Dear Sirs, RE: Maintenance Dredging Works at Tok Bali Supply Base (“Supply Base”) Including Turning Basin and Navigation Channel (“Dredging Works”) Dredging Works Progress at Supply Base and Maintenance Time Off Request We are writing in reference to the above matter and your letters to us dated 11" February 2024 and 19" February 2024. 1. As you are aware, we do not bear any reciprocal contractual obligations with you, despite you being Cygnus Maritime Sdn Bhd’s ("Cygnus") appointed sub-contractor. Our contractual obligations are exclusively with Cygnus pursuant to the letter of award entered between us and Cygnus dated 7% December 2023 ("LOA"). Therefore, any of your concerns pertaining to the Dredging Works must be directed to Cygnus, and not us. 2, In any event and without prejudice to item 1 above, we categorically reject the accusations outlined in your aforesaid letters, as they lack substantiated evidence. 3, Additionally, it is important to highlight that although we do not have access to the specifics outlined in the sub-contract between you and Cygnus (if any), we have placed our trust in your expertise, as reflected in the technical proposal shared by you on 4 September 2023 and integrated by Cygnus in the said LOA, 4, Wealso note that you are now requesting maintenance time off. Our position is that any requests shall be made through Cygnus. However, we state that any time off should not affect the completion date stipulated in the aforesaid LOA for the Dredging Works. We trust that this clarifies our position regarding the contractual obligations and the allegations presented and that the above information adequately addresses the matter at hand.
