AFTER blocking social media platforms like X, the state

appears to have turned its attention to silencing dissent
on other platforms. The hastily passed Punjab
Defamation Act, 2024, is the latest in a series of
measures curtailing free speech under the pretext of
obviating the dissemination of fake news. Does the Act
merely address the infirmities underpinning the
Defamation Ordinance, 2002, or is it an attempt to
muzzle dissent?

Section 8 of the Act establishes tribunals which may

By placing adherence to statutory timelines on a higher

pedestal than competence and integrity, the Act allows
a member to pass muster even where his judgements
are egregiously unlawful or motivated by extraneous
factors.

While trials emanating from the 2002 Ordinance were

Such concerns are also aggravated by Section 26 which

Most disconcertingly perhaps, the Act shields

constitutional office holders from legitimate critique.
The Act’s ‘Statement of Objects’ state that defamation
“damages the reputation and image of public figures or
the government”. While the Act creates tribunals for
claims instituted by the general public, constitutional
office holders can directly invoke the high court’s
jurisdiction, thus, implying that holders of constitutional
offices require more protection than the general public.

The Act, thus, departs from principles entrenched in

other jurisdictions where public office holders have to
meet a higher threshold to prevail in a claim of
defamation since they voluntarily place themselves in
positions where their actions may be subjected to
heightened scrutiny. Moreover, public office holders
often have much greater access to the media than
average citizens and can use their access to the media
to rebut any defamatory statements without assistance
from the courts.

part of a series of actions symbolising the breakdown of
our democracy. Where then do we go from here?

The path to our salvation lies in political parties, the

judiciary, and critically the security establishment
coming together and acknowledging the follies which
have brought us to this juncture. Political parties in
particular need to preserve the democratic structures,
which are critical to their own survival. Will our ruling
elites shun short-term opportunism in the interest of
their own longevity, or will they continue to ingratiate
themselves with the actual custodians of power? Will
we ever learn from history?

IS our exchange rate ‘market-determined’ nowadays? Its
stability — around Rs280 to one US dollar — appears
both amazing and perplexing in the current difficult
balance-of-payments situation. This remarkable stability
reportedly helped the State Bank of Pakistan purchase
billions of dollars from the interbank foreign exchange
market over the last few months. Earlier, in the first half
of FY2024, the rupee first depreciated from Rs282 to
Rs333 within two months, ie, July-August 2023, and
then appreciated in the open market back to around
Rs280 during September-October. This behaviour
brought about by economic and non-economic forces,
with few fluctuations since then, helped the SBP
increase its dollar reserves through purchases.

During a period of high volatility in the open market, the

In our foreign exchange interbank market, those on the

goods via Pakistan and the suspension of B-category
exchange companies’ authorisation, further alleviated
the strains in the FX market.”

The ‘crackdown’ referred to here became both domestic

reported it as ‘The dollar galore in grey market’ and

According to the assessment of the IMF staff published
in their May 2024 report, “Gross debt-service
obligations remain substantial, and current account
imbalances stemming from insufficient exchange rate
flexibility and import restrictions may require additional
policy adjustment to reach external equilibrium.” Are
we about to see a move towards market-determined

I HAVE a dream that, one day, Pakistan’s local ‫ یاکشیان کے لوکل گورنمیٹ (ایل جی) کے ابنجایات کو اس‬،‫ ایک دن‬،‫میرا ای ک جواب ہے کہ‬

fledgling democracy must continue to fledge, it may do

It may seem like common sense that the third tier in a
democracy would be a natural extension of the

country, only receiving patronage from the unlikeliest
benefactors of democracy: military dictators.

Their attempt at using LGs to gain legitimacy — while
bypassing the national and provincial leadership — has

restructuring that they have been subjected to means

Even a political demand for establishing LGs has yet to
gain public traction. For one, tensions in the national
and provincial arenas are already so electrifying that
they consistently hold the country’s imagination captive.
In such instability, it is difficult to get attention spans to
rest on seemingly boring matters of local governance.
Secondly, public expectations from representatives are
entirely warped, wherein we look towards national-level
legislators to perform tasks that are categorically the
domain of LGs. Thirdly, LGs are too small, scattered, and
fractured of a polity to lobby for their own collective
rights.

LGs are the logical step in bringing governance closer to ‫ایل جی گورتیس کو زمین کے فربب الئے کے لنے ای ک م نطقی فدم ہیں۔‬
the ground.

All of this is not to say that Pakistan’s general elections

are a gold standard for LGs — far from it. But as flawed ‫ کے لنے ایک ستہری معیار‬LGs ‫اس سب کا مظلب یہ یہیں ہے کہ یاکشیان کے عام ابنجایات‬

This is also not a neoliberal call to champion some kind

But far from robust LGs with all the powers that ought
to rightfully be devolved to them, we seem unable to

A crisis of power ‫طاقت کا بحران‬

TEMPERATURES are soaring in Pakistan, as we edge into
summer. This means our energy consumption is going to
shoot up to over 29,000 MW. It also means that we’re
looking at more power cuts, planning our chores, work,
and rest around unpredictable and unannounced load-
shedding. As our air conditioners hum louder and fans
whirl faster (when there is electricity), the strain on our
fragile energy infrastructure becomes palpable.

Yet, the ramifications extend far beyond our homes. Our

economic development is strangled, bound as it is by
downtime and rising fuel costs. Manufacturing remains
im--perilled, as does agriculture, threatening livelihoods
and food security. In October 2023, Pakistan had an
energy deficit of 6,000 MW, incurring an import bill of
$7 billion.

According to the National Electric Power Regulatory
Authority’s 2022 annual report Pakistan’s installed
generation capacity adds up to 43,775 MW, of which a
paltry seven per cent comes from renewable energy
sources.

Making an energy transition towards a sustainable

Over the years, Pakistan’s power sector has grappled

carbon energy but lacks the infrastructure to fully
realise its benefits. There is no consensus among
stakeholders and significant financial constraints. And
with a population becoming more conscious of rising
emissions, there is a reputational cost of sticking to
fossil fuels.
