University for short the NMC respondentNo2 has neither allowed

the petitionerCollegeto grantadmission to the MBBS students for the

Academic Year 20232024 nor any clarication has been givenby it to

the University thereby causing serious loss injury prejudice and

injustice to the petitionerCollegeinasmuch as it is an admitted fact

that the present petitioner

is a dulyrecognized
and registered
Institute

for the MBBS Course and is alreadyhaving two consecutiveMBBS

batches andis due for for 3rd batch 2nd renewalfor the

Academic
Year 20232024 and since the petitioneris fully entitled for

the relief grantedin the Public Notice dated 14072023 and thus

there is no reason or occasion for the respondentsto with

the petitionerand not to recognizethe present for the same

courses
and therefore the action of the respondentsis most illegal
arbitrary unjust and without jurisdiction and the same is nothing but

a
classic exampleof unjustifieddiscrimination and hence immediate

interference of this Honble Court is warranted

That under the above facts the presentpetitionis beingled on

the followinggrounds

GROUNDS

A BECAUSE the facts narrated herein above would clearly

indicate that there is clear discrimination on the part of the

J BECAUSE

the illegal arbitrary

and
discrimination is writ largefrom the impugned
action of the

respondents inasmuch as the other similarly situated

dated 14072023 in admittingthe MBBS studentswithout

any fresh inspection and without completing any

formalities petitionerhas been deprivedof the

benet of said Public Notice and thus has been deprived

BECAUSE it is an admitted position that the petitioneris

duly registered and recognizedcollege and is already

running with two batches of MBBS Courses and hence

there is ground why

no reason or as to
thepetitioner
cannot be grantedpermissionin terms of Public Notice

dated 14072023

BECAUSE a perusal letter dated 22052023 would show

that there are no deciencies visavis and

there is no deciency regardingclinical materials in the

deciency pointedout by the inspectionreportis that of the

factor that the collegeof the answering

BECAUSE it is an admitted fact that the University

No 5 has soughtclarication in the petitioners

matter with specic pointsand issues but the respondent

No 2 to 4 have decided to keep silent and thus the

conduct of said respondents gives a reasonable and

justiable reason and suspicionof malade onthe part of

the said respondents

BECAUSE even otherwise the NMC or any of its organ

and
has no rightor power to discriminate amongstthe colleges
inasmuch as every institutecollege under the

NMC norms has a right to be considered

forthe benet
