1. Years of Past Experience required: The bidder must have experience for number of years as indicated above in
bid document (ending month of March prior to the bid opening) of providing similar type of services to any
Central / State Govt Organization / PSU / Public Listed Company. Copies of relevant contracts / orders to be
uploaded along with bid in support of having provided services during each of the Financial year.
2. Purchase preference to Micro and Small Enterprises (MSEs): Purchase preference will be given to MSEs as
defined in Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012 dated 23.03.2012 issued
by Ministry of Micro, Small and Medium Enterprises and its subsequent Orders/Notifications issued by concerned
Ministry. If the bidder wants to avail the Purchase preference for services, the bidder must be the Service
provider of the offered Service. Relevant documentary evidence in this regard shall be uploaded along with the
bid in respect of the offered service. If L-1 is not an MSE and MSE Service Provider (s) has/have quoted price
within L-1+ 15% of margin of purchase preference /price band defined in relevant policy, then 100% order
quantity will be awarded to such MSE bidder subject to acceptance of L1 bid price.
OM_No.1_4_2021_PPD_dated_18.05.2023 for compliance of Concurrent application of Public Procurement Policy
for Micro and Small Enterprises Order, 2012 and Public Procurement (Preference to Make in India) Order, 2017.
3. Estimated Bid Value indicated above is being declared solely for the purpose of guidance on EMD amount and
for determining the Eligibility Criteria related to Turn Over, Past Performance and Project / Past Experience etc.
This has no relevance or bearing on the price to be quoted by the bidders and is also not going to have any
impact on bid participation. Also this is not going to be used as a criteria in determining reasonableness of
quoted prices which would be determined by the buyer based on its own assessment of reasonableness and
based on competitive prices received in Bid / RA process.

Buyer Added Bid Specific Terms and Conditions/ े ता ारा जोड़ गई बड क वशेष शत

1. Generic

OPTION CLAUSE: The buyer can increase or decrease the contract quantity or contract duration up to 25
percent at the time of issue of the contract. However, once the contract is issued, contract quantity or
contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised
quantity or duration

2. Generic

1. The Seller shall not assign the Contract in whole or part without obtaining the prior written consent of
buyer.
2. The Seller shall not sub-contract the Contract in whole or part to any entity without obtaining the prior
written consent of buyer.
3. The Seller shall, notwithstanding the consent and assignment/sub-contract, remain jointly and severally
liable and responsible to buyer together with the assignee/ sub-contractor, for and in respect of the due
performance of the Contract and the Sellers obligations there under.

6. Buyer Added Bid Specific ATC

​ ATC

1. The contract is initially for a period of one year. The contract will be reviewed yearly, and may b
e extended for a further period, as deemed fit by the DOP. The requirement of security guards may
vary according to the need & may be reviewed/ reduced/enhanced as and when required.

2. The contract can be terminated before the expiry of contract period owing to deficiency in servic
e or substandard quality of service provided by the SECURITY AGENCY. Further, DOP reserves the ri
ght to terminate contract at any time by giving one month’s notice, without assigning any reason
whatsoever.

3. The selected SECURITY AGENCY shall not be allowed to transfer, assign, or sub-contract its right
s and liabilities under this contract to any other agency.

4. The selected SECURITY AGENCY shall obtain and produce licence under the “The Contract Labou
r (Regulation & Abolition) Act 1970” from the Labour department. The SECURITY AGENCY shall mai
ntain and if necessary submit to the DOP, for inspection on demand, the records such as Muster rol
l, Payment register etc.

5. The selected SECURITY AGENCY will be bound by the details furnished by them to DOP, while su
bmitting the bid or at subsequent stage. In case, if any of such document/s furnished by the agenc
y is found to be false, it would amount to breach of terms of contract and the SECURITY AGENCY wil
l be liable for legal action besides termination of contract.

6. The selected SECURITY AGENCY shall ensure that the security guards deployed at ATM sites conf
orm to the STANDARDS prescribed in the Private Security Agencies Rules framed by the State
Governments.

