ከተገኘው የስራ ሌምድ አንዲንድ በከፍተኛው ፍርድ ቤት የተጀመሩ ጉዲዮችን ወዯ ላሊ ሥፍራ ማዛወር
አስፈሊጊ መሆኑ ስሇተዯረሰበት፤
እነኝህን ችግሮች ሇማስወገድ የወንጀሇኛ መቅጫ ሥነ ሥርዓት ሕግንና የፍትሏ ብሔር ሥነ ሥርዓት
ሕግን ማሻሻሌ አስፈሊጊ ስሇሆነ፤
የጊዜአዊ ወታዯራዊ አስተዲዯር ዯርግንና የሉቀ መንበሩን ሥሌጣን ሇመወሰን በወጣው አዋጅ ቁጥር
2/1977 ዓ.ም በአንቀጽ 6 መሠረት ከዚህ የሚከተሇው ታውጅዋሌ፡፡
1. አጭር ርዕስ
ይህ አዋጅ “የወንጀሇኛ መቅጫ ሕግ ሥነ ሥርዓትና የፍትሏብሔር ሥነ ሥርዓት ሕግ ማሻሻያ
አዋጅ ቁጥር 84/1969 ዓ.ም.” ተብል ሉጠቀስ ይቻሊሌ፡፡
2. መሻሻሌ
በ1954 ዓ.ም የወጣው የወንጀሇኛ መቅጫ ሕግ ሥነ ሥርዓት (እንዯተሻሻሇ) ከዚህ እንዯሚከተሇው
እንዯገና ተሻሽሎሌ፤
ቁጥር 1ዏ6 ተሠርዞ በሚከተሇው አዱስ ቁጥር 1ዏ6 ተተክቷሌ፤
“ቁጥር 1ዏ6 ክስን ወዯ ላሊ ሥፍራ ስሇማዛወር
1. ማስረጃ ከመሰማቱ በፊት ዏቃቤ ሕጉ ወይም ተከሳሹ ሇከፍተኛው ፍርድ ቤት፤
ሀ. ጉዲዩን መስማት የጀመረው የበታች ፍርድ ቤት በማመሌከቻ የቀረበሇትን ጉዲይ
ያሇአድል በትክክሌ ሇመስማት የማይችሌ መሆኑን፤ ወይም
ሇ. ጉዲዩ ዘወትር የማያጋይም አስቸጋሪ የሕግ ክርክር የሚያነሣ መስል መታየቱን፤ ወይም
ሏ. በዚህ ንዐስ ቁጥር (1) መሠተት ትእዛዝ ቢሰጥ ሇሁሇቱም ተከራካሪ ወገኖች ወይም
ሇምስክሮቹ ምቹ መሆኑን፤ ወይም

2. ማስረጃ ከመሰማቱ በፊት ከተከራካሪዎቹ ወገኖች አንደ በዚህ ቁጥር ንጉስ ቁጥር 1
ከ(ሀ) እስከ (ሏ) ከተመሇከቱት ምክንያቶች ውስጥ አንደ ምክንያት መኖሩን ሇጠቅሊይ
ፍርድ ቤት ሲያመሇክትና ፍርድ ቤቱም ሁሇቱን ተከራካሪ ወገኖች ሰምቶ አቤቱታውን
ከተቀበሇው ጉዲዩ በላሊ የከፍተኛው ፍርድ ቤት እንዱታይ ሇማዘዝ ይችሊሌ፡፡
3. “በዚህ ቁጥር መሠረት የቀረበ አቤቱታ ተቀባይነት ካሊገኘ በዚህ ምክንያት በላሇው
ተከራካሪ ወገን ሊይ የዯረሰውን ወጭ ሁለ ክስ ወዯ ላሊ ሥፍራ እንዱዛወር የጠየቀው
ወገን ይችሊሌ፡፡”
3. አዋጁ የሚጸናበት ጊዜ፤
ይህ አዋጅ በነጋሪት ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የጸና ይሆናሌ፡፡
WHEREAS, the criminal procedure code fails to provide for change of venue of proceedings submitted to
the High Court;
WHEREAS, experience shows that change of venue is necessary in some criminal proceedings that are
submitted to the High Court;
WHEREAS, the fact that change of venue is allowed at any time before judgment has been a cause of delay
and confusion in civil suits;
WHEREAS, to deal with these problems, it is necessary to amend both the Criminal procedure Code and
the civil procedure Code;
NOW, THEREFORE, in accordance with Article 6 of the Definition of powers of the Provisional Military
Administration Council and its Chairman proclamation No. 2/1974, it is here by proclaimed as follows;
1. Short title
This Proclamation may be cited as the “Criminal Procedure Code and Civil procedure Code (Amendment)
Proclamation No. 84/1976.”
2. Amendment
a) that a fair and impartial trial cannot be held in any criminal court subordinate thereto;
or
b) that some question of law of unusual difficulty is likely to arise; or
c) that an order under this sub-Article (1) will tend to the general convenience of the
parties or witnesses; or
d) that such an order is expedient for the ends of justice or is required by any provision
of this code;
It may, after hearing the parties in the case, make an order against which no appeal shall lie
to the effect that:

(i) any offence be tried by any court not empowered under the provisions of Arts. 99-104 of this Chapter
but in other respect competent to try such offence; or
(ii) an accused person be committed for trial to itself.
(2) The Civil Procedure Code of 1965, as amended, is court by application eiter by the public prosecutor
or by the accused before evidence is produced, sub-Art. 1 (a)-(b) of this Article exists, it may, after
hearing the parties in the case, make an order to the effect that the offence be tried by ssuch division
of the High Court as it shall direct.”
(a) that a fair and impartial trial cannot be held in any court subordinate thereto;
(b) that some question of law of unusual difficulty is likely to arise; or
(c) that an order under this sub-Article will tend to the general convenience of the parties or witnesses or
is expedient for the ends of justice;
(d) the high Court may, after hearing the parties in the case, make an order from which no appeal shall lie
to the effect that any suit:
(e) be tried by any court not empowered under the provisions of this Chapter to try it but having material
jurisdiction to try the same; or
(f) be transferred for trial by itself.
(2) Whenever it is made to appear to the Supreme Court by application by either party before
evidence is produced that any one of the reasons enumerated under sub-Artcle 1 (a)-(c) of this Article
exists, it may, after hearing the parties in the suit, make an order to the effect that the suit be tried by such
division of the high Court as it shall direct.
(3) The applicant for change of venue shall bear all expenses incurred by the other party if his application
under this Article is rekected.”
3. Effective Date
This Proclamation shall enter into force on the date of its publication in the Negarit Gazeta.
