh các mối quan hệ xã hội,
đồng thời không phát huy được tối đa vai trò, giá trị của pháp luật.
Cùng với pháp luật, đạo đức cũng có vị trí, vai trò và giá trị xã hội hết sức quan trọng. Đặc biệt
là ở các quốc gia phương Đông như Việt Nam, Hàn Quốc, Trung Quốc… Những quốc gia chịu ảnh
hưởng nhiều của những giá trị đạo đức truyền thống. Tuy nhiên, trên thực tế có một thời gian dài do
nhận thức xã hội, vị trí, vai trò và giá trị xã hội của đạo đức chưa được nhận thức một cách đầy đủ và
đúng đắn. Ở Việt Nam, những giá trị to lớn của đạo đức truyền thống, thuần phong mỹ tục tốt đẹp
của quốc gia chưa được khai thác và sử dụng triệt để. Những ưu điểm của pháp luật và đạo đức
không được phát huy hết, đồng thời cũng không có sự bổ trợ qua lại giữa pháp luật và đạo đức trong
việc điều chỉnh các mối quan hệ xã hội nói chung, các quan hệ pháp luật Giáo dục phổ thông nói
riêng và tất nhiên, hiệu quả đạt được trong việc quản lý xã hội là chưa thực sự cao.
Hiện nay, nước ta đã nhận thức được vị trí, vai trò và giá trị xã hội của đạo đức, truyền thống và
đã có sự vận dụng mối quan hệ giữa pháp luật và đạo đức vào việc xây dựng các quy định của pháp
luật. Ở mỗi lĩnh vực, mối quan hệ giữa pháp luật và đạo đức cũng có sự biểu hiện khác nhau và cần
phải có sự áp dụng một cách linh hoạt, hài hòa để đạt được hiệu quả. Với việc nhận thức tầm quan
trọng của mối quan hệ giữa pháp luật và đạo đức trong việc xây dựng pháp luật, tầm quan trọng của
việc điều chỉnh các mối quan hệ xã hội trong Giáo dục đặc biệt là Giáo dục phổ thông, em đã chọn đề
tài: “PHÁP LUẬT VÀ ĐẠO ĐỨC

2. Đối tượng, mục đích nghiên cứu
Thông qua đề tài luận án này, em sẽ đi sâu nghiên cứu pháp luật, đạo đức, mối quan hệ giữa
pháp luật và đạo đức trong lĩnh vực Giáo dục phổ thông để nhằm đạt được những mục đích sau:
o Thứ nhất, nghiên cứu làm sáng tỏ vị trí, vai trò, giá trị của pháp luật, đạo đức và mối quan hệ
pháp luật và đạo đức trong Giáo dục phổ thông;
o Thứ hai, nghiên cứu để thấy được thực trạng của việc ứng dụng các khía cạnh trong Giáo dục
phổ thông tại Việt Nam;
o Thứ ba, kết hợp pháp luật và đạo đức để nâng cao hơn nữa hiệu quả của Giáo dục phổ thông
nước ta và kế thừa từ những nước có nền Giáo dục hàng đầu thế giới: Mỹ, Nhật, Đức, ...