7. The selected SECURITY AGENCY shall furnish the following documents in respect of each securit
y guard deployed, before the commencement of contract :

(I) List of trained security guards identified/selected by agency for deployment with Bio
data i.e., date of birth, age, qualification address etc.

(II) Training certificate in From IV issued by training /institute /organization.

(III) Certified copy of the character certificate in Form III.

8. In case, the security guard deployed by the selected SECURITY AGENCY commits any act of omis
sion / commission resulting in loss/damage to the Post office, the selected SECURITY AGENCY shall
take appropriate disciplinary action against such personnel immediately on being brought to their
notice, failing which it would amount to breach of contract and may lead to termination of contract.

The Post office is also not precluded from taking action on its own against the security guards and t
he selected SECURITY AGENCY if the act and omissions of the security guard result in loss/damage
as aforesaid.

9. The selected SECURITY AGENCY shall provide proper uniform and identity card in Form IX to t
he security guard deployed at the ATM sites having the photograph of the person and personal info
rmation such as name, designation, address and identification mark etc.

10. The selected SECURITY AGENCY shall designate/deploy a field officer at its own cost who would r
egularly interact with officers of the DOP for better co-ordination, utilization of services, optimal ma
npower deployment etc., could be addressed.

11. It will be the responsibility of the selected SECURITY AGENCY to provide accommodation, transpo
rt, food, medical and any other requirement of their personnel deployed. The DOP will have no
liability what so ever in this regard at any stage.

12. Payment of bills will be made to the selected SECURITY AGENCY on a monthly basis as per actual
services. The SECURITY AGENCY has to submit invoice/bill in the first week of the succeeding mont
h for the services rendered in the preceding month. Wages of the deployed security guards shall b
e credited to the individual Post office account, as per salary slip issued by the selected SECURITY
AGENCY.

13. DOP reserves the right to amend or withdraw any of the terms & conditions contained in the Bid
Document or to reject any or all bids without giving notice or assigning any reason. The Post office
Head is the final authority for settling any dispute/s and his decision in this regard shall be final an
d binding on all.

14 The security guards of the selected SECURITY AGENCY shall be required to work in 1/3 shifts of 8
hours duration (excluding lunch / dinner recess) on all seven days with staggered weekly off. (Ther
e will be 03 shifts. Each shift will have 8 hours duration (excluding lunch / dinner recess) and 01 S
ecurity Guard will be on duty in each shift).

15. The security guard deployed shall be required to report for work at specified shift duty hours and
remain in the designated post till the end of the shift. In case, any post is vacant on any shift/day, t
he selected SECURITY AGENCY shall immediately provide replacement. In case the SECURITY AGEN
CY fails to provide replacement, the wages for that shift/day shall be deducted, on pro rata basis a
nd SECURITY AGENCY is liable to make good the financial/other losses suffered by the Post office.

16. The security personnel should


(a) Be of age group between 22 and 50 years.
(b) Have knowledge of at least two of the three languages- local/Hindi/English is essential.
(c) The security supervisors should have at least three years’ experience, should be a matric
ulate, physically fit and should be able to read & write in English.

17. The DOP’s authorized signatory will screen the security guard deputed/deployed, including variou
s educational/character certificates. No security guard should have been involved in any crime/or a
history sheeted anywhere in the country.

18. The duty hours should not exceed eight hours at a stretch. Continuous shifts by the same person
should be avoided and no post should remain unmanned. Odd duties/shifts may be required accor
ding to exigencies, which are to be provided by the SECURITY AGENCY.

19. Items of equipment - whistle, torch, uniform including rain coat, jersey etc., - for efficient dischar
ge of duty by the personnel shall be provided by the selected SECURITY AGENCY (at their own cost
) and should be in good presentable condition.

20. The selected SECURITY AGENCY shall arrange to safeguard men & material and the interest of th
e Post office at ATM sites by posting its security guard in such a manner and time to assure the P
ost office that its interest are fully and wholly safe guarded. This includes assisting the Post office i
n first-aid and fire safety operations as may be deemed necessary.

