earlier on Thursday, 19th February, 2015, because I have to
attend my brother’s engagement, something that I cannot afford
to miss. But I promise that I will finish my job early so that nothing
is left incomplete or unattended. And I also assure that I will
compensate this time by staying an hour extra on Friday,
Saturday and Monday so that there is no work loss to the
company.

The Local Government Code provides in Section 47 that

"Approval of Leaves of Absence. – (2) Leaves of absence of vice-governor or a city or municipal vice-
mayor shall be approved by the local chief executive concerned: Provided, That the leaves of
absence of the members of the sanggunian and its employees shall be approved by the vice-
governor or city or municipal vice-mayor concerned;" (emphasis mine).

However in our LGU leaves of absence of all employees including those under the Sanggunian are
approved by the Local Chief Executive. Is there no legal problem with this? Can the Vice-LCE claim the
authority to approve leaves of absence of employees under the Sanggunian as per above mentioned
provision of the LGC?
