This is a PETITION FOR DECLARATION OF ANNULMENT OF MARRIAGE filed by Petitioner-wife


against the Respondent-husband.

Summons with copy of the Petition law served on Respondent personality on January 11,
2023 per the Process Server's dated January 13, 2023.

Per order dated January 13,2023, the Public Prosecutor of the City of Manila and/or the
Office of the Solicitor General were requested to conduct an investigation to find out if
collusion exist between the parties within thirty (30) days from receipt thereof.

The Department of Social Welfare and Development were also requested to a conduct a
Social Case Study of this case within thirty (30) days thereof and make recommendation on
the matter

On January 13, 2023, the Office of the Solicitor General filed a Notice of Appearance and
deputizing the Public Prosecutor of the City of Manila to assist the solicitation general in the
case.

This is to certify that the Order/Decision issued by the Honored Court presided by Marina M.
Manuel, Presiding Judge of the Regional Trial Court, National Capital Region Branch 25, City
of Manila in the matter for the Declaration of Nullity of Marriage into by and between Rona
Shella Dela Cruz and Mark Brian Cacao, on July 28,2011 at RTC Pasig under Civil Case No
3155 issued on September 21.2023 was already received by this office this 12 day of October,
2023 and therefore included in the official record filed in this Office under Registry No 2023-
67 Series of 2023

major defect in his personality structure. His flaws in personality rendered him
psychologically incapacitated to handle the essential obligation of marriage. The behavioral
disorder is permanent in nature and incurable in character. His difficulty to adjust to the
marriage speaks of a more serious psychological problem of their marriage.

The psychologist recommended that the marriage between petitioner and respondent be
declared annulled due to his personality disorder which is permanent and incurable.

No conjugal property was acquired during marriage.

WEHERFORE, PREMISES CONSIDERED, the Petitioner is therefore granted. Let the marriage
between RONA SHELLA DE LA CRUZ and MARK BRIAN CACAO be annulled, as it hereby
declared null and void, as if it never took place at all. Petitioner may however resume using
her maiden name if she so desires.

The City Civil Registrar of RTC Pasig the City Civil Registrar of Manila and Civil Registrar of
General, Philippines Statistics Authority (SPA), Quezon City, are directed to make the
necessary entries corrections on the record of the marriage between the petitioner and
respondent

It is SO ORDERED.

DECREE OF DECLARATION
OF ABSOLUTE NULLITY

WHEREAS, a decision dated October 12, 2023 in the above entitled case has been rendered.

WHEREAS, the said Decision provides that the parties did not acquire any property.

WHEREAS, the said Decision has become and executory with an Entry of
Judgement/Certificate of Finality has been issued on 10th day of July, 2022;

NOW THEREFORE, this Decree of Finality is hereby issued concerning the Decision on June 9,
2022 in the above entitled case, the dis-positive portion of which reads as follows, to wit:

WHEREFORE, premises considered the petition is GRANTED rendered declaring the marriage
between petitioner RONA SHELLA DE LA CRUZ and MARK BRIAN CACAO, GARCIA solemnized
on July 28, 2011 at RTC Pasig City is NULL AND VOID under Family Code, as amended
accordingly the property relation between the parties is dissolved.

On January 11,2023, Public Prosecutor Antonio V, Padilla filed a Report and Manifestation
asking that this case be set for trial on the merits as only the Petitioner appeared and it
difficult to ascertain if there is collusion between the parties.

Per Notice dated January 11, 2023, this case was set for hearing on February 06, 2023 at
11:00 o'clock in the morning.

Despite receipt of the Petition on January 11, 2023, Respondent did not file his answer or
responsive pleading to this Petition.

The Office of Solicitor General and the Public Prosecutor of the City of Manila and the DSWD
did not interpose any written objection to this petition.

At the hearing on February 06, 2023 the City Prosecutor of City of Manila appeared for and
in a behalf of Solicitor General but did not interpose any objection thereto, So, evidence for
the Petitioner was receive ex-partner.

The first witness presented was Petition herself. She testified that respondent was her
husband, they having been married on July 18, 2011 at RTC Pasig. Copy of the Certificate of
Marriage was marked as Ex. A".

From the documentary and testimonial evidence adduced by Petitioner, it was established
that they were introduced to each other by common friends. Since then, they were always
with their friends either chatting or just whiling away their time. Soon after, respondent
courted her and because she found him attractive and a gentlemen, she accepted his
proposal and they become sweethearts. They began dating exclusively and to avoid being
talked about by their neighbors, respondent proposed marriage to petitioner. Because she
loved him very much, she agreed and they were thus married on July 18, 2011 at RTC PASIG.
After their wedding, they lived as husband and wife. They were helping each other with the
household chores, However, because of financial constraint there were no more harmony in
their once very happy home. There was quarreling and disagreement most of the time. With
every little mistake committed by his wife, respondent would shout and their verbal
shouting with her. They were nearly on the verge of separation but with the intervention of
their parents, they promised to start all over again. There was love and harmony in their
home. They were helping each other and tried to be peaceful. However, because differences,
Respondent would always shout at her. He would hurt her physically and emotionally. He
always blames their misfortune to his wife. However, their happiness was short-lived as they
began.