21. The selected SECURITY AGENCY shall ensure good behaviour, conduct, application and discharge
of duty of security guards engaged by them. They shall perform their duties effectively and diligen
tly in accordance with the general procedure laid down by the DOP from time to time.

22. For all intents and purposes, the selected SECURITY AGENCY shall be the “Employer” within the
meaning of various Labour Legislations in respect of security guards so employed and deployed at
Post office’s ATM sites for guarding, on contract.

23. The selected SECURITY AGENCY shall alone, be solely responsible for redressal of grievances/ res
olving of disputes relating to guards deployed. Post office, shall in no way, be responsible for any
damages, losses, FINANCIAL or other injury claims to any security guard deployed by the SECURITY
AGENCY in the course of his performing the functions/duties, or for payment towards any compens
ation.

24. The security guards deployed by the selected SECURITY AGENCY shall not have any claim of Mast
er and Servant relationship vis-à-vis Post office. They also shall not have any Principal and Agent re
lationship with or against the Post office.

25. The security guards of the selected SECURITY AGENCY shall not be treated or considered as empl
oyees of the Post office under any circumstances.

26. The security guards deployed by the selected SECURITY AGENCY under contract shall not be enti
tled for claim, pay, perks and other facilities which may be admissible to casual, part time/ confirm
ed employees of the Post office, during and/or after expiry of the contract. In case of termination of
the contract also, the security guards deployed by the SECURITY AGENCY shall not be entitled to a
ny or /and will not have any claim for absorption or relaxation for absorption in the regular / otherw
ise, in any capacity in the Post office.

27. The selected SECURITY AGENCY shall alone be liable to pay compensation for any damage/death
/injury sustained by the security guard or any other member of the selected SECURITY AGENCY as
sustained by them in the course of their work/duty at the ATM sites during the contract period.

28. In the event of theft, pilferage or damage to the Post office’s property, after necessary investigat
ions, if proved beyond doubt that the SECURITY AGENCY/their security guards are responsible, the
selected SECURITY AGENCY shall be responsible and make good all the losses /damage.

29. The selected SECURITY AGENCY will be required to pay minimum wages as prescribed under the
Minimum Wages Act for Central sphere. The SECURITY AGENCY will maintain proper record as requ
ired under the Law / Acts. They shall produce the records on demand to the concerned authority of
the Post office or any other authority under Law.

30. The selected SECURITY AGENCY will be responsible for compliance of all statutory provisions relat
ing to Employees Provident Fund, and Employees State Insurance etc. in respect of the security gu
ards deployed at ATM sites of the Post office.

31. The selected SECURITY AGENCY shall also be liable for depositing all taxes, levies, cess etc. from
time to time as per the rules and regulations in the matter.

32. Tax shall be deducted at the source (TDS) as per the provisions of the Income Tax Department by
the Post office and a certificate to this effect shall be provided to the SECURITY AGENCY by the Pos
t office.

33. In case, the selected SECURITY AGENCY fails to comply with any statutory/taxation liability under
appropriate law, and as a result thereof, if the Post office is put to any loss/obligation, monetary or
otherwise, Post office will be entitled to recover such damage/loss/deemed loss, either out of the o
utstanding bills or from the Security Deposit of the SECURITY AGENCY.

34. The selected SECURITY AGENCY will indemnify the Post office from all legal, financial, statutory, t
axation and any other liabilities.

35. The selected SECURITY AGENCY is required to execute an agreement as per the approved format
of the Post office immediately on award of the contract.

36. The Technical Part of the bid should be submitted along with an Earnest Money Deposit (EMD) if r
equired, failing which the bid shall be rejected outright.

7. Buyer Added Bid Specific Scope Of Work(SOW)

Text Clause(s)

SOW:-

​1. The Security Services/ Security Guard without guns on contract basis for the ATM situated at P
uri HO, Puri-752001 for a period of one year from the date of signing of contract.

