COMPLAINT AGAINST CHEQUE DISHONOUR

Complaint Under Section 138 and 142 of Negotiable Instrument Act,1881

Respectfully Showeth:-
1. That the accused issued one cheque bearing no. 567812 dated Jan 15, 2023 for a sum
of Rs. 50,000 drawn on for lawful valueable consideration in discharge of his liability in
favour of the complainant.
2. That the complainant presented the said cheque lastly on 20 Jan,2023 which was
returned unpaid by drawee Bank vide returning Memo dated 15, Jan 2023 for the
reasons `Insufficient Funds`. The said cheque was presented within its validity period
and stood dishonoured on presentation.
3. The complainant sent a notice through their lawyer on January 21, 2023, to the
accused's registered address via registered mail with a proof of delivery request
(UPC), demanding payment for dishonored checks within 15 days of receipt. The
notice was received by the accused on January 25, 2023. However, the
registered mail was returned as unclaimed, suggesting the accused intentionally
avoided receiving it. Nonetheless, the notice sent via UPC was successfully
delivered to the accused. The complaint includes a copy of the notice, postal
receipt, and envelope as evidence.
4. The accused person did not make the payment of the dishonored checks to the
complainant within the 15-day period as required by law, as demanded in the
notice.

6. That the accused has been found guilty of an offense under Section 138 of the
Negotiable Instrument Act, 1881, and is subject to punishment under Section 142
of the same Act.
it is therefore requested that the accused individual be prosecuted and punished in accordance
with the law as outlined in Section 142 of the Negotiable Instrument Act.
