Abstract

Insurance is defined as an agreement between two or more parties who bind themselves to the
insured by paying the insured for any loss, damage, or loss of expected profits. This research is
included in descriptive qualitative research with the type of literature review. Literature review is
the process of investigating and analyzing literature or written sources relevant to the research
subject. In this article the author wants to examine how the implementation of maqashid sharia in
the Islamic insurance system where it is expected that the maqashid sharia approach can offer a
logical and substantial perspective and description of operational activities, contracts, and goods
offered when assessing Islamic insurance. There are four scholarly opinions about insurance
from the perspective of Islamic law, namely the views of scholars who consider insurance haram,
halal, conditionally halal, and subhat In sharia insurance, the main principle is ta'awunu 'ala al
birr wa al-taqwa, which means helping each other in virtue and piety, and al-ta'min, which means
a sense of security.