2. 2. The security guard will be deployed for 24X7 hrs with proper uniform & id proofs since ATM will be oper
ating on every day.

Disclaimer/अ वीकरण

The additional terms and conditions have been incorporated by the Buyer after approval of the Competent
Authority in Buyer Organization, whereby Buyer organization is solely responsible for the impact of these clauses
on the bidding process, its outcome, and consequences thereof including any eccentricity / restriction arising in
the bidding process due to these ATCs and due to modification of technical specifications and / or terms and
conditions governing the bid. If any clause(s) is / are incorporated by the Buyer regarding following, the bid and
resultant contracts shall be treated as null and void and such bids may be cancelled by GeM at any stage of
bidding process without any notice:-

1. Definition of Class I and Class II suppliers in the bid not in line with the extant Order / Office Memorandum
issued by DPIIT in this regard.
2. Seeking EMD submission from bidder(s), including via Additional Terms & Conditions, in contravention to
exemption provided to such sellers under GeM GTC.
3. Publishing Custom / BOQ bids for items for which regular GeM categories are available without any
Category item bunched with it.
4. Creating BoQ bid for single item.
5. Mentioning specific Brand or Make or Model or Manufacturer or Dealer name.
6. Mandating submission of documents in physical form as a pre-requisite to qualify bidders.
7. Floating / creation of work contracts as Custom Bids in Services.
8. Seeking sample with bid or approval of samples during bid evaluation process. (However, in bids for
attached categories, trials are allowed as per approved procurement policy of the buyer nodal Ministries)
9. Mandating foreign / international certifications even in case of existence of Indian Standards without
specifying equivalent Indian Certification / standards.
10. Seeking experience from specific organization / department / institute only or from foreign / export
experience.
11. Creating bid for items from irrelevant categories.
12. Incorporating any clause against the MSME policy and Preference to Make in India Policy.
13. Reference of conditions published on any external site or reference to external documents/clauses.
14. Asking for any Tender fee / Bid Participation fee / Auction fee in case of Bids / Forward Auction, as the
case may be.
15. Any ATC clause in contravention with GeM GTC Clause 4 (xiii)(h) will be invalid. In case of multiple L1
bidders against a service bid, the buyer shall place the Contract by selection of a bidder amongst the L-1
bidders through a Random Algorithm executed by GeM system.

Further, if any seller has any objection/grievance against these additional clauses or otherwise on any aspect of
this bid, they can raise their representation against the same by using the Representation window provided in
the bid details field in Seller dashboard after logging in as a seller within 4 days of bid publication on GeM. Buyer
is duty bound to reply to all such representations and would not be allowed to open bids if he fails to reply to
such representations.

This Bid is governed by the General Terms and Conditions/सामा य िनयम और शत, conditons stipulated in Bid and
Service Level Agreement specific to this Service as provided in the Marketplace. However in case if any condition
specified in General Terms and Conditions/सामा य िनयम और शत is contradicted by the conditions stipulated in
Service Level Agreement, then it will over ride the conditions in the General Terms and Conditions.
In terms of GeM GTC clause 26 regarding Restrictions on procurement from a bidder of a country which shares a land border with India, any bidder from a country which
shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. While participating in bid, Bidder has to
undertake compliance of this and any false declaration and non-compliance of this would be a ground for immediate termination of the contract and further legal action

in accordance with the laws./ जेम क सामा य शत के खंड 26 के संदभ म भारत के साथ भूिम सीमा साझा करने वाले दे श के बडर से खर द
पर ितबंध के संबंध म भारत के साथ भूिम सीमा साझा करने वाले दे श का कोई भी बडर इस िन वदा म बड दे ने के िलए तभी पा होगा
जब वह बड दे ने वाला स म ािधकार के पास पंजीकृ त हो। बड म भाग लेते समय बडर को इसका अनुपालन करना होगा और कोई भी
गलत घोषणा कए जाने व इसका अनुपालन न करने पर अनुबंध को त काल समा करने और कानून के अनुसार आगे क कानूनी कारवाई
का आधार होगा।
