Scenario

▪ New Charter fixed!

▪ C/P clauses:
– Line 21 of C/P : Vessel on her delivery to be ready to receive cargo with
clean swept holds and tight, staunch and in everyway fitted for the cargo.
– Clause 46 of C/P : “… it is understood that on dely or upon arrival 1st
loading port, v/l to be clean grain standard up to independent surveyors
satisfaction.”
– Clause 13 in Fixture note: “Owners warrant that v/ls holds on delivery or
arrival first load port to be cleaned, swept washed down with freshwater,
dried up free from rust leaks, scale, free from salt and free from residue of
previous cargo in every respects ready to load up to satisfaction of
surveyor”

▪ Charterers takes delivery. Both owners & Chtr know hold is not
“grain clean”, but is ok for less clean cargo. Chtr decide to load
Iron ore at port of delivery.

▪ V/l complete voyage. Proceeds to second loadport. Charterer


wants to load cargo of rapeseed. Hold has to be cleaned to “grain
clean” standard. 5 days delay.

▪ Cleaning Holds in higher areas poses a particular challenge, especially at Sea when the vessel
may be rolling / pitching and it is unsafe for the crew. Is there any alternate way of cleaning these
areas without the need of sending crew – Samit..

▪ Based on my experience, we tend to fail the cargo hold inspection due to inadequate time given, to
properly prepare the cargo holds. Factors also include where vessel had dirty cargo and schedule
to load grain standard cargoes, which time is very crucial. – Elijah

▪ On some vessels, the cargo holds inspection it’s a really nightmare, due to requirement and limited
preparing time cause great stress for us, as crew members. - GG

Q&A – Hold failures

▪ Are Owners liable for breaching their maintenance obligations in case of intermediate hold failures due
to excessive rust? – Vikram.

▪ Grain cleaning standard is a range rather than a specific cleanness level. Does the master have the
right to demand in writing the cleaning requirements from the surveyor prior to the inspection? how to
dispute the results in case of failure? – Nikolaos..

▪ Normally, we understand the intermediate hold cleaning is under time chtrs' responsibility. Is there any
case that owners have compensated for intermediate hold cleaning for the reason of due diligence of
master and crews? - Kim

▪ When vessel fails hold inspection due to poor condition of hatches / lack of maintenance, Can
Charterers claim from owners? Similarly if holds fail due to poor condition of other hatch equipment not
connected with cargo ( hatch coaming etc) can a claim against owners arise? – Hamada.

Q&A – Charterer obligations

▪ Considering the size of ships, limited manpower & equipment, weather factor affecting Hold Cleaning,
we should consider the Charterer providing the manpower & resources at Load port to prepare the
Holds to their requirement. – Kamalaksha.

▪ In most cases, CP mention the holds ready to received permissible cargo OR cargo(es). In the latter
situation, can charterers still put owners on notice for subsequent cargoes if vsl passes first cargo(eg
coal) but not for second (eg grains/ferts) - Victoria

▪ Issues when time charter vessel for long period , first voy with lenient cleaning requirements like steel
coils. But 2nd cargo grains and fail due to previous cargo residues not from our charter but owners
refuse to be responsible claiming it's under IHC – Kuan.

Q&A – Cleaning standards

▪ Are there any particular requirements for preparing holds for cereals? Are there surface coating which
are not suitable for foodstuffs? – Andrew

▪ If the vessel fails hold inspection, CP usually says the vessel will be off-hire until the passing of re-
inspection. In this situation, can chrtrs claim head owner off-hire and compensation of demurrage that
chrter can legally obtain without off-hire? – Taro.

▪ In the hold condition CP, it is often put “cargo holds to be ready to load charterers intended cargo as
per officially authorised independent surveyor”. Question: which surveyor can be consider as the
“officially authorised independent surveyor” ? – Edouard..

Q&A – Charterer obligations- post charter

▪ Should a Charterers be responsible for cleaning of dust (cement crust) from decks, cranes, hatch
covers, deck fittings after loading of cement clinkers. – Sergii

▪ We have not seen charter party agreement with holds to be returned in same condition as taken at
time of delivery or hold upgradation after dry dock. Pls advise your comments. – Rishitosh.
