(Herein after referred to as "THE FIRST PARTY" (which expression shall unless it be
repugnant to the context or meaning thereof be deemed to mean and include her/his/their
respective heirs, executors, administrators and assigns) of the One Part: AND Piramal
Capital and Housing Finance Ltd a Company registered under the Companies Act, 1956
hereinafter referred to as the "COMPANY" having its branch office at No. No 13, Old No 5,
1st Main Road, Vasanth Nagar, Bengaluru, Karnataka 560052 · which expression shall include its
successors in interest and assigns) of the Other Part.

WHEREAS:

1) Consideration paid to HUF account to be a part of sale deed and property owner
will execute sale deed in individual capacity.

Whereas, the FIRST PARTY has handed over the original title deeds pertaining to the
Schedule Property in favour of the Company towards security to the loan availed by the
FIRST PARTY from the company.
Whereas, the FIRST PARTY sates that the following documents are not retrievable as this
belongs to the older transaction:

1) Consideration paid to HUF account to be a part of sale deed and property owner
will execute sale deed in individual capacity

The FIRST PARTY herein states and declare that she/he/they shall not hold the company
responsible for any future claim by any third party or interested party if any and shall keep
the company indemnified in future for all times and shall be solely responsible for the
same.
The FIRST PARTY herein states and declares and confirms that the Schedule Property is
not mortgaged to any Banks/ Financial Institutions/ Scheduled Banks/ Government or
Semi Government bodies and the Schedule Property is Free from all encumbrances,

litigations, minor claims, mortgage/chares, prior agreements, etc.

Relying upon the aforesaid representation, the Company has agreed to sanction the Loan
upon the FIRST PARTIES indemnifying the Company as hereinafter appearing the
Obligors have agreed to do.

NOW THIS DEED OF INDEMNITY WITNESSETH, that in consideration of what is


stated hereinabove, the FIRST PARTY do hereby agree and undertake to indemnify
and keep indemnified and forever save harmless the Company against all demands,
claims, suits, actions, proceedings and litigations etc., that may be adopted by anybody
in respect of the Schedule Property, by virtue of such person being in possession of the
Original, Title Deed in respect of the aforesaid Property as a consequence of the same
being delivered elsewhere as security and the FIRST PARTY do and further agree and
undertake to indemnify and keep indemnified and save harmless the Company against all
costs, charges and expenses on defending any such actions, suits, proceedings, demands,
notices, prosecutions, claims, litigations, etc. that the obliges may suffer or incur as a
consequence of including but not limited to non-furnishing of documents and non-
stamping and non-registration of any the aforesaid documents and also on account of any
declarations, statements and/or representations made hereinabove against any costs,
charges and expense that may from time to time be incurred or sustained or suffered by
the Company and/or its assets, effects and estate and/or incidental to or arising from such
claims, demands suits, actions and for proceeds made, taken, brought, institutional filed
or levied against or upon the Company and/or the said shares and/or the Schedule
Property or any part thereof for any other reason howsoever or whatsoever.

IN WITNESS WHEREOF the FIRST PARTY has hereunto set and subscribed
her/his/their respective hand the day and year herein above written.

I state that the Schedule Property is mortgaged to Piramal Capital and Housing Finance
Ltd, as security for the loan sanctioned and for which, I have deposited the original Title
documents of the Schedule Property with Piramal Capital and Housing Finance Ltd.

DESCRIPTION OF PROPERTY:-

All that piece and parcel of the property bearing Northern portion of Site No.23, House List
No.133/7, out of Old VP katha No.133/7, New BBMP Form B Katha Sl.No.168, Property
No.133/7/23, situated at Doddathogur Village, Begur Hobli, Bangalore South Taluk, presently
comes under the BBMP limits measuring East to West: 63.5+65/2=64.25 and North to South:
50.5+50.8/2=50.6 feet measuring 3252.5 Sq.ft out of totally measuring 6505.3125 Sq.ft. and
bounded on;
