(Citizenship Amendment Act) CAA

The citizenship Amendment Act 2019 was passed by the Parliament of


India on 11th of December 2019 it amended the citizenship act 1955
by providing a pathway to Indian citizenship for persecuted religious
minority from Afghanistan Bangladesh and Pakistan who have arrived in
India by 2014. The Eligible minorities were stated as Hindu, Sikh,
Buddhist, Jains, Parsi or Christians.
(For the specified class of undocumented immigrants, the number of
years of residency has been relaxed from 11 years to five years).

The Bharatiya Janata Party (BJP) had promised in previous election


manifestos to offer Indian citizenship to members of persecuted religious
minorities who had migrated from neighbouring countries. Under the
2019 amendment, migrants who had entered India by 31 December
2014, and had suffered "religious persecution or fear of religious
persecution"

Many parties who are against of this law say that India is promising to
provide citizenship to the persecuted people of every religion from the
countries i mentioned about, but why were Muslims not included in this
law??? So my answer to this common argument by most of the
opposition party is Pakistan, Bangladesh and Afghanistan, which are
Islamic countries, are harassing and forcing the minorities to convert
their religion living in the country, who were a part of India before
partition, so isn't it India's right and duty to protect them?

And since Pakistan, Afghanistan and Bangladesh have Islam as their


state religion, it is therefore "unlikely" that Muslims would "face religious
persecution" there.
Certain Muslim groups, such as Shias and Ahmadis, have historically
faced persecution in these countries but to counter this statement i
would like to say that since India and Pakistan on August 14, 1947 was
primarily based on religious difference and then in 1971 Bangladesh was
formed from Pakistan (due to different Muslim sections) which is also a
Muslim country.
When two countries have already left India on name of religion, now if
the Muslims of these countries will also be given citizenship in India, then
why did India divide itself? And it is not like that India is not granting
citizenship to the Muslims of these countries of Couse they can still apply
the difference is the privilege minorities are receiving as they were the
residence of India before the partition therefore it’s the duty of India to
protect them.

MYTHS AND FACT ABOUT THIS ACT


1. CAA is targeted at taking away the citizenship of any Muslim in
India???? But the fact is CAA does not affect any existing citizen of any
religion in India.

2. CAA stops a Muslim of other country to enter the India???? but


actually the fact is CAA cannot stop Muslim of other countries to enter
the India as first of all India is a secular country and Muslims of other
country can still apply through the usual procedure and still get the
Indian citizenship.

3. CAA can deport Muslim illegal immigrants??? But the fact is CAA
cannot depot illegal Muslim immigrants but in actual any illegal
immigrant can be deported from India as per the foreign act of 1946.
NRC aims to identify undocumented immigrants residing in India,
irrespective of religion.
