RE: HDPE PIPE LAYING BY KL MIDTOWN’S CONTRACTOR (MUTU NUSANTARA SDN BHD) AT PERSIARAN
DUTAMAS

Reference is made to the above.

We are writing in response to your letter dated 26th April 2024 (Ref No.: TKLM-P1B-PD-KLM-2024-04-042) regarding the
infrastructure construction works at Jalan Dutamas 2 (JD2), Persiaran Dutamas (PD), and the KL Metropolis development,
involving Suhati Sdn Bhd (Suhati), Mutu Nusantara Sdn Bhd (MNSB) and Loo Sek Choy Plumbing Construction Sdn Bhd
(LSC). KL Midtown Sdn Bhd (KLM), as the Project Manager, has been actively engaged in coordinating the works for the
upgrading works at Jalan Dutamas 2, including the ongoing coordination work regarding “TNB Rentis” to ensure the final
coordinated drawing benefits the Master developer while minimizing commercial impacts.

Nevertheless, MNSB obtained a DBKL excavation permit on 3rd April 2024 with a validity period of 1 month. The delay in
coordination was due to the completion of piloting work, which required the arrangement of the witness from TNB. MNSB
must complete the works within the timeline to obtain the subsequent permit from DBKL. Hence, the timely completion of
these works is essential for the above reason and the overall TNB energization for the hotel in KL Midtown, which has faced
delays due to permit approval. Given the stringent schedule constraints, KLM and MNSB proceeded with the ducting laying
works on 23rd and 24th April 2024 to avoid idling costs and commercial impacts on the hotel, which would be more costly
than relocating the ducts. We appreciate your understanding of the challenges and constraints we face as the JV partners of
KL Midtown.

Regarding the statement in your letter mentioning, "KLM as the PMC of the JD2 project has repetitively and continuously
failed in performing your duty as PMC on behalf of Client. Your ignorance and actions have shown that KLM has
compromised the execution and implementation of the JD2 project..." We would like to convey our disagreement with such a
statement. First, we would like to clarify that while KLM is not the consultant for this work, we have taken over the
upgrading works of JD2 as the Project Manager for the JD2 project at the request of TKLM. Throughout our engagement,
KLM has consistently respected and complied with the involvement and direction of the master developer, even though KLM
has taken over the project. Nevertheless, our commitment to professionalism and diligence remains unwavering. The master
developer's interests have always been a priority for KLM, and we have not compromised the execution or implementation of
the project.
We assure you that we are fully aware of the importance of coordinating the infrastructure works in this limited space and of
the work progress at the site. All our actions and decisions align to complete the project on time and to the highest quality
standards.
Regarding the statement in your letter mentioning "KLM as the PMC of the JD2 project has repetitively and continuously
